Handicapped Access There is no federal of state . requirement of handicapped access for the proposed residential parking area. Neither Title III of the Civil Rights Act nor the Americans With Disabilities Act, which govern handicapped access in public accommodations and commercial facilities, require that residential accommodations have handicapped access. The Massachusetts Handicapped Access Board does not have jurisdiction over residential areas or over rental property of less than five rooms. M.G.L.A. c. 151B, Section 4 (6) - 4 (7B). 2. Drainage The landscape architect recommends that an . on-site dry well be placed within the proposed parking area, as shown on the plan submitted with the proposal. Such a dry-well is more suitable than a connection to a water drain because the dry well would provide better moisture for the plants and trees proposed for the area. The water that could possibly collect within the parking area is sufficiently slight to be adequately accommodated by a dry well. Only if percolation is unsatisfactory would it be necessary to provide a connection to a main water drain.
