(2) They shall come into force on the date of their publication in the Official Gazette. In the Schedule to the Ministry of Law and Justice, Legislative Department, Official Languages Wing (Group `A' and Group IV Posts) Recruitment Rules, 2003, for serial number 3 relating to the post of Additional Legislative Counsel (Regional Languages Branch) and corresponding entries against it under columns (2) to (14), the following shall be substituted, namely : [ TIT II — t_q 3(i)] 1TM : 37(1NR-tit 5 SCHEDULE (3) (4) (5) (6) (7) "3. Promotion : Deputy Legislative Counsel (Regional Languages Branch) of Official Languages Wing, Legislative Department with five years' regular service in the grade failing which Deputy Legislative Council (Regional Languages Branch) with ten years' combined regular service in the grades of Deputy Legislative Council (Regional Languages Branch) and Assistant Legislative Counsel (Regional Languages Branch) with at least two years' regular service in the grade of Deputy Legislative Counsel (Regional Languages Branch). Note (1) :—Where juniors who have completed their qualifying/ eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requi- site qualifying/eligibility service by more than half of such qualify- ing/eligibility service or two years, whichever is less, and have suc- cessfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying/eligibility service.. Note (2):— For the purposes of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 01-01-2006, i.e. the date from which the revised pay structure based on the 6th Central Pay Commission's recommenda- tions has been extended, shall be deemed to be the service rendered in the corresponding pay/pay scale extended based on the recom- mendations of the said Pay Commission. Deputation : Officers under the Central or State Government— (i) holding analogous posts on regular basis in the Parent Cadre or Department; or (ii) with five years' service in the grade rendered after appointment thereto on a regular basis in the PB-3 Rs.15600-39100 plus Grade Pay of Rs.7600/- or equivalent in the Parent Cadre or Department; and possessing the following educational qualifications and experience : Essential : A.(i) Master's Degree in Law (LLM) from a University established or incorporated by or under a Central Act; a Provincial Act or a State Act or any institution for higher education deemed to be a Univer- sity by the Central Government or any other institution or foreign University approved by the .Central Government; and 3L I 6 THE GAZETTE OF INDIA : EXTRAORDINARY PART II—SEc. 3(i)] (12) (ii) should be a member of State Judicial Service for a period of ten years; or should have held a post in the legal department of a State Govern- ment for ten years; or should be a Central Government servant who has had experience in legal affairs for ten years; Or should be a qualified legal practitioner who has practised as such for ten years; or should be a teacher of law for ten years in a recognised institution; or should have ten years' experience of translation into the language (one of the languages, other than Hindi, mentioned in the Eighth Schedule to the Constitution) concerned of statutes, statutory rules and orders in Central or State Governments; or should have ten years' experience of drafting of statutes in the Cen- tral or State Governments; or B. (i) Bachelor's Degree in Law (LLB) from a University established or incorporated by or under a Central Act; a Provincial Act or a State Act or any institution for higher education deemed to be a Univer- sity by the Central Government or any other institution or foreign University approved by the Central Government; should be member of State Judicial Service for a period of twelve years; or should have held a post in the legal department of a State Govern- ment for twelve years; or should be a Central Government servant who has had experience in legal affairs for twelve years; or should be a qualified legal practitioner who has practised as such for twelve years; or should be a teacher of law for twelve years in a recognised institu- tion; or should have twelve years' experience of translation into the lan- guage (one of the languages other than Hindi mentioned in the Eighth Schedule to the Constitution) concerned of statutes, statu- tory rules and orders in Central or State Government; or should have twelve years' experience of drafting of statutes in the Central or State Government; Passed Secondary School Examination or any higher examina- tion from a recognised Board or University or Institution through medium of language (one of the languages other than Hindi men- tioned in the Eighth Schedule to the Constitution) concerned or had offered the language concerned as a subject in Secondary School Examination or any higher examination. ITRU (1,7144 : 37iTt1R11 7 Desirable : Five years' experience of legislative drafting in the language (one of the languages other than Hindi mentioned in the Eighth Schedule to the Constitution) concerned in Central or State Government. Bachelor's degree from a University established or incorporated by or under a Central Act; a Provincial Act or a State Act or any institution for higher education deemed to be a Universityby the Central Government or any other institution or foreign University approved by the Central Government with the language (one of the languages other than Hindi mentioned in the Eighth Schedule to the Constitution) concerned as a subject or medium at degree level. Note (1).—The exact requirement of the language concerned shall be indicated at the time of recruitment. Note (2).— For the purposes of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 01-01-2006, i.e. the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been ex- tended, shall be deemed to be service rendered in the correspond- ing grade pay/pay scale extended based on the recommendations of the said Commission except where there has been merger of more than one pre-revised scale of pay into one grade with common grade pay/pay scale, and in the case of such merger this benefit will extend only for the post(s) for which that grade pay/pay scale is the normal replacement of the grade prior to 01-01-2006 without any u pgradati on. Note :—The departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment by promotion. (Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation/department of the Central Government shall ordinarily not exceed five years.
