1. Onorabout April 12,2022, within the Easter DistrictofNew Yorkand
elsewhere, thedefendant FRANKJAMES did knowingly and without lawful authority and
permission commit and attempttocommit an act, includingthe use ofadangerous weapon, with
he intent to causedeath and serious bodily injury toone ormorepersonson agarage, terminal,
structure, track, electromagnetic guideway, supply, and fcility used in the operation of, and in
supportofthe operation of, a mass transportation vehicle, which mass transportation vehicle was
carryingone ormore passengers and employees at the timeofthe offense, to wit: JAMES
discharged a firsarm at passengers on a Metropolitan Transportation Authoritysubway car,
which was located on asubway track and in a structure and facility used in theoperation of the
subwaysystem, and theconduct required forthe offense was engaged in, on, against and
affecting amass transportation providerengaged in interstate and foreign commerce, and
