PurposeofandNeedforAction Introduction ThisEnvironmentalAssessmentanalyzestheimpactsofapproving"typicalremediations"ofphysical humansafetyhazardsassociatedwithAbandonedMinedLands(AMLs)onpubliclandsinNevada.The proposedactionprovidesaframeworkthatallowsmostproposalsthatinvolveremediationofhazardous of24 01/03/20012:551' http://www.nv.blm.gov/AMLRemediationEAJ AMLsonBureauofLandManagement(BLM)landsinNevadatobeanalyzedinoneprogrammatic EnvironmentalAssessment(EA).IfaproposaltoremediateorsecureanAMLconformstothesubject regulationsandtotheframeworkofthisdocument,thenBLMmayallowtheproposalwithoutfurther detailedanalysis.ThisEAispartoftheBLM'sdecisionmakingprocessinaccordancewiththeNational EnvironmentalPolicyAct(NEPA),theFederalLandPolicyandManagementActof1976(FLPMA). TheNevadaBureauofLandManagement(BLM)enteredintoaCooperativeAgreementwiththeNevada DivisionofMinerals(NDOM)in1994toestablishandmaintaincoordinationandresponsibilities pertainingtothesecuringofminesafetyhazardsonBLM-managedlandsinNevada.Theagreement, pursuanttoSection307ofFLPMA,authorizesNDOMtosecureAMLsafetyhazardsonBLMlandsin Nevada. TwelvehumanfatalitiesandmanyinjurieshaveresultedfromincidentsinvolvingAMLsitesinNevada since1971.Thespreadofurbanpopulationsintoareaswheresuchsitesarecommonandexpanding recreationaluseofpubliclandsmakessuchincidentsincreasinglylikely.Oftheestimated155,000AML sitesinNevada,about50,000mayposeseriousriskstohumansafety.Onlyabout5,500ofthesehavebeen securedbyfencingorbackfillingtodate.Whilepublicinformationcampaignsdescribingthehazardsof AMLsiteshavebeenconducted,theneedtosecureotherhighrisksitesisimmediate.Thepurposeofthis EAistoexpeditethesecuringofhazardoussiteswhichdonotrequiremorespecificNEPAanalysis. Applicationsofthisdocument: CategoricalExclusions: CertainactionsmayfallundercategoricalexclusionsandthusnotrequireanalysisunderthisEA.Whenno exceptionsasdescribedinDepartmentalManual[516DM2.3A(3)&Appendix2]apply,Installationof minordevicestoprotecthumanlife,(e.g.gratesacrossmines)donotrequireanEAorEIS.(Federal Register/Vol.57No62/Tuesday,March31,1992)FRDoc92-6700.
