RAO, Secy. 26 THE GAZETTE OF INDIA : JANUARY 17, 1998/PAUSA 27, 1919 [PART II—SEC. 3(iii)] ORDER New Delhi, the 8th December, 1997 O.N. 9.—Whereas the Election Commission is satisfied that each of the contesting candidates specified in column (3) of the Table below at the Election to the Legislative Assembly, 1996 held from the constituency specified in cloum (2) against his/her name has failed to lodge an account of his/her ©lection expenses as shown in column (4) of the said Table, as required by the Representation of the People Act, 19S1 and the Rules made thereunder; And, Whereas, the said candidates have cither not furnished any reason or explanation for the said failure even after due notice of the Election Commission, after considering the representation, if any made by them is satisfied that they have no good reason or justification for the said failure; Now, therefore, in pursuance of Section 10A of the said Act, the Election Commission hereby declares the person specified in column (3) of the Table below to be disqualified for being chosen as and for being, a member of either House of the Parliamentary of the Legislative Assembly or Legislative Council of a State for a period of 3 years from the date of this order. Ghaziabad, a contest- ing candidate for the General Election to Lok Sabha from 56 Allahabad constituency held in May, 1996 was disqualified by the Election Commission of India vide its Order No. 76/UP-HP/96, dated 8-9-1997, under section 10-A of the Representation of the People Act, 1951, for failure to lodge the account of his election expenses within the time and in the manner as required by the said Act and Rules made thereunder ; And whereas the said Shri Pramod Srivastava had submitted a petition dated 26-12-1997 before the Election Commission of India for removal of dis- qualification imposed on him, giving reasons for his failure to lodge the account ; And whereas, after considering the petition and taking into account all material facts of the case, the Election Commission, in exercise of the powers con- ferred by section 11 of the Representation of the People Act, 1951 has, vide its Order dated 6-1-1998 removed the disqualification of Shri Pramod Srivas- tava imposed upon him by the Commission's order dated 8-9-1997. under section 10-A of the said Act, with effect from 6-1-1998 .
