April 20, 2018 AIP No. 3-32-0005-049-2018 INVITATION FOR BIDS 65 66 67 Elko Regional Airport 68 Elko, Nevada 69 AIP Project No. 3-32-0005-049-2018 70 PWP No. EL-2018-176 71 72 Sealed bids, subject to the conditions contained herein, for improvements to the Elko Regional 73 Airport, Elko, Nevada, AIP Project No. 3-32-0005-049-2018 will be received by the office of the 74 Elko City Clerk, 1751 College Avenue, Elko, Nevada 89801 until 2:00 p.m. local time, on May 21, 75 2018. 76 77 The work involved will include the following: 78 79 Schedule I - Construct Airfield Lighting Vault 80 81 Bid Proposals received after the above noted time will not be accepted. Bidders mailing their bids 82 assume the risk of late delivery. 83 84 The approximate quantities of major bid items involved in the proposed work are: 85 87 Construct Airfield Lighting Vault – LS 88 89 Construction for this project is expected to take 60 calendar days. 90 91 Contract Documents. The complete set of bidding documents, plans, specifications, contract 92 documents, and addendums can be downloaded from the Elko City Clerk's website at elkocity.com. 93 All bidders must register with the Elko City Clerk via email or phone at [email protected] or 94 (775) 777-7127. All bidders shall appear on the official plan holder’s list. It is the planholder’s 95 responsibility to review the site for addendums and changes before submitting their proposal. 96 97 Bid proposals must be submitted on the prescribed forms and accompanied by security in the amount, 98 form and subject to the conditions listed in the Instructions to Bidders. 99 100 Bid proposals will be opened at City Hall immediately after the above deadline with the bid amounts 101 submitted being read aloud by City Staff and interested parties present, if any. All interested parties are 102 invited to be in attendance at the bid opening. 103 104 All bids must be submitted in a sealed envelope and legibly marked AIP Project No. 3-32-0005-049- 105 2018 Construct Airfield Lighting Vault. City staff shall thoroughly review all bid proposals for 106 conformance with the contract documents prior to making a written recommendation for award to the 107 City of Elko. 108 109 The award may be made to the lowest responsive and responsible bidder. The lowest responsive and 110 responsible bidder shall be judged on the basis of price, conformance to specifications, bidder's 111 qualifications, conformance to applicable sections of NRS Section 338, and the best interest of the City 112 of Elko. Each of the listed factors will be considered. 113 114 Pre-Bid Conference. The pre-bid conference for this project will be held on Tuesday, May 1, 115 2018, at 10:00 a.m. local time, at the Elko Regional Airport, 975 Terminal Way, Elko, Nevada. 116 Issued for Bid Division 1-1 Jviation, Inc. April 20, 2018 AIP No. 3-32-0005-049-2018 117 Bid Conditions. The bidder is required to provide all information as required within the Contract 118 Documents. The bidder is required to bid on all items of every schedule or as otherwise detailed in 119 the Instructions to Bidders. 120 121 Bids may be held by the City of Elko for a period not to exceed 90 calendar days from the date of 122 the bid opening for the purpose of evaluating bids prior to award of contract. The City of Elko may 123 formally award the contract to the successful bidder at their regularly scheduled meeting at City Hall 124 on Tuesday, May 22, 2018, after 4:00 PM, local time. 125 126 The right is reserved, as City of Elko may require, to reject any and all bids and to waive any 127 informality in the bids received. 128 129 All questions regarding the bid are to be directed to Diann Byington, Elko City Recording Secretary, 130 at 1751 College Avenue, Elko, NV 89801, Ph: (775) 777-7127, Fax: (775) 777-7129, or email 131 [email protected]. 132 133 LABOR COMMISSIONER: The Nevada Labor Commissioner’s identifying number for this 134 project is: PWP No. EL-2018-176. NRS 338.013 requires that identifying number to be included in 135 all Bids. 136 137 Pursuant to the Statutes §§ 338.020 to 338.090 of the State of Nevada, the Labor Commissioner has 138 established the minimum wage rates and rates of overtime and legal holidays in the locality in which 139 the work is to be performed. Additionally, there are Federal requirements for minimum wage rates. 140 The higher of these two shall prevail. Nevada bidder preference Statute NRS §§338.147 is not 141 applicable to the Project. 142 143 Bid Bond. Guarantee will be required with each bid as a certified check on a solvent bank or a bid 144 bond in the amount of ten (10) percent of the total amount of the bid, made payable to the City of 145 Elko. 146 147 Performance & Payment Bond. The successful bidder will be required to furnish separate 148 performance and payment bonds each in an amount equal to 100% of the contract price. 149 150 Airport and Airway Improvement Act of 1982. In accordance with the Davis-Bacon Act and 151 Elko County Prevailing Wage Law, the Contractor will be required to comply with the wage and 152 labor requirements and to pay minimum wages in accordance with the schedule of wage rates 153 established by the United States Department of Labor and Nevada Division of Labor Standards, 154 respectively. The highest rate between the two (Federal and County) for each job classification shall 155 be considered the prevailing wage. 156 157 Non-Segregated Facilities. The successful bidder will be required to submit a certification of 158 Non-Segregated Facilities and to notify prospective subcontractors of the requirement for such a 159 certification where the subcontract exceeds $10,000. 160 161 Equal Employment Opportunity and Affirmative Action Requirement. The proposed 162 contract is under and subject to 41 CFR Part 60-4 and Executive Order 11246 of September 24, 163 1965, as amended, and to the equal opportunity clause and the Standard Federal Equal Employment 164 Opportunity Construction Contract specifications including the goals and timetables for minority 165 and female participation. 166 Issued for Bid Division 1-2 Jviation, Inc. The City of Elko, in accordance with the provisions of Title VI of 168 the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. §§ 2000d to 2000d-4) and the Regulations, 169 hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to 170 this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to 171 submit bids in response to this invitation and will not be discriminated against on the grounds of 172 race, color, or national origin in consideration for an award. 173 174 DBE REQUIREMENT. 175 176 Information Submitted as a matter of bidder responsiveness: 177 The Owner’s award of this contract is conditioned upon Bidder or Offeror satisfying the good 178 faith effort requirements of 49 CFR §26.53. 179 As a condition of bid responsiveness, the Bidder or Offeror must submit the following 180 information with its proposal on the forms provided herein: 181 (1) The names and addresses of Disadvantaged Business Enterprise (DBE) firms that will 182 participate in the contract; 183 (2) A description of the work that each DBE firm will perform; 184 (3) The dollar amount of the participation of each DBE firm listed under (1) 185 (4) Written statement from Bidder or Offeror that attests their commitment to use the DBE 186 firm(s) listed under (1) to meet the Owner’s project goal; and 187 (5) If Bidder or Offeror cannot meet the advertised project DBE goal, evidence of good faith 188 efforts undertaken by the Bidder or Offeror as described in appendix A to 49 CFR part 26. 189 Information Submitted as a matter of bidder responsiveness: 190 The Owner’s award of this contract is conditioned upon Bidder or Offeror satisfying the good faith 191 effort requirements of 49 CFR §26.53. 192 As a condition of bid responsiveness, the Bidder or Offeror must submit the following information 193 with its proposal on the forms provided herein: 194 (6) The names and addresses of Disadvantaged Business Enterprise (DBE) firms that will 195 participate in the contract; 196 (7) A description of the work that each DBE firm will perform; 197 (8) The dollar amount of the participation of each DBE firm listed under (1) 198 (9) Written statement from Bidder or Offeror that attests their commitment to use the DBE 199 firm(s) listed under (1) to meet the Owner’s project goal; and 200 (10) If Bidder or Offeror cannot meet the advertised project DBE goal, evidence of good faith 201 efforts undertaken by the Bidder or Offeror as described in appendix A to 49 CFR part 26. 202 The bidder shall make good faith efforts, as defined in Appendix A of 49 CFR Part 26, Regulations 203 of the Office of the Secretary of Transportation, to subcontract 0.86 % of the dollar value of the 204 prime contract to small business concerns owned and controlled by socially and economically 205 disadvantaged individuals (DBE). In the event that the bidder for this solicitation qualifies as a 206 DBE, the contract goal shall be deemed to have been met. Individuals who are rebuttably presumed 207 to be socially and economically disadvantaged include, women, Black Americans, Hispanic 208 Americans, Native Americans, Asian-Pacific Americans, and Asian-Indian Americans. The apparent 209 successful bidder will be required to submit information concerning the DBE's that will participate Issued for Bid Division 1-3 Jviation, Inc. The information will include the name and address of each DBE, a description of 211 the work to be performed by each named firm, and the dollar value of the contract. If the bidder 212 fails to achieve the contract goal stated herein, it will be required to provide documentation 213 demonstrating that it made good faith efforts in attempting to do so. A bid that fails to meet these 214 requirements will be considered non-responsive. Those firms currently certified as DBE's by the 215 Nevada Department of Transportation are eligible to participate as DBE's on this contract. A list of 216 these firms can be obtained from the State, the consulting engineer, or the Sponsor. 217 218 Buy American Preference. 219 The Contractor agrees to comply with 49 USC § 50101, which provides that Federal funds may not 220 be obligated unless all steel and manufactured goods used in AIP funded projects are produced in 221 the United States, unless the Federal Aviation Administration has issued a waiver for the product; 222 the product is listed as an Excepted Article, Material Or Supply in Federal Acquisition Regulation 223 subpart 25.108; or is included in the FAA Nationwide Buy American Waivers Issued list. 224 225 A bidder or offeror must complete and submit the Buy America certification included herein with 226 their bid or offer.
