C94, C96 and C97 and Planning Permits PP2014‐0106, PP2014‐0107 and PP2014‐0128 Panel Report 15 April 2015 Executive Summary (i) Summary Warrnambool is the key regional centre in South West Victoria and the hub for retail, health, education, community and industrial services. It is a significant employment generator and provides the focal point for major industry in the region. One of these key industries is agriculture and in particular, livestock production. To survive and to remain competitive, regional centres need to ensure continued growth and development. Warrnambool has a strong industrial base, which is located in several key precincts, including the West Warrnambool Industrial Precinct, located two kilometres from the Central Activities District. In planning for the future, Warrnambool has identified land for new industrial development in the growing Eastern Precinct. This Panel process is considering three amendments, each accompanied by a planning permit application. Amendments C94 and C96 to the Warrnambool Planning Scheme seek rezoning from the Public Use Zone 6 – Local Government to the Industrial 1 Zone in two locations in Scott Street. Amendment C97 seeks to rezone land known as Lot 2 Eccles Street from Schedule 1 to the General Residential Zone to Schedule 3 to the Special Use Zone ‐ Warrnambool West Industrial Precinct Transition Area. The permits sought include a milk processing facility for the C94 land, a freezing and cold store facility for the C96 land, and a six lot subdivision for the C97 land. Midfield Group Pty Ltd is one of the key industries in Warrnambool and its region, and it has significant and diverse operations, resulting in a strong employment base. As with all major industry, it must diversify to ensure it remains viable, and in this regard, Midfield proposes to expand its operations to develop a cold store facility and a milk processing plant. Such expansion requires rezoning of land within the West Warrnambool Industrial Precinct to enable these uses and development. Co‐location with other Midfield operations will result in clear synergies and efficiencies. The Panel supports both the amendments and the planning permit applications. A thriving and robust industrial precinct needs to ensure it has suitable buffers in place to protect the amenity of nearby residential areas and other sensitive uses, and to this end, an area of residential zoned land (Eccles Street) falls within the 500 metre buffer threshold for some existing uses, as well as the proposed milk processing plant. A residential subdivision has already been refused for this land, and the dilemma for Council is how to best resolve what to do with this land. Clearly it is not suitable for residential development, but as it is adjacent to an existing residential area, it raises issues about whether it is appropriate for light industrial uses. This Panel has considered a proposal to rezone the land to a tailored Special Use Zone which it supports, and a subdivision, which the Panel does not support, principally because the applicant so poorly conceived the proposal, that it could not possibly be supported. Critical issues such as access, and layout were so lacking in detail that the application can only be refused. To assist Council deal with separation distances, it has commenced preparation of the West Warrnambool Industrial Precinct Separation Distance Management Plan (Warrnambool Review of Land Uses within Industrial Buffers 2014), which is to be realised through local Page i Warrnambool Planning Scheme Amendments C94, C96 and C97 and Planning Permits PP2014‐0106, PP2014‐0107 and PP2014‐0128 Panel Report 15 April 2015 policy changes as part of Amendment C97. The Panel supports the intent of this, but more work needs to be done to finalise the review. The local community however, do not believe that the Amendments should be approved, nor should the permits issue for the applications. Submitters spoke of the increasing level of heavier industry in the precinct, particularly those put forward by Midfield, are too much for the area. Concerns related to traffic and access, visual amenity impacts, noise, odour, particulate matter (milk dust) and social impacts. While there were some submissions in support of the proposals, the clear majority of submitters were against it. Particular concerns related to impacts on neighbouring residents and children using the Merrivale Primary School. In assessing the concerns raised by the community, the Panel has found that these can be mitigated through appropriate control and mitigation measures such as a fabric filter (bag house) constructed on the milk processing facility dryer to capture airborne particles arising from the processing operations to a requirement of less than 20mg/m³. The Panel accepts that the two facilities will comply with the noise limit of 45dB(A) at the closest sensitive receivers (residences) for day, evening and night time noise associated with the facilities. Odour is not expected to be an issue as there will be no wastewater treatment on the site. A number of permit conditions, which were recommended by the technical experts, have been endorsed by the Panel and included in the permits to address these matters. The Panel concludes that there are no substantive traffic engineering reasons why Amendment C94 and C96 and their associated planning permits should not be approved, subject to conditions that truck traffic be restricted to designated routes. In relation to Amendment C97 subdivision permit, the Panel concludes that the information (or lack of) regarding traffic and access, leads the Panel to recommend the refusal of the associated planning permit on the basis that the traffic and access plans and the relevant information provided to the Panel are lacking in quality and substance. One of the issues that emerged is whether Midfield is a ‘good neighbour’. Overall, the Panel considers that Midfield needs to be a better neighbour to its residential community. These proposals have suffered due to a lack of meaningful consultation, especially prior to the exhibition process. Put simply, there was no engagement or consultation, apart from the statutory requirements. The community has felt disenfranchised and disengaged, and both Council and Midfield need to now work hard and effectively to gain back the trust and support of its local community. The Panel was surprised that Council did not seek improvements to Scott Street (which is largely populated by Midfield industries) through some form of development contribution. As the major tenant of Scott Street, it is in Midfield’s interest to assist in upgrading the street through streetscape works, street repairs, better defined parking and the like. While Council rates contribute towards this, there is an opportunity for Midfield to put something back into the industrial precinct through a voluntary development contribution. Subject to modifications, the Panel supports the three amendments and the two permit applications for Midfield, but not the application for the Eccles Street land. Adopt Amendment C94 to the Warrnambool Planning Scheme as exhibited. 2. Adopt Amendment C96 to the Warrnambool Planning Scheme as exhibited. 3. Adopt Amendment C97 to the Warrnambool Planning Scheme as exhibited, subject to: a) The modifications to Clause 21.06 as provided in Appendix C. b) The modifications to Schedule 3 to the Special Use Zone as provided in Appendix D. 4.
