Parties of different nationalities sign contracts with implications in far corners of the planet, for which both jurisdiction and applicable law are not always pre-determined. One should thus ask himself the right questions. In case of conflict, should I choose to resort to arbitration or to another alternative dispute resolution method? Should I rather submit the dispute to traditional judges, and if so, before what jurisdiction? Rising competition among seats and institutions When resorting to arbitration, then the seat and eventually the arbitral institutions must be chosen. Today the range of options is larger than ever, with traditionally iconic seats such as London, Paris, Geneva or New York being challenged by new locations. According to recent research*, Singapore and Hong Kong rank among the five most preferred seats. The results show the same trend for arbitral institutions: HKIAC (Hong Kong International Arbitration Center) and SIAC (Singapore International Arbitration Center), both in the top five. The change of scenery is global: Africa wants to have its share, with Mauritius paving the way to ADR on the continent and in Latin America, in spite of the relatively young culture of arbitration, an ever increasing number of conflicts are submitted to arbitration, notably important local disputes. Cost and duration in the eye of the storm Cost remains an issue. Users often complain about the expenses of arbitration sometimes due to excessive duration. The ICC International Court of Arbitration seems to hear the message: in January 2016, the Court announced cuts in arbitrators’ fees in case of unjustified delay in rendering the decision. Why not resort to third party funding for litigation or international arbitration when cost is a problem? These funds, dedicated to financing arbitration or trials, are becoming more common around the world, for matters of any size. In early 2016, the New York litigation funding firm Burford Capital signed a financing litigation agreement with BT Group for $45 million. Other disruptive players, such as E-Just, are appearing. This is only the beginning of a global rescaling of financing methods and seats for dispute resolution, certain to bring the field greater accessibility, innovation and competition. *Conducted by the School of International Arbitration at Queen Mary University of London.
