In 2013, it took placeon10–11May,lessthantwomonthsbeforetheexpectedaccessionofCroatia totheEuropeanUnion.ThisvolumecontainspaperspresentedattheConference, updatedtomatchthestateofaffairson31December2014. This bookexplores the reactions toEuropeanizationandglobalizationintimes of economic distress, including the transformation of European values in national legal cultures. The authors explore how European values, tradition and new legal challenges interconnect and dictate the paths of transition between old and new Europe.Thefirstchapterstartswithaquestion:canRomanLegalTraditionplaythe roleofanidentityfactorinthetransitiontoanewEurope?Canitbeconsideredasa general value identifying a new Europe, built on a minimum core of principles— persona, dominum, obligation, contract and inheritance—composing the entire Europeanprivatelawtradition?Thefollowingchaptersattempttoprovidepossible responsestothequestion:whatis Europetoday?Theanswersdiverge, depending ontheresearcharea.TheinherentdichotomyofhumanrightsprotectioninEurope and the concept of “one law, one court” are investigated in the second chapter, whilethethirdchapterfocusesonasylumandtherelationshipbetweentheCourtof Justice of the EU and the European Court of Human Rights, as well as the interdependence between these institutions. The next three chapters concentrate onmattersofequaltreatmentandnondiscrimination.Thefirstcontributionofthis section reflects on the crisis and methodological and conceptual issues faced by modernantidiscriminationlaw.Itisfollowedbyaspecificanalysisoftheempow- erment of women or gender balancing in company boards. The third contribution examines the impact of Croatian antidiscrimination law on private law relations. ThenextchapterdealswiththeissueofsocialrightsinCroatiaandtheirregulation inthecontextofnewEuropeanvalues. The immense challenges posed by the market integration imperative and dem- ocratic transition have brought about different reactions in the national legal systems and legal cultures of both old and new Member States. As such, Europe v vi Foreword haseffectivelybeenreunited,butthequestionoftheconvergenceofnationallegal cultures remains. This is the focal point of the remaining chapters, which discuss various issues, including the internal market, competition law, consumer welfare, theliberalizationofnetworkindustriesandtheEUcapitalmarket.ThelevelofEU activity in these areas offers conclusive evidence that old and new paradigms are evolvingandshapingthefutureoftheEU.
