National courts witness the same issues over and over again: dispute resolution is too slow, not always trustworthy and sometimes even corrupt. It comes as no surprise then that resorting to alternative dispute resolution (ADR) is regarded as a viable alternative. Yet ADR faces its share of problems. The arbitration community is often seen as a small club, with a limited number of overstretched practitioners, and therefore prone to conflicts of interest. New challenges, new solutions What to do to broaden the scope? New challenges call for new solutions. In insurance, for example, arbitrators have tended to be underwriters or brokers. However, drawing from a wider pool could bear significant fruit. Initiatives aimed at fighting the subconscious biases which still exist are flourishing. Everywhere you look arbitration is being democratized, with a larger number of young professionals, women and people with a broader spectrum of backgrounds breaking into the practice. New seats and institutions have been gaining more attention, reflecting the success of this on-going process. Solutions also lie in financing dispute resolution. Third-party funding, now commonplace in both arbitration and litigation, has developed recently but for some it still lacks regulation and others believe the criteria in relation to fees and what to finance – among other things – need to be standardized. The high cost of arbitration is also hindering development, but here too solutions are being found. In the dispute resolution arena, technology is helping gain time, improve efficiency and, therefore, save money. Litigation has an equal opportunity to benefit from it. Virtual hearings and the use of specialized software to collect data and review documentation are just two ways in which technology is transforming the scene. In addition, litigation support and legal crisis communication specialists aggregate and help define legal strategy efficiently. Of course, high standards of ethics and transparency must be applied because without them other conflicts will arise. Disputes are getting more complex, numerous and cross-border. These new human and technological solutions allow us to manage today’s litigations and arbitrations. Let’s make the most of them.
