If the Bill is enacted the Rules will be made by the Lord Chancellor. PrintedimagedigitisedbytheUniversityofSouthamptonLibraryDigitisationUnit Interpretation 2.-(l) In these Rules - "the 1984Rules" meanstheImmigrationAppeals (Procedure) Rules 1984(a); "the 1971Act" means theImmigrationAct 1971(b); "the 1992Act" means theAsylum Act 1992(c); "asylumappeal"meansanyappealmadeunderanyofthesubsections (1)to(4)ofsection 5ofthe1992Actandshallincludeanyappealwhich,byvirtueofparagraph1ofSchedule 2tothatAct, shallbedealtwithinthesameproceedings as the appealbroughtunderany ofthose subsections; "special adjudicator" means an adjudicatordesignatedundersection5(6) ofthe 1992Act; and "theTribunal" means theImmigrationAppealTribunal. (2) IntheseRules, thetimebywhichanyact must be done shallbecalculatedinthemanner providedinrule24. Application 3.-(l) Allasylum appeals shallbebroughtunder these Rules. (c) 1992c. 2 PrintedimagedigitisedbytheUniversityofSouthamptonLibraryDigitisationUnit PART 11 APPEALSTO SPECIALADJUDICATORS Application ofPart II 4. This Partappliestoasylum appeals toaspecialadjudicator. Leave to appeal 5-(1) An asylum appeal may bebrought onlywiththe leaveofaspecial adjudicator. (2) Anapplicationforleaveshallbemadenotlaterthan2daysaftertheapplicanthasreceived notice ofthedecisionagainstwhichhewishes toappeal. (3) Anapplicationforleave shall bemadebylodging- (a) inthecaseofanapplicationrelatingtoanappealundersection5(1)or(4)ofthe1992 Act, with an immigrationofficer; and (b) inthecaseofanapplicationrelatingtoanappealundersection5(2)or(3)ofthe1992 Act,withtheSecretaryofState, theForm prescribedintheScheduletotheseRuleswhichshallbeaccompaniedbythenotice(or acopyofthenotice)informingtheapplicantofthedecisionagainstwhichhewishestoappealand thereasons forthedecision. (4) Uponreceipt ofan applicationfor leave, theimmigration officer orSecretaryofState (as thecase may be) shall forthwith send to aspecialadjudicator that application (and the notice or copyaccompanyingit)togetherwiththenotesofinterviewandanydocumentsuponwhichreliance was placedinreachingthe decision. (5) Aspecialadjudicatorshalldetermineanapplicationforleaveassoonaspracticableand,in any event, notlaterthan5 days afterreceivingthedocumentsreferredtoinparagraph(4). (6) Aspecial adjudicatorshall determineanapplicationforleavewithoutahearing. (7) A special adjudicator shall grant an applicant leave to appeal unless satisfied that the applicantdoesnothaveanarguableclaimforasylumwithinthemeaningofsection l(l)(b) ofthe 1992Act. (8) A special adjudicator (or officer acting for him) shall send to the applicant and to the immigration officer orSecretary ofState(as thecasemaybe) anotice ofhis determinationand, whereleaveto appeal is refused, he shall send totheapplicantandto the immigrationofficeror Secretary ofState(as thecasemay be) thereasons fortherefusal. 3 PrintedimagedigitisedbytheUniversityofSouthamptonLibraryDigitisationUnit Notice ofappeal 6-(1) Theapplicationforleavetoappealshallbedeemedtobetheappellant'snoticeofappeal. (2) Thespecialadjudicator(orofficer actingforhim)shallnotlaterthan5 days afterleaveto appeal has been granted serve onthe appellant anoticeofthedate, time and place fixedfor the hearing. (3) Thenoticeofappealmaybevariedoramplifiedbytheappellantandservedonthespecial adjudicatorandontheimmigrationofficerortheSecretaryofState(asthecasemaybe)notlater than5 days afterhe has receivedthenoticeofthe special adjudicator's determination. Responseby Secretary ofState 78., Wherethenotice ofappeal oranyvariationor amplification ofthatnotice madepursuant torule6(3)disclosesanynewfactsormattersinsupportofhisasylumappealnotpreviouslyraised bytheappellant,theSecretaryofStatemay,notlaterthan5daysafterthetimeprovidedforbyrule 6(3)hasexpired, serveontheappellantandonthespecialadjudicatorawrittenstatementrelating tothatnewfact ormatter. Parties -(l) Thepartiestoanappealshallbetheappellantandthe Secretary ofState. (2) TheUnitedKingdomRepresentativeoftheUnitedNationsHighCommissionerforRefugees shallbetreatedas apartytoanappealupongivingwrittennoticetothespecialadjudicatoratany timeduringthecourseoftheappealthathedesirestobesotreated. Determination ofappeal 9-(1) Subjecttorule23, aspecialadjudicatorshalldetermineanappealnotlaterthan42days afterleavetoappealhasbeengranted. - (2) Subjecttorule35ofthe1984Rules anappeal shall bedisposed ofby hearingunless (a) theappealhasbeenabandonedbytheappellant; or (b) thedecisionbeingappealedagainst has beenwithdrawn orreversed, andthe special adjudicatorissatisfiedthatwrittennoticeofthewithdrawalorreversalhasbeengiven to theappellant. Adjournmentofhearings 10.-(1) Subjecttorule9(1),aspecialadjudicatormaygrantanapplicationforanadjournment ofahearinguponbeingsatisfiedthatthereisgoodcausefortheadjournment. 4 PrintedimagedigitisedbytheUniversityofSouthamptonLibraryDigitisationUnit (2) Where a hearing is adjourned, the special adjudicator shall give notice either orally orin writingto everyparty totheproceedings ofthe timeandplace oftheadjourned hearing. Summoning ofwitnesses H_(l) A special adjudicator may,forthepurposes ofany appeal, by summons require any personintheUnitedKingdomtoattendaswitnessatahearingoftheappealatsuchtimeandplace asmaybespecifiedinthesummonsand,subjecttorule29(2)ofthe1984Rules,atthehearingto answeranyquestions orproduceanydocumentsinhiscustodyorunderhiscontrolwhichrelateto any matterinquestion intheappeal. (2) Any such summons shallbeintheFormprescribedintheScheduletotheseRules. Personal attendanceofappellant J2.-(1) In any case where the appellant fails to attend the hearing of the appeal in person without goodcausebeingshown, thespecialadjudicatorshall dismiss theappeal. (2) Whereanappealhasbeensodismissed,thespecialadjudicatormay,subjecttorule9(1)an-d uponbeingsatisfiedbytheappellantthathehadgoodcauseforhisfailuretoattendthehearing (a) set asidethedismissal; and (b) arrangefortheappealtobeheardatsuchtimeandplaceasheshallnotify eachparty totheproceedings eitherorallyorinwriting. (3) The determinationonanyappeal(togetherwiththereasons therefor) shallberecordedby thespecialadjudicatorinadocumentsigned byhim. 5 PrintedimagedigitisedbytheUniversityofSouthamptonLibraryDigitisationUnit PART 111 APPEALSTOTRIBUNALFROMSPECIALADJUDICATOR 14. Application ofPart111 ThisPartappliestoappealsonapointoflawtotheTribunalunderthe1971Act,asapplied by Schedule2tothe 1992Act, from thedetermination ofaspecialadjudicator. Leave to appeal 15.-(1) Anappealshallbebroughtonlywiththeleaveofaspecialadjudicatoror,ifsuchleave isrefused, withtheleave oftheTribunal. (2) Anapplicationforleavetoaspecialadjudicatorshallbemadenotlaterthan5daysafterthe applicant has receivednotice ofthedetermination againstwhich hewishes to appeal; and, in the eventofleavebeingrefused, anyapplicationtotheTribunalforleavetoappealshallbemadenot laterthan5 days aftertheapplicanthasreceivednoticeofthespecial adjudicator's decision. (3) Anapplicationfor leave shallbemade by lodgingwiththespecial adjudicatoror, as the case may be, the Tribunal the Form prescribed in the Schedule to these Rules which shall be accompanied by the document (or copy of the document) recording the special adjudicator's determination. (4) An application for leave shall be determined not later than 5 days after its receipt by a specialadjudicatoror, asthecasemaybe,theTribunal. (5) Anapplicationforleavemaybedeterminedwithoutahearing. (6) Anapplicationforleaveshallnotbegrantedunlessaspecialadjudicatoror,asthecasemay be, theTribunal issatisfied thattheappealinvolves anarguablepoint oflaw. (7) Aspecial adjudicator or, as the casemay be, the Tribunal shall send to theparties tothe asylumappealanoticerecordingthedeterminationoftheapplicationforleaveand,whereleaveto appealisrefused, thereasons fortherefusal. Noticeofappeal 16.-(1) The application for leave to appeal shall be deemed to be the appellant's notice of appeal. Timewithin whichappeal is to be determined Every appeal under this Part shall be determined not later than 42 days after the date of servicebytheTribunal oftheappellant's noticeofappeal. Evidence 20. In any proceedings on an appeal the Tribunal shall receive as evidence the sumnar recordtakenorkeptinaccordancewithrule40ofthe1984Rulesofanyevidencereceivedbythe specialadjudicatorinthe course oftheproceedings towhichtheappealrelates. Adjournmentofhearings,personalattendanceofappellantandpromulgationofdetermination and reasonstherefor 21. Rules10,12and13oftheseRulesshallapplytothisPartastheyapplytoPart11exceptthat thereferencesinthoserulestoMspecialadjudicator shall betakentobereferencestotheTribunal. 7 PrintedimagedigitisedbytheUniversityofSouthamptonLibraryDigitisationUnit PARTIV GENERALPROCEDUREANDMISCELLANEOUS [Whereappropriate, the relevantprovisions ofthe 1984Rules willbeincorporatedby referencesoas to apply to appeals broughtundertheseRules] Deemedgrantofapplication 22. WhereaspecialadjudicatorortheTribunalfailstodetermineanyapplicationforleaveunder theseRuleswithinthetimeprescribed, theapplication shall bedeemedtohavebeengranted. Extension oftimelimit 2234.. WhereaspecialadjudicatorortheTribunal isrequiredto determineanappealunderthese Ruleswithinthetimeprescribed, thespecialadjudicatoror, asthecasemaybe,theTribunalmay ifnecessary extendthetimesoprescribedtoenableitfairly todeterminetheappeal. Time -(l) Subject to paragraph (2), any notice or other document that is sent or served under theseRules shallbedeemedto havebeenreceived- (a) wherethenoticeorotherdocumentissentbypost,onthedayafterwhichitwassent; and (b) inany othercase, onthedayonwhichthenoticeorotherdocumentwasserved. (2) WhereanoticeorotherdocumentissentbyposttoaspecialadjudicatorortotheTribunal, itshallbedeemedtohavebeenreceivedonthedayonwhichitwasactuallyreceivedbythespecial adjudicatoror, asthecasemaybe,theTribunal. (3) Where under these Rules, anact is to be donenot later than a specified period afterany event, theperiodshallbecalculatedfrom theexpiryoftheday onwhichthe event occurred. (4) Where the time provided by these Rules by which any act must be done expires on a Saturday,Sundayorabankholiday, ChristmasDayorGoodFriday, theactshallbedoneintime ifdoneonthenextworkingday. (5) Where, apartfrom thisparagraph, theperiodinquestionbeingaperiodof10days orless wouldincludeaSaturday, Sundayorbankholiday, Christmas DayorGoodFriday,thatdayshall beexcluded. 8 PrintedimagedigitisedbytheUniversityofSouthamptonLibraryDigitisationUnit PART V APPEALS FROM TRIBUNAL ApplicationofPart V 25. This Part appliesto applications undersection 6ofthe 1992Act for leaveto appeal from afinaldeterminationoftheTribunal. Leaveto appeal to the CourtofAppeal 26-(1) AnapplicationtotheTribunalforleavetoappealshallbemadenolaterthan10days afterthepartyseekingtoappeal(referredtohereafterinthisruleas "theapplicant")hasreceived noticeofthe determination. (2) AnapplicationforleaveshallbemadebylodgingwiththeTribunalanoticeofapplication forleavetoappealintheFormprescribed intheScheduletotheseRules. (3) Anapplication may be determined by the President ora chairmanoftheTribunal acting alone. (4) TheTribunalshalldeterminetheapplicationwithoutahearingunlessitconsiders thatthere arespecialcircumstancesmakingahearingnecessary ordesirable.
