An excision is required to remove the entire fifth scene depicting a woman's degrading, dehumanising and demeaning treatment by four men. The men treat the woman as a sex object and have no regard for her comfort or dignity. By extension the scene legitimises and encourages a misogynistic viewpoint of women in general to such a degree that the publication's availability is likely to be injurious to the public good unless one excision is made. In this instance the distributor declined to make the required excisions and therefore this publication is classified as objectionable. The Classification Office has considered the effects of the New Zealand Bill of Rights Act 1990 on the application of the classification criteria. The classification of this publication interferes with the right to freedom of expression, but this is an outcome that reflects the concerns of a free and democratic society to limit the availability of publications which encourage misogynistic attitudes and present strongly degrading and dehumanising sexual behaviour as sexually arousing.
