PREMIUMS PAID BY CERTAIN SENIOR CITIZENS 2 FORMEDICAREPARTB. — 3 (a) In General. Subpart C of part IV of sub- 4 chapterAofchapter 1 ofthe Internal Revenue Code of 5 1986 (relatingtorefundablecredits)isamendedbyredes- 6 ignating section 35 as section 36 and by inserting after 7 section34thefollowingnewsection: 8 "SEC. 35.PREMIUMS PAID BYCERTAINSENIORCITIZENS 9 FORMEDICAREPARTB. — 10 "(a)AllowanceofCredit. Inthecaseofaneli- 11 gibleindividual,thereshallbeallowedasacreditagainst 12 the tax imposed bythis subtitle for the taxable year an 13 amountequaltotheaggi'egatepremiumspaidundersec- 14 tion 1840oftheSocial SecurityActb}^thetaxpayerdur- 15 ingthetaxableyearforenrollmentoftheeligibleindi^^d- 16 ualunderpartBoftitleX\r[IIofsuchAct. — 17 "(b) Eligible iNDmDUAL. For purposes of sub- 18 section(a),theterm'eligibleindividual'means 19 "(1) an individual born after 1916 and before 20 1922 who had wages or self-employment income 21 credited for one or more years prior to 1979 and 22 who was not eligible for an old-age or disabilityin- 23 surance benefit, and did not die, prior to Januar^^ 24 1979, •HR122IH Cr-';sLibrary C2-07-13 "o yr>^:O!tOimSr>crcsu.rlMiayrvBi:?v=rd!.'< llVAn 1 "(2) the spouse (as determined under section 2 7703) of an indi^ddual described in para^aph (1), 3 and 4 "(3) thewidoworwidower, asthecasemaybe, 5 ofanindi\ddualdescribedinparagraph(1).". — 6 (b)TechnicalAjviendments. 7 (1) Paragi-aph (2) of section 1324(b) of title 8 31, United States Code, is amended bystriking "or 9 enacted" and inserting "enacted" and by inserting 10 before the period ", or from section 35 of such 11 Code". 12 (2) The table ofsections for subpart C ofpart W 13 of subchapter A of chapter 1 of such Code is 14 amendedby strikingthe lastitem andinsertingthe 15 followingnewitems: "See.35.Premiumspaidbycertainseniorcitizensformedicare partB. "See.36.Overpaymentsoftax.". — 16 (c) Effectr^ Date. The amendments made by 17 this section shall apply to premiums paid after the date 18 ofenactmentoftliisAct. 19 SEC.3.ELIMINATIONOFMEDICAREPARTBPREMIUMPEN- 20 ALTY. — 21 (a) InGeneral. Section 1839(b) ofthe SocialSe- 22 curityAct (42 U.S.C. 1395r(b)) isamendedbyaddingat 23 the end the following: "Any increase in an indi^idua^s 24 montlily premium under the first sentence of this sub- •HR122IH 4 "3 aOTS Q00LQ5UT 0 1 section shall notbe applicablewith respect to an eligible 2 individual(ordependentofsuchanindividual),asdefined 3 insection 35(b) ofthe InternalRevenue Code of1986.". — 4 (b) Effective Date.
