And whereas, the Central Government, in exercise of the powers conferred by section 9 of the National Highways Act, 1956 (48 of 1956) has framed the National Highways Fee (Determination of Rates and Collection) Rules, 2008, vide Notification No. G.S.R. 838 (E) dated the 5th December, 2008, and amended vide Notification Nos. G.S.R. 950(E) dated 3rd December, 2010, G.S.R. 15(E) dated 12th January, 2011, G.S.R. 756(E) dated 12th October, 2011 and G.S.R. 778 (E) dated 16th December, 2013, G.S.R. 26(E) dated 16th January, 2014 G.S.R. 831(E) dated 4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 21st November, 2014 and G.S.R 220(E) dated 23rd March, 2015 for collection of fee for use of sections of national highways, permanent bridges, bypasses and tunnels; Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956), read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the “said Rules”), the Central Government hereby levies the fee at 100% of the base rate specified in columns (2) in Table 1 for net road section length of 55.8184 km [excluding 0.1616 Km of structure (having length more than 60 m) with equivalent length of 1.616 km] (hereinafter referred to as “base rate”) for use of the four lanning sections on the Type of Vehicles specified in column (1) of Table 1 below and 01 bypass having a length of 5.86 Km. at 150% of the base rates specified in column-2 of Table-1 below for the use of Jorbat-Shillong (Barapani) section of NH-40 from Km. 0.000 to Km. 61.840* in State of Assam and Meghalaya and authorizes the Authority to collect, either through its officials or through a contractor, the said fee, namely:- *End chainage of the project i.e Km. 61.840 is same as end chainage of the NH entrusted to NHAI i.e Km. 61.800 vide notification S.O 1937(E) dated 09.08.2010. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometres from the toll plaza is Rs. 230.00 (Rupees Two Hundred Thirty only) for the year 2015-16 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: Amount Payable Maximum number of one way Period of validity journeys allowed One and half times of the fee for one way Two Twenty four hours from the journey time of payment Two-third of amount of the fee payable for Fifty One month from date of fifty single journeys payment 6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions including category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the rules. 9. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules. 10. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority on the basis of the completed length of the section and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly. 6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] 11. The estimated capital cost of the project is Rupees 1372.40 Crore (Rupees One thousand three hundred Seventy two crore and forty lakh only). The capital cost is subject to variation as the activities of land acquisition, utility shifting, tree cutting etc. are yet to be completed. The final capital cost will be notified separately. The Authority shall maintain a record of the recovery of capital cost through user fee realized and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules.
