CWC/FD/CPF/01/GEN/97-98.—In exercise of the powers conferred by Section 42 of the Warehousing Corporation Act, 1962 (58 of 1962), the Central Warehousing Corporation with the previous sanction of the Central Government hereby makes the following Regulations further to amend the Central Warehousing Corporation Employees' Provident Fund Regulations, 1962. namely :— 1.(1) These Regulations may be called the Central Warehousing Corporation Employees' Provident Fund (Amendment) Regulations, 1998. (2) They shall be deemed to have come into force on the 22nd day of September, 1997. 2 In the Central Warehousing Corporation Employees' Provident Fund Regulations, 1962 (hereinafter referred to as the said Regulations), for Regulation 8, the following Regulation shall be substituted, namely :— "8 Rate of Subscription :— The subscriber shall subscribe monthly to the Fund at such rate of his pay (not being less than 12%) as may be fixed by him from time to time, Such subscription shall be deducted by the Corporation from the pay payable to the subscriber every month in amounts calculated to the nearest rupee. The Corporation's contribution shall remain fixed as provided by Regulation 10. Within the above limits, the subscriber can change the rate of subscription with effect from 1st April of each year The rate once fixed shall remain unaltered throughout the year " 3 3. In the said regulations, in Regulation 10, for sub-regulation (1), the following sub-regulation shall be substituted, namely :— "(1) Save as otherwise provided the Corporation shall contribute to the Fund every month as employer's contribution an amount equal to the amount subscribed by each of the subscribers : Provide that the amount contribution by the Corporation shall not exceed 12% of the pay earned by a subscriber during a particular month : Provided further that the Corporation shall not be liable to make any such contribution in respect of a subscriber who has been permitted to subscribe to the Fund under the proviso to Regulation 7" Explanatory Memorandum :—The rate of subscription and contribution under the Employees Provident Fund and Miscellaneous provisions Act, 1952 has been increased from 10% to 12% with effect from 22-09-1997. On the same analogy, it has been decided to increase the rate of subscription and contribution under the Central Warehousing Corporation Employees' Provident Fund Regulations, 1962 from 22-09-1997. Therefore, it has become necessary to give retrospective effect to these Regulations. It is certified that by giving effect to these Regulations retrospectively, it shall not prejudicially effect the interest of any person to whom these Regulations are applicable. K. N. SAWHNEY, Dy.
