Stretch Section Entrustment notification No. published vide 1 Guwahati Bypass section S.O. 196(E) dated 06.03.2000 Km 156.500 to km 164.395 of NH-37 2 Nagao to Guwahati section (including S.O. 465(E) dated 26.04.2002 Km 164.395 to km 274.000 of NH-37 Guwahati bypass) 3 Nagaon Bypass New Stretch KM. 0.000 to Km. 15.943 of NH-37 4 Km 0.000 – Km 38.000 of NH-36 Daboka-Nagaon S.O. 465(E) dated 26.04.2002 5 Km. 0.000 to Km. 309.000 of NH- Silchar to Haflong to Lanka to Daboka Section S.O. 465(E) dated 26.04.2002 54/54E (in the state of Assam) issued under Section 11 of the National Highways Authority of India Act, 1988 (68 of 1988), the Central Government has entrusted the stretch (above) to the National Highways Authority of India (hereinafter referred to as the Authority) ; And Whereas, pursuant to the provision of Section 14 of the National Highways Authority of India Act, 1988 (68 of 1988), the Authority has entered into an agreement (hereinafter referred to as said agreement) on 17th October, 2014 with M/s Northeast Tollways Private Limited having its registered office at 101, Shree Amba Shanti Chambers, Opp. Hotel Leela, Andheri-Kurla Road, Andheri East, Mumbai-400059 (hereinafter referred to as the “Concessionaire”), for bids submitted on 22.05.2014 for the Operation and Maintenance of Guwahati Bypass-Nagaon-Daboka-Udauli Section of NH-37, 36 & 54/54E from Guwahati Bypass and from Km. 163.90 to 262.725 (NH-37), from Km. 0.000 to Km. 15.943 (NH-37), from Km. 5.500 to Km. 35.862 (NH-36), from Km. 0.000 to Km. 40.000 (NH-54/54E) (hereinafter referred to as the “said section”) on Operation, Maintenance & Transfer (OMT) basis; Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956), read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 published vide G.S.R 838(E) dated 5th December, 2008 and its amendment till bid submission date (hereinafter referred to as the “Rules”), the Central Government, having regard to the expenditure involved in maintenance, management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of said section at the rates specified in column (2) of Table 1 for net road section length of 166.059 km (excluding 1.237 Km of structure having length more than 60 m with equivalent length of 12.37 Km) for use of the four & more lane sections(hereinafter referred to as “base rate”) and one and half times of base rate for bypasses having an aggregate length of 37.866 Km costing each Bypass Rupees Ten Crore or more on the type of vehicles specified in column(1) of Table 1 below and authorizes the said Concessionaire to collect and retain the fee for the use of the said section on and from the date of commercial operation declared by the Authority or publication of this notification in the Official Gazette, whichever is later, till the termination date as specified in the agreement; TABLE-1 Type of vehicle Base rate of fee per km for the base year 2007-08 (in Rupees) (1) (2) Car, Jeep, Van or Light Motor Vehicle 0.65 Light Commercial Vehicle, Light Goods Vehicle or Mini Bus 1.05 Bus or Truck (Two Axles) 2.20 Three-axle commercial vehicles 2.40 Heavy Construction Machinery (HCM) or Earth Moving Equipment (EME) or Multi 3.45 Axle Vehicle (MAV) (four to six axles) Oversized Vehicles (seven or more axles) 4.20 1. The rate of monthly pass for a person who owns a mechanical vehicle registered for non-commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 225.00 (Rupees Two Hundred and Twenty- five only) for the year 2014-15, which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008. 5. For multiple journeys on the highway section, passes shall be issued at the following rates, namely: Amount Payable Maximum number of one Period of validity way journeys allowed One and half times of the fee for one way journey Two Twenty four hours from the time of payment Two-third of amount of the fee payable for fifty or more Fifty or more One month from date of payment single journeys 6. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles. 7. The driver or owner or a person in charge of a Mechanical vehicle which is loaded in excess of permissible load specified for its category, shall be liable to pay fee for entering the overloaded vehicle on the National Highway to the toll collecting agency, equal to ten times of the fee applicable to such category of mechanical vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle. 8. All definitions, category of mechanical vehicles, its permissible load, category of exempted vehicles, service road, alternative road etc. shall be as per definitions specified in the Rules. 9. The fee rates shall be displayed for information of the users in accordance with Rule 12 of the said Rules. 10. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table-1 above, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority. The same shall be got published by the Authority in at least one newspaper, each in English and vernacular language through the Concessionaire and thereafter revised annually in accordance with the rule 5 of the said Rules and provisions of the Concession Agreement and will be published; provided, however, that such revision shall not be effected until a period of 6 (six) months from preceding revision of fee. 11. The Present Value of Capital Cost of the project to be recovered from the date of COD is Rs. 2413.65 Crore (Rupees Two Thousand Four Hundred Thirteen Crore and Sixty-five Lac Only). From the Commercial Operation Date (COD) toll shall be collected by the Concessionaire at the applicable rates provided under the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and further amendments till bid due date. The Capital Cost shall be recovered through Concession Fee by discounting @ 12% per annum to arrive at NPV as on the date of commercial operation (COD). After the day on which the Capital Cost is recovered the toll rates chargeable shall be reduced to 40% of the rate being charged. The Concession Fee shall also be reduced to 40% of the amount payable and annual increment of 10% as per Clause 21.1.1 shall be applicable. 12. In case, due to any reason, COD is advanced/postponed, the capital Cost to be recovered shall be reworked and intimated to the concessionaire within 30 days after actual COD, by the Engineer/Independent Engineers.
