COVERAGE OF COUNSELING FOR CESSATION OF 2 TOBACCO USE UNDERTHE MEDICARE PRO- 3 GRAM. 4 (a)Coverage.—Section1861(s)(2)oftheSocialSe- 5 curityAct(42U.S.C. 1395x(s)(2))isamended— 6 (1) in subparagi-apli (Z), by striking "and" at 7 theend; 8 (2) in subparagraph (AA), byadding "and" at 9 theend;and 10 (3)byaddingattheendthefollowingnewsub- 11 paragraph: 12 "(BB) counseling for cessation of tobacco use 13 (asdefinedinsection 1861(ddd));". 14 (b) Sera^ces Described.—Section 1861 of such 15 Act (42 U.S.C. 1395x) is further amendedbyadding at 16 theendthefollowingnewsubsection: 17 "(ddd) Counseling for Cessation of Tobacco — 18 Use. (1) Subjecttoparagraph (2),theterm'counsehng 19 for cessation oftobacco use' means diagnostic, therapy, 20 and counsehng services for cessation oftobacco use, for 21 indiAidualswhousetobaccoproductsorarebeingtreated 22 fortobaccouse,furnished 23 "(A)byorunderthesupendsionofaphysician; 24 or 25 "(B) by any other health care professional 26 who •HR6393IH — 3 1 ''(i) is legally authorized to furnish such 2 services under State law (or the State regu- 3 lator^^mechanismprovidedbyStatelaw) ofthe 4 State in which the services are furnished; and 5 "(ii) is authorized to receive payment for 6 other services under this title or is designated 7 bytheSecretaryforthispurpose. 8 ''(2)Suchtermishmitedto 9 "(A) servicesthatareincludedinthemostcur- 10 rent chnical practice guidehnes on treating tobacco 11 use and dependence issued by the Public Health 12 Service;and 13 "(B) suchotherservicesthatthe Secretaryrec- 14 ognizestobeeffective.". — 15 (c)Payment;EliminationofDeductible. 16 (1) Payment.—Section 1833(a)(1) ofsuchAct 17 (42U.S.C. 13951(a)(1))isamended— 18 (A)bystriking"and"before"(V)";and 19 (B) by inserting before the semicolon at 20 the end the following: ", and (W) with respect 21 to counsehng for cessation of tobacco use (as 22 definedin section 1861(ddd)), the amountpaid 23 shall be 80 percent ofthe lesser ofthe actual 24 chargefortheserviceortheamountdetermined •HR6393IH — 4 1 by a fee schedule established by the Secretary 2 forpurposesofthisclause". — 3 (2) Elimination op deductible. The first 4 sentence ofsection 1833(b) ofsuch Act (42 U.S.C. 5 13951(b))isamended 6 (A)bystriking"and"before"(8)";and 7 (B) byinsertingbefore the period the fol- 8 lowing: and (9) such deductible shall not 9 applywithrespecttocounsehngforcessationof 10 tobaccouse (as definedin section 1861(ddd))". 11 (d) Effective Date.—The amendments made by 12 this section shall applyto ser\ices furnished on or after 13 January 1 ofthe first calendaryearthatbegins atleast 14 6monthsafterthedateoftheenactmentofthisAct. 15 SEC. 3. COVERAGE OF TOBACCO CESSATION 16 PHARMACOTHERAPYUNDERTHEMEDICARE 17 PROGRAM. 18 (a) Inclusion ofTobacco CessationAgentsas 19 Co^^3RED Drugs.—Section 1860D-2(e)(l) ofthe Social 20 SecurityAct (42 U.S.C. 1395w-102(e)(l)) isamended— 21 (1) in subparagraph (A), bystriking"or" after 22 thesemicolonattheend; 23 (2)insubparagraph(B),bystrikingthecomma 24 attheendandinserting";or";and •HR6393m 5 1 (3)byinsertingaftersubparagraph (B)thefol- 2 lomngnewsubparagraph: 3 "(C) anyagent approvedbytheFood and 4 DrugAdministrationforpurposesofpromoting, 5 and when used to promote, tobacco use ces- 6 sation that may be dispensed without a pre- 7 scription (commonlyreferredtoasan'over-the- 8 counter'drug),butonlyifsuchanagentispre- 9 scribedbyaphysician (orotherperson author- 10 izedtoprescribeunderStatelaw),". 11 (b) Establishment of Categoriesand Classes — 12 Consisting of Tobacco Cessation Agents. Section 13 1860D-4(b)(3)(C) ofthe Social SecurityAct (42 U.S.C. 14 1395w-104(b)(3)(C))isamendedbyaddingattheendthe 15 followingnewclause: 16 "(iv) Categories and classes of — 17 tobacco cessation agents. There 18 shall be a therapeutic category or class of 19 covered part D di-ugs consisting ofagents 20 approvedbythe Food and DrugAdminis- 21 tration for cessation oftobacco use. Such 22 categors^orclass shall includetobacco ces- 23 sation agents described in subparagraphs 24 (A) and (C)ofsection 1860D-2(e)(l).". •HR6393IH — 6 1 SEC.4.COVERAGEOFCOUNSELINGANDMEDICATIONFOR 2 CESSATION OF TOBACCO USE UNDER THE 3 MEDICAIDPROGRAM. 4 (a) Dropping Exception From Medicaid Pre- 5 scRiPTiON Drug Coverage for Tobacco Use Ces- — 6 SATiONMedications. 7 (1) In GENERAL.—Section 1927(d)(2) of the 8 Social Security Act (42 U.S.C. 1396r-8(d)(2)) is 9 amended 10 (A)bystrikingsubpara^aph (E); 11 (B) by redesig:nating subpara^aph (F) 12 through (K) assubparagraphs (E) through(J), 13 respectively;and 14 (C) in subparagraph (F), as so redesig- 15 nated,byinsertingbeforetheperiodattheend 16 thefollowing: otherthan agents approvedby 17 theFoodandDrugAdministrationforpurposes 18 of promoting, and when used to promote, to- 19 baccouse cessation (regardless, forpurposes of 20 this title only, ofwhether such agents may be 21 dispensedonlyuponprescriptionormaybedis- 22 pensed A^ithout a prescription (commonly re- 23 ferred to as an 'over-the-counter' drug), but 24 only ifsuch an agent is prescribed bya physi- 25 cian (or other person authorized to prescribe 26 underStatelaw))". •HR6393IH 7 j\CC/i2F'-OS0G7LZ-ibniic3awr'ytyB!vd. Section 2 1860D-2(e)(2)(A) of the Social Security Act (42 3 U.S.C. 1395w-102(e)(2)(A)) is amendedbystriking 4 otherthan subparagraph (E) ofsuch section (re- 5 latingtosmokingcessationagents),". 6 (b) Requiring Co\^rage of Tobacco Use Ces- 7 SATiON Counseling.—Section 1905(a)(4) of such Act 8 (42U.S.C. 1396d(a)(4))isamended— 9 (1)bystriking"and"before"(C)";and 10 (2) by adding at the end the following: and 11 (D) counsehng for cessation oftobacco use (as de- 12 finedinsection1861(ddd));". 13 (c) Treatment of Tobacco Cessation Services 14 AND Medications as Services Related to Preg- — 15 NANCY. Section 1905 ofsuchActisamendedbyadding 16 attheendthefollowingnewsubsection: 17 "(y) Sendees describedin subsection (a)(4)(D) shall 18 be treated as services related to pregnancywith respect 19 towomenduringpregnancy(andduringthe60-dayperiod 20 beginningonthelastdayofthepregnancy.". — 21 (d) Epfectr^ Date. The amendments made by 22 thissectionshallapplytoitemsandsendeesfurnishedon 23 or afterJanuarys 1 ofthe firstcalendaryearthatbegins 24 atleast 6 months afterthedateoftheenactmentoftliis 25 Act. HR6393IH ensLIBRARV IDLII 8 3 flDTS T 1 SEC.5.PROMOTINGCESSATIONOFTOBACCOUSEUNDER 2 THE MATERNAL AND CHILD HEALTH PRO- 3 GRAM. 4 (a)QuALm'MaternalandChildHealth Serv- 5 ICES Includes Tobacco Use Cessation Counseling 6 and Medications.—Section 501 ofthe Social Security 7 Act(42U.S.C. 701) isamendedbyaddingattheendthe 8 foDo^^ingnewsubsection: 9 ''(d) For purposes of this title, counseling for ces- 10 sation oftobacco use (as defined in section 1861(ddd)), 11 di-ugs and biolo^cals used to promote tobacco use ces- 12 sation (regardless of whether such drugs or biologicals 13 maybe dispensed onlyupon prescription or maybe dis- 14 pensed without a prescription (commonly referred to as 15 an'over-the-counter'drug),butonlyifsuchadrugorbio- 16 logical is prescribed by a physician (or other person au- 17 thorizedtoprescribeunderStatelaw)), andtheinclusion 18 of antitobacco messages in health promotion counsehng 19 shallbeconsideredtobepartofquahtymaternalandchild 20 healthservices.". 21 (b) Effective Date.—The amendment made by 22 subsection (a) shall take effect on the date ofthe enact- 23 mentoftliisAct.
