L.-33004/99 The Gazette of India EXTRAORDINARY PART II—Section 3—Sub-section (ii) PUBLISHED BY AUTHORITY No. 109] NEW DELHI WEDNESDAY, JANUARY 30, 2002/MAGHA 10,1923 316 01/2002 (1) 2 THE GAZKITE OF INDIA: EXTRAORDINARY [PART II—SEC. 3(ii)l 3 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS (ROADS WING) NOTIFICATION New Delhi, the 23rd January, 2002 S.O. 129(E).~ WHEREAS, by the notification of Government of India in the erstwhile Ministry'of Surface Transport, number S.O.78(E), dated the 4th February, 1999 issued under section 11 of the National Highways Authority of India Act, !988(68 of 1988), the Central Government entrusted the entire National Highway No. 2 to the National Highways Authority of India; 4 , THE GAZETTE OF INDIA: EXTRAORDINARY [PART II—She. 3(u)] NOW, therefore, in exercise of powers conferred by section 7 of the National Highways Act, 1956(48 of 1956), read with rules 3and 9 of the National Highways (Fees for the use of National Highway Section and Permanent Bridge-Public Funded Project) Rules, 1997 and in supersession of notification number S.O. 2788(E), dated the 12* September, 1997, except as respect of things done or omitted to be done before such supersession, the Central Government hereby notifies that there shall be levied and paid fees on the mechanical vehicles for the use of km. 65 of two lane Durgapur Expressway between Dankuni and Palsit on the said Highway in the State of West Bengal at the rates specified in the Schedule annexed hereto and authorizes the National Highways Authority of India to collect and retain fees at the rates specified in the said Schedule from the date of publication of this notification in the Official Gazette to the 30th November,2002. SCHEDULE Rates of fee to be recovered from the users of 65km. of 2 lane Durgapur Expressway between Dankuni and Palsit in the State of West Bengal. Heavy Construction Machinery and 195.00 Earth Moving Equipment 5. Any other Mechanical Vehicle NIL NOTES: - 1. The following types of vehicles are exempted from the fee, natnery:- (i) Defence vehicles; (ii) Vehicles with Very Important Person(VIP) symbols; (iii) Police Vehicles; (iv) Fire fighting vehicles; (v) Ambulances; (vi) Funeral vans; (vii) Post and Telegraph Department's vehicles, and (viii) Central and State Government vehicles on duty. (ix) Vehicles of National Highways Authority of India on duty (x) Vehicles being used for the project of widening of Durgapur Expressway to 2. The vehicles officially belonging to the following shall be deemed to be vehicles having VIP symbols, namely:- (a) President of India; (b) Vice-President of India; _5 (c) Governors of States; (d) Central and State Ministers; (e) Leaders of Opposition of Lok Sabha/Rajya Sabha/State Legislatures, having the status of Cabinet Ministers; (f) Lt. Governors of Union Territories; (g) Speakers or Chairmen of Central and State Legislatures; (h) Executive Councilors; (i) Foreign dignitaries on State visit to India, and; (j) Foreign Diplomats stationed in India using cars with CD symbols; (k) Members of Parliament and Members of State Legislative Assemblies/Councils, within their respective Constituencies. 3. The rates of fee, the categories of vehicles exempted from payment of fee and the name, address and telephone number of the authority to whom complaints, if any, should be addressed, shall be conspicuously and prominently displayed 500m ahead of the toll booths, 100m ahead of the toll booths and at the toll booths also, the height of the display boards and size of letters being such that it is easy for drivers to read the display boards. 4. For the purposes of this notification the expression "Light Commercial Vehicle" shall mean a motor vehicle used for commercial purpose, the gross vehicle weight of which does not exceed 12000kgs. [F.
