foreword
Hostilities broke out between Eritrea and Ethiopia in May 1998 . On
12 December 2000, an Agreement was signed in Algiers by which the Parties
agreed to, inter alia, end the hostilities between themseles and refrain from
the use or threat of force against the other . The Agreement further proided
for the establishment of two Commissions .1 The Boundary Commission was
mandated to delimit and demarcate the colonial treaty border between the two
countries based on pertinent colonial treaties and applicable international law .
The Claims Commission was mandated to decide through binding arbitration
all claims for loss, damage or injury by one Goernment against the other, and
by nationals of one Party against the Goernment of, or other entities owned
or controlled by, the other Party, that were related to the conflict and resulted
from iolations of international humanitarian law, including the 1949 Genea
Conentions, or other iolations of international law .
The Eritrea-Ethiopia Claims Commission completed its mandate on
17 August 2009 . The present olume contains the Decisions and Awards issued
by the Commission throughout its proceedings . Part I includes Preliminary
Decisions 1-8 of the Commission; Parts II and III include the Partial Awards
on the parties’ respectie claims with regard to prisoners of war; Parts IV and
V include the Partial Awards on the respectie parties’ claims with regard to
the Central Front; Parts VI and VII include the Partial Awards on the par-
ties’ respectie claims regarding ciilians; Part VIII includes the Decision
on Eritrea’s claims regarding the Western Front, aerial bombardment and
related claims; Part IX includes the Decision on Ethiopia’s claims regarding
the Western and Eastern Fronts; Parts X and XI include the Partial Awards on
the respectie parties’ diplomatic claims; Part XIII includes the Decision on
Ethiopia’s claim on economic loss throughout Ethiopia; Part XIV includes the
Partial Award on Ethiopia’s claim regarding jus ad bellum; Part XV includes
the Final Award on Eritrea’s claim regarding pensions; Part XVI includes the
Final Award on Ethiopia’s claim regarding ports; and Parts XVII and XVIII
include the Final Awards on the respectie parties’ damages claims .
The Eritrea-Ethiopia Boundary Commission issued its Delimitation
Decision on 13 April 2002 . That Decision and related documents issued in
2002 and 2003 are contained in olume XXV of this collection . A Statement
regarding the demarcation of the border was issued by the Commission on
27 Noember 2006, and is included as Part XIX of the present olume . Forty-
six maps accompany this Statement detailing the demarcation of the border
between Ethiopia and Eritrea . In this olume the comprehensie map has been
reproduced as hard copy . That map is also reproduced on a DVD, together
