The state plan is Montana's Eligibility Document that was submitted to the U.S. Department ofEducation for Federal Fiscal Year (FFY) 2001. On July 2, 2001, the U.S. Department of Education provided written notification to the Office of Public Instruction that the enclosed state plan has been fully approved. As a result ofits approval, Montana is eligible to receive IDEA Part B and Preschool funds for the support of special education services to eligible students with disabilities. As part of the eligibility document submission for FFY 2001, the Office of Public Instruction made an assurance, under 34 CFR 80.11(c). that it will comply with all federal statutes and regulations in effect with respect to the periods for which it receives grant funding. The state plan contains Montana's policies and procedures for the conduct of special education. Local education agencies must provide special education services to eligible students with disabilities in accord with these policies and procedures.
