The information regarding his wives and which children each had may be incorrect. If others have definitive proof about anything here which contradicts what I've written, please share it--I'd welcome it. And I apologize in advance for the spacing. It's a copy and paste from my Family Tree Maker software and a chapter in a book I've published about all of my daughter's known ancestors. Bob Olive =================================================== Over the years changing and sometimes differing stories have been told about James Olive. In fact it was long believed (incorrectly) that he was the original "immigrant father", the first person with an Olive surname to permanently settle in America. Most of the stories about James seem to be based on the preface by Henry Calvin Olive to the 1886 autobiography of his father Reverend Johnson Olive (great-grandson of James and a son of Burrell). Subsequently, from it a lengthy, detailed story about the circumstances of James' immigration and his move to North Carolina was told in "Biography of a Country Church", which was published in 1950. It was then largely repeated in "James Olive Family...", first edition, 1965, and Lowney Virginia Olive's "The William Johnson Olive Family in America", 1983. "Biography of a Country Church", although embellished from the original, also includes the most detail. Like all four versions it contains inaccuracies. That said, its worth sharing: "James Olive was born in England in the year 1720. At the age of twenty he was bound under a lengthy apprenticeship to a cruel master of the leather trade, who took no interest in his personal welfare and required of him a severe discipline. He heard such attractive tales about the success of those who had gone to America that he set his heart on seeking a fortune in one of the colonies of the new world. When the young Englishman disembarked at New York harbor in 1740, he did not like the looks of the city. So he worked his way south, doing odd jobs on farms for board, bed, and a little pay. When he reached Carolina, he was referred to a large slaveholder near a village called Raleigh, who gave him temporary employment as caretaker of tools with instructions to mend all leather harness. He learned he could purchase virgin land at a resonable price. To the authorities he paid 125 shillings for 420 acres. One year later he purchased a smaller farm twenty-five miles to the southwest on a ridge which divides Wake and Chatham counties. Most of his neighbors were illiterates and had seen little of the world. All of them had good blood in their veins, were blessed with strong bodies, and possessed a will to work and make something of life. The English farmer married, and seven sons and two daughters came into the home. At the outbreak of the American Revolution, some of the boys took part in battles for independence. Two sons moved westward, where Abel became a minister of the gospel of much ability and influence. The other five boys reared large families and stayed near the Olive home. One of the younger ones, John Olive, married a Miss Partridge. His first son he named Burrell". That final paragraph is a generally accurate description of James and his family (although we believe that John was the only son who actually fought during the Revolutionary War). The pentultimate paragraph may be accurate as well in detailing James' land purchases in North Carolina. But all of paragraphs prior to those two are most probably about James' father William Olive, who we currently believe is the "immigrant father", not James. Henry Calvin Olive, in his preface to his father Rev. Johnson Olive's 1886 autobiography, said of James (though Henry Calvin never knew him) that: "..his chosen occupation for life (was) farming and stock raising. He is described as a stout, strong, healthy man, of good height. Possessed of a strong will, much industry and thrift". Of his seven sons, Henry Calvin said: "They were all possessed of fair mental capacity. Some of them became distinguished by their intellectual attainments. They only had such education as the times in which they lived offered to country boys. They did not seek fame or distinction...they were men whose characters were strongly marked...they were among the foremost men of their day with the early settlers and planters of their section". Current information, and probably the most accurate indicates that James was not born in England, but in America, specifically Virginia, the second son of William Olive (and a currently unknown mother). Parish records found and compiled by Robert W. Robins and published in 1981 don't tell us precisely when James was born, but do tell us that he was baptized on October 3rd, Page 2 of 78 Wednesday, October 16, 2013 Generation 2 (con't) Robins and published in 1981 don't tell us precisely when James was born, but do tell us that he was baptized on October 3rd, 1713, at Abingdon Parish, Gloucester County, Virginia, on the middle peninsula between the York and Rappahannock Rivers.(1) We believe James' siblings to have been William, Jr. (probably the oldest), Edward, and Alexander. On November 4th, 1735, about the age of 22 and still in Virginia, James married Mary Allard (according to The Register of Abingdon Parish). Mary was ten years older than he. Although currently unproven, its speculated by some that James and Mary had two children, James Olive, Jr. and daughter Amy. It appears that Mary died relatively young, leaving James a widower with two young children. Following her death, he apparently moved from Virginia to North Carolina, arriving there about 1740. Records indicate that he settled along Crabtree Creek and twelve years later, in 1752, showed him living in what was then Johnston County in north central North Carolina, a portion of which became part of Wake County in 1771. After the move, we believe about 1743, James remarried, to Elizabeth, whose surname is currently unknown. She was probably not Elizabeth Allard, the cousin of his first wife, as has been believed by some. Genealogists believe that Elizabeth gave birth to the six James Olive sons and one daughter other than James, Jr. and Amy. Those children included William, 1746; Southwood, about 1750-52; John, 1754; Rachel, about 1758; Anthony, about 1759; Jesse, about 1762; and Abel, 1765. James was a planter, a farmer by trade, raising crops and livestock on land that sat on what became the border of Wake and Chatham Counties, about two miles from what is today New Hill, North Carolina.(2) Numerous records dating from 1752 thru 1766, listed James Olive as a buyer and seller of land, overseer of roads (highways), and even as a judge or bailiff. The earliest record found to date is from April 6th, 1752, and is the entry of a claim of 640 acres of land on James' behalf by agents of the Earl of Granville on the north side of Crabtree Creek. Abstracts of two records from the original Granville Land Patent book indicated that on June 8th, 1761, James was granted 484 acres (in what was then Johnston County) "..in the Parish of St. Patrick, joining Theophilus Hunter, Walnut Creek, James Mackleroy, and Col. Hollton". It had been surveyed on December 11th, 1755. The second record, dated July 22nd, 1761, granted 280 acres "..on the S side of Crab Tree, joining Olives line, Col. Halton, and Simmons line". James was apparently expanding his land holdings considerably. A survey of one of James' neighbor's land found by Irene Olive Kittinger in the former North Carolina Land Grant Office says that it adjoins "Olive's corner..." between Crabtree Creek and Beaver Dam Creek. James apparently could not write. His mark on the various county real estate transactions was simply an "O". Johnston County Records indicated that in 1759 James was appointed "To serve as overseer of the highway (on the south side of the Neuse River)...from John Gyles Thomases to White Oak". In 1761, the county "Ordered that road leading from the house of John Gyle Thomas to Johnston Courthouse be altered by making a new road and (James Olive) ordered for a jury to lay out said road". In 1762, James served on the Grand Jury, "Ordered...appointed Constable in the room of Jonathon Monk". Later, in 1764, the county "Ordered that William Bedlinger be appointed Constable in room of James Olive". It's clear that James was very much involved in the early civic matters of his community. And much later, despite his age, James would play a role in the American Revolution. He is listed in the "DAR Patriot Index, Centennial Edition" as serving during the Revolutionary War in "patriotic service" (which means non-military, he would have been 60+ years old at the time). Also listed are sons, Anthony, John, and Jesse. Although John is believed to be the only one who actually served in the military. The 1790 U.S. Census, the first in the United States, listed James Olive, who would have been 77 years old, as head of a family in the Hillsborough District of Wake County, North Carolina. It said his household included two white males 16 and older (James, and we think his brother Alexander, who was later exempted from the poll tax in 1792 because of "his inability", and who apparently died without heirs in 1798 according to "James Olive Family"), one white female (presumably Elizabeth Olive), and three slaves. All of James Olive's sons except Anthony, were listed in the 1790 census for North Carolina, all within Wake County. James, James Jr., and Southwood were all listed as surname Olive. Abell (note spelling), Jesse, John, and William were all listed as surname Oliff, probably an indication of a lack of spelling skills on the part of both the Olive family and the census taker. As indicated above, James was a slave owner, as many of his descendants would be. The 1790 census listed each of his sons except Jesse and Abel as owning slaves. Estate records for Chatham County (James' land crossed the line dividing Chatham and Wake) listed the sale of a slave named Phillis on October 18th, 1794 to his son Abel. James was listed as James Olive, Sr. in the 1800 census for Wake County. His household included one male over 45 (James himself), one female over 45 (presumably Elizabeth), and three slaves. James lived a long life, particularly for the 18th century, dying at age 91, on January 22nd, 1805. According to "James Olive Family" the following obituary appeared in the Raleigh (North Carolina) Register of January 28th, 1805: "Died: In Wake County on the 22nd instant, Mr. James Olive, farmer, in the 92nd year of his age." Even in death questions about James Olive remain. Henry Calvin Olive said that "Toward the close of the eighteenth century James Olive, the father, died at his family residence, and was buried upon the premises, where it is thought his grave can now be distinguished". According to Lowney Virginia Olive, James was buried at the family homeplace in 1805. She said the cemetery there was marked by four, 10 foot cedar posts until 1983. That year a homecoming at Olive Chapel Church raised enough money for an iron grill fence. But "James Olive Family" reports that his grave is not located although it could be on Thomas Creek, a branch of the Little White Oak. ? Notes: (1) The 1981 discovery and publication of the Abingdon Parish records came well after "Biography of a Country Church" in 1950, and "James Olive Family", first edition in 1965. And they were apparently unknown to Lowney Virginia Olive when she wrote "The William Johnson Olive Family in America" in 1983. (2) Wake County was formed in 1771, during James Olive's life there, from Johnston, Cumberland, and Orange Counties. According to "North Carolina History" it was "named in honor of Margaret Wake, wife of William Tryon. The first courthouse was erected at what is known as Bloomsbury. It was called Wake County Court House until 1792, when Raleigh was established and was made capital of the State. Raleigh is the county seat". James' farm sat on land that would become the border of Wake and Chatham Counties. Chatham County was formed in 1771 from Orange. It was "named in honor of William Pitt, Earl of Chatham who was a most eloquent defender of the American cause in the English Parliament during the Revolution. I believe that to be the 1790 U.S. Census of Wake County, North Carolina. In that census, the family of James and Elizabeth is shown to have 2 males over 16 years of age, 4 males under the age of 16and 3 females. If we allow 1 male over 16 and 1 female for James and Elizabeth, we have left 5 sons and 2 daughters living at home in 1790. Since James and Elizabeth had moved to Columbia County, Georgia around 1792-1793 and the Columbia County, Georgia Census records of 1800 and 1810 were destroyed by fire, we have no record of their household in those years. We have to search county court records to establish identities and, fortunately, there are many records in Columbia and Warren County to work from. I have been through Wills, land records, property transfers, marriages, estate records, newspaper articles and anything else I could find relating to Olives and related families in order to establish identities of all the children. In this report I will lay out evidence to support the family connections and bring out questions that I feel need to be answered. I feel confident in naming 5 sons and 3 daughters born to James and Elizabeth: John, Wiley, Berry, Thomas W., Ichabod, Delilah, Lucy and Frances. The first evidence of James and Elizabeth in Columbia County is a deed dated December 14, 1793 when James Olive, planter of Columbia County, bought land on Kiokee Creek from James Donnelly. James also bought 173 acres on Kiokee Creek from Benjamin Harris on April 5, 1796. Several other deeds are registered in Columbia County on James, but the most important is a deed dated June 22, 1803. In this deed, John Olive bought the 173 acres that James bought from Benjamin Harris in 1796. In this deed, Elizabeth is mentioned as James' wife several times and signs the deed along with James. This proves that she moved to Columbia County with James and was still living in 1803. James died in the fall of 1820, probably in October. John Olive was granted Letters of Administration over the estate on November 6, 1820 and an estate sale was conducted on December 29, 1820. Final returns on the estate were filed by John on March 3, 1823. JOHN OLIVE John Olive married Sarah Magruder on January 3, 1803 in Columbia County. Sarah was the daughter of Col. Ninian Offut Magruder and Mary Harris. In Col. Magruder's will of 1803 he names John Olive as his son-in-law and provides for Sarah in the event John is unable to provide for her. John witnessed several deeds for his father, his siblings and his in-laws as well as some other local residents. John is also the only Olive child that left a Last Will and Testament. In his will he names his 2 sons and 5 daughters. He died in January of 1837 and is buried alongside Sarah in the Ninian Magruder graveyard in Appling, Georgia on the banks of the Kiokee Creek on Highway 221. His grave is the only one of his generation that we know the location of. WILEY OLIVE Wiley married Lucretia Newsom, daughter of Claiborne Newsom, in Columbia County on December 22, 1801. There are several land records on file that reference Wiley, but most important are those involving children of Ninian Offut Magruder. Several of those records use a post on –Wylie Olive–s –land as a marker of property lines. A Sheriff's sale of property of John Olive in 1802 (later required in 1803) gives a description as bordering on land owned by Hoge, James Olive, Wylie Olive and Magruder. Wiley appears at the estate sale for James Olive in 1820 and for Zadock Magruder (Sarah– sbrother) in 1821. A notice appeared in the Augusta Chronicle on January 10, 1824 in which Wiley declared a divorce from Lucretia stating she had left him without provocation and taken all her belongings. He further admonished anyone from doing business with her and declared that he would not be responsible for any debts she may incur. In January of 1825 a lawsuit was filed against Wiley Olive on behalf of Lucretia Olive by her brothers to reclaim her 1/8 share of the estate of Claiborne Newsom. I have not found any later record of Wiley in Columbia or Warren County except for a letter left unclaimed in the Warrenton Post Office for him. I have not located the disposition of the lawsuit or the transfer of his land. They could be tied together. The family is shown in the 1820 Columbia County Census with (in addition to Wiley and Lucretia)1 male between 16 and 21, 1 male between 10 and 16, 4 males under the age of 10, 3 females between 10 and 16 and 2 females under the age of 10. In 1830 the family is shown in Warren County, Georgia with the head of household listed as Lucretia Oliver. There is also a Wiley Oliver in Twiggs County, Georgia (below Macon) in 1830 but I have not had the opportunity to investigate that lead yet. BERRY OLIVE Berry married Elizabeth Wilkins, daughter of Sheriff William Wilkins, on May 18, 1813 in Columbia County. The marriage record lists her as Eliza Wilkins and her fathers will lists her as Betsy Olive, but in her own official records (deeds and will) she refers to herself as Elizabeth. I suspect their marriage was one of convenience because of several things. In William Wilkins will he makes it clear that Berry and Betsy maintained separate houses and names his grandchildren, none of which were Olives. After Berry died in 1832, Elizabeth signed a deed of transfer to Thomas W. Olive on April 28, 1834 giving Thomas full control over Berry's estate prior to her marriage to Jesse Clarke. In her will written January 28, 1845 and probated on March 9,1847 she names her nieces and stepchildren as heirs and names Sen. Andrew Jackson Miller (son-in-law of John Olive and Sarah Magruder) as her executor. Like Wiley and John, Berry witnessed several legal transactions involving James, his siblings and the Magruders and was at the estate sales of James Olive and Zadock Magruder. Of most interest, however, was a deed of indenture that he entered into Page 7 of 78 Wednesday, October 16, 2013 Generation 3 (con't) the estate sales of James Olive and Zadock Magruder. Of most interest, however, was a deed of indenture that he entered into with Sally Scott, a free woman of color, and her two daughters on July 25, 1814. In this deed Berry assumes responsibility of Sally and the daughters, and Sally accepts, with no set time period of expiration. This is interesting because it fits with the oral family tradition of the black Olive family of Thomson, Georgia. Their tradition is that their Olive progenitor was a white man in Appling who fathered daughters with their black grandmother. They further state that he acknowledged paternity and provided for them although they had to maintain separate houses. THOMAS W. OLIVE Thomas married Elizabeth Wilkins, daughter of Justice of the Peace Thomas Wilkins sometime prior to 1818. Although not as involved with the family legal proceedings as his brothers, he was also present at James Olive– sand Zadock Magruder– sestate sale. His legal dealings don– tget complicated until after assuming control of Berry– sestate in 1834. Immediately Thomas Wilkins began providing for his –only grandson– Thomas B. W. Olive. Thomas Wilkins wrote his will on April 17, 1834 although he did not die until 1847 and in the will he provides for his grandson Thomas B. W. Olive. In a deed dated September 25, 1838 he transfers ownership of his Negro slave Aggy and her children to his daughter Elizabeth Olive with the stipulation that , in the event of Elizabeth– sdeath, ownership is to transfer to Thomas B. Olive and that his son-in-law Thomas W. Olive is to have no control or involvement. It appears that by assuming control over Berry– sestate, Thomas had created concerns or problems between himself and his father-in-law. According to descendents of Thomas B. W. Olive, Thomas died August 15, 1837 and Elizabeth died February 10, 1839. In his will, Thomas Wilkins set aside land for a family Cemetery but I have not located it nor do I know who is buried in it although it is likely that Thomas and Elizabeth are buried there. ICHABOD OLIVE I know very little about Ichabod and it probably is because he died relatively young. There is a marriage record in Columbia county dated January 27,1818 between Bud Olive and Prudence Grinage. The 1820 Columbia County Census, enumerated in June, lists Ichabod Olive with 1 male over 21 and 1 female over 21. At the James Olive estate sale in December of 1820, Prudence Olive bought a bed and furniture with a trunk and bureau and Prudence Olive married John Tindall in Columbia County on August 25, 1828. Taken together this indicates that Bud died between June 1820 and 1827, probably with no children. DELILAH OLIVE Delilah married Edmund Lashley in Wake County, North Carolina March 13, 1783. Assuming they were living in their own home in 1790, she would not be one of the 2 daughters in James and Elizabeth– shouse at that time. According to their descendents, Edmund and Delilah moved to Pike County, Georgia which is northwest of Macon. The next generations were in Dodge County in the southwest portion of Georgia and in Florida. There is strong evidence of them, however, in Columbia County prior to that and involvement with James– family. Although they were not at James Olive– sestate sale, James Lashley is listed on the returns John Olive filed on the estate in 1823. Also, Elijah Lashley was at Zadock Magruger– sestate sale with the Olive brothers in 1821. Delilah– sson Elijah and daughter Elizabeth both married in Columbia County. LUCY OLIVE Although I have not had the opportunity to dig into Lucy– sfamily, there is a marriage record in Columbia County for Lucy Olive and Stephen Hoge. Hoge was a Justice of the Peace that witnessed several Olive transactions. Hoge is also listed as an adjoining property owner to James Olive, Wiley Olive and Ninian Magruder and he was at James Olive– sand Zadock Magruder– sestate sales. FRANCES OLIVE Frances married John Butt on June 20, 1810 in Columbia County. In a deed dated May 20, 1813, James transfers ownership of 2 female slaves to his daughter Frances Butt and his son-in-law John Butt. They lived in Warren County, Georgia where John was Justice of the Peace in Warrenton. The actual status of John and Frances– smarriage is a little unclear because John is listed in the 1850 Warren County census with the children while Frances– sestate, administered by their son John D. There are 2 marriage records in Columbia County for Stephen Hoge, but there also appears to be 2 Stephen Hoges. The marriage record for Lucy and Stephen in 1797 comes a book entitled –37,000 Early Georgia Marriages– but I have not found the actual record at the courthouse. Another marriage exists for Stephen Hoge from 1799. However, the will for William Hoge in 1802 names his sons, including Stephen and the will for Daniel McNeil in 1804 lists his grandsons, including Stephen Hoge.
