“8.(1) कोई Rय ि&त जो (cid:4)कसी भिू म म, िजसक’ बाबत् धारा 7 के अधीन अिधसूचना िनकाली गई ह,ै िहतब5 ह,ै अिधसूचना
के िनकाले जाने स े तीस (cid:4)दन के भीतर स0प ूण(cid:26) भिू म या उसके (cid:4)कसी भाग या ऐसी भूिम म या उस पर के (cid:4)क(cid:15) हT अिधकारC का
अज(cid:26)न (cid:4)कए जान ेके बारे म आपिBत कर सकेगा ।
(cid:11)प 8ट ीकरण.- इस धारा के अंतग(cid:26)त यह आपिBत नहT मानी जाएगी, (cid:4)क कोई Rय ि& त (cid:4)कसी भिू म म कोयला उB पादन के िलए
(cid:11)व यं खनन स(cid:4)ं Uयाए ंकरना चाहता ह ैऔर ऐसी स(cid:4)ं Uयाएं के(cid:15) (cid:16)ीय सरकार या (cid:4)कसी अ(cid:15) य R यि& त को नहT करनी चािहए।
(2) उपधारा (1) के अधीन 2Bय ेक आपिB त स(cid:23)म अिधकारी को िलिखत Vप म क’ जाएगी और स(cid:23)म अिधकारी,
आपिBत कता(cid:26) को (cid:11)व य ंसनु े जान,े fof/ Rय वसायी (ारा सुनवाई का अवसर दगे ा और ऐसी सभी आपिB तयC को सनु ने के
प"च ात् और ऐसी अित:र&त जांच, य(cid:4)द कोई हो, करन े के प" चात् जो वह आव" यक समझता ह,ै वह या तो धारा 7 क’
उपधारा (1) के अधीन अिधसिू चत भिू म के या ऐसी भिू म म या उस पर के अिधकारC के संबंध म एक :रपोट(cid:26) या ऐसी भिू म के
िविभ(cid:15)न टुकड़C या ऐसी भिू म म या उस पर के अिधकारC के संबंध म आपिBत यC पर अपनी िसफा:रशC और उसके (ारा क’ गई
काय(cid:26)वाही के अिभलेख सिहत िविभ(cid:15)न :रपोट(cid:26) के(cid:15) (cid:16)ीय सरकार को उसके िविन" चय के िलए दगे ा ।
(3) इस धारा के 2योजनC के िलए वह Rय ि& त (cid:4)कसी भिू म म िहतब5 समझा जाएगा जो 2ितकर म िहत का दावा करन े
का हकदार हो, य(cid:4)द भिू म या (cid:4)कसी ऐसी भूिम म या उस पर के अिधकार इस अिधिनयम के अधीन अFजत कर िलए जात े।”

MINISTRY OF COAL
NOTIFICATION
New Delhi, the 27th August, 2015
S.O. 200(E).—Whereas by the notification of the Government of India in the Ministry of Coal number S.O.
3060(E), dated the 9th October, 2014 issued under sub-section (1) of section 4 of the Coal Bearing Areas (Acquisition
and Development) Act, 1957 (20 of 1957) (hereinafter referred to as the said Act ), published in the Gazette of India, Part
II, Section 3, Sub-section (ii), dated the 4th December, 2014, the Central Government gave notice of its intention to
prospect for coal in 4.047 hectares (approximately) or 10.000 acres (approximately) of the land in the locality specified in
the Schedule annexed to that notification;
And whereas the Central Government is satisfied that Coal is obtainable in a part of the said lands prescribed in
the Schedule appended to this notification;
Now, therefore, in exercise of the powers conferred by sub-section (1) of section 7 of the said Act, the Central
Government hereby gives notice of its intention to acquire the land measuring 4.047 hectares (approximately) or 10.000
acres (approximately) and all rights in or over the such land as specified in the Schedule appended hereto.
Note 1: The plan bearing number ECL/ RGOM/ GM(I/C)/ PCD&E/ CBA(Phase–IX)/51, dated the 22nd February, 2015,
of the area covered by this notification may be inspected in the office of the Deputy Commissioner, District Godda,
Jharkhand, or in the office of the Coal Controller, 1, Council House Street, Kolkata – 700 001 or in the office of the
Director Technical (Operation), Eastern Coalfields Limited, Sanctoria, Post Office Dishergarh, District Burdwan (West
Bengal), Pin Code – 713 333.
Note 2.: Attention is hereby invited to the provisions of section 8 of the said Act which provided as follows:-
Objection to acquisition:-
“8 (1) Any person interested in any land in respect of which a notification under section 7 has been issued, may, within
thirty days of the issue of the notification, object to the acquisition of the whole or any part of the land or any rights in or
over the such land.
Explanation .- It shall not be an objection within the meaning of this section for any person to say that he himself desires
to undertake mining operation in the land for the production of coal and that such operations should not be undertaken by
the Central Government or by any other person.
(2) Every objection under sub-section (1) shall be made to the competent authority in writing, and the competent
authority shall give the objector an opportunity of being heard either in person or by a legal practitioner and shall, after
hearing all such objections and after making such further inquiry, if any, as he thinks necessary, either make a report in
respect of the land which has been notified under sub-section (1) of section 7 or of rights in or over such land or make
different reports in respect of different parcels or such lands or of rights in or over such land, to the Central Government,
containing his recommendations on the objections, together with the record of the proceedings held by him, the decision
of that Government.

(3) For the purposes of this section, a person shall be deemed to be interested in land who would be entitled to claim an
interest in compensation if the land or any rights in or over such land were acquired under this Act.”
Note 3: The Coal Controller, 1, Council House Street, Kolkata-700001 has been appointed by the Central Government
as the competent authority under section 3 of the said Act, vide notification number S.O. 2520, dated the 11th June,
1983 published in Part II, Section 3, Sub-section (ii) of the Gazette of India.
