Subpart C of part IV of sub- 4 chapterA ofchapter 1 ofthe Internal Revenue Code of 5 1986 (relatingtorefundablecredits)isamendedbyredes- 6 ignating section 35 as section 36 and byinserting after 7 section34thefollowingnewsection: 8 "SEC. 35. PREMIUMS PAID BY MILITARY RETIREES FOR 9 MEDICAREPARTB. — 10 "(a)AllowanceofCredit. InthecaseofaneU- 11 gibleindividual,thereshallbeallowedasacreditagainst 12 the tax imposed bythis chapter for the taxable year an 13 amountequaltothe aggregatepremiumspaidundersec- 14 tion1840ofthe Social SecurityActbythetaxpayerdur- 15 ingthetaxableyearforenrollmentoftheeligibleindivid- 16 ualunderpartBoftitleXVIIIofsuchAct. — 17 "(b) Eligible Individual. For purposes of sub- 18 section(a),theterm'eligibleindividual'means 19 "(1) an indi\idualwho is entitledto retired or 20 retainer pay based upon service in the uniformed 21 services(asdefinedinsection 101oftitle10,United 22 StatesCode), 23 "(2) the spouse (as determined under section 24 7703) of an individual described in paragraph (1), 25 and -HR4167IH 1 3 1 "(3) thewidoworwidower, asthecasemaybe, 2 ofjanindividualdescribedinparagraph(1).". — 3 (b)TechnicalAmendments. 4 (1) Paragraph (2) of section 1324(b) of title 5 31, United States Code, is amendedbystriking"or 6 enacted" and inserting "enacted" and by inserting 7 before the period ", or from section 35 of such 8 Code". 9 (2) Thetable ofsections for subpart C ofpart Id IV of subchapter A of chapter 1 of such Code is 11 amendedbystrikingthelast item andinsertingthe 12 followingnewitems: "Sec. 35.Premiumspaidbymilitaryretireesformedicarepart ' . B. "Sec.36.Overpaymentsoftax.". — 13 (c) Effective Date. The amendments made by 14 thissectionshallapplytoexpensesincurredafterDecem- 15 ber31, 1997. 16 SEC.3.ELIMINATIONOFMEDICAREPARTBPREMIUMPEN- 17 ALTY. 18 (a) InGeneral.—Section 1839(b) oftheSocial Se- 19 curityAct (42 U.S.C. 1395r(b)) isamendedbyaddingat 20 the end the following: "Any increase in an individual's 21 monthly premium under the first sentence of this sub- 22 section shall notbe applicablewith respectto aneligible 23 individual(ordependentofsuchanindividual),asdefined 24 insection25B(b)oftheInternalRevenueCodeof1986.". m •HR4167 cmLIMMV 3 flOTS DODLflH?! 1 — 1 (b) Effective Date.
