Chair's Report - Lucia Tam Membership renewal is in process. Many have sent in completed membership application packages. For those who have not, please submit the missing documents. Nominations from members are due by Nov. 12. Ballots will be sent out on Nov. 15. V. TBAC Speakers Chris Liban. Metro Environmental Compliance Service Department Manager: Department Mission: • Remediation • Environmental Compliance • Environmental Liability Reduction • Sustainability Near-Term Contracting Opportunities: Environmental remediation contract: Hazardous waste and material remediation. Current contract is $10 Million but will end in winter 2011. RFI (Industry Review) being prepared, will come out at the end of October. RFP to follow. Environmental compliance contract: EIRIEIS efforts. Current contract ends summer 2011. Industry review will come out in March 2011, to be followed by RFP. Long-Term Contracting Opportunities: Major capital projects, water action plan, LEED existing building operation and maintenance. TRANSPORTATION BUSINESS ADVISORY COUNCIL MEETING MINUTES October 7, 2010 Other potential opportunities: Energy efficiency and sub-metering projects, solarization of Metro facilities and soundwalls, Red Line tunnel lighting retrofit, renewable (wind) energy study, electric vehicle plug-in vehicle stations. Department is open to innovative ideas, pilot projects, public-private partnerships Historically the department awards contracts to single firms rather than benches, and will most likely follow that pattern for the upcoming contracts. Remediation contract will most likely be three years in duration with two one-year extensions. Encourages small businesses to team with potential large primes. Incumbents: CH2M Hill (remediation), ICF International (compliance). John Harris, Harris & Associates (presented by Legislative Affairs Committee). Harris & Associates performed anecdotal studies under contract to BBC for inclusion in the current Joint Disparity Study. Nearly all MBE/DBE firms interviewed by Harris stated their belief that the large primes would not hire them for a contract unless there was a goal associated with it. This sentiment was repeated by the large firms that were interviewed. These results were presented to BBC but because they conflicted with the results of BBC's economic stUdies they were dropped from the Report. Mr. Harris stated his belief that an expert peer review of the report is necessary in order to successfully challenge it, either before the Metro Board or in court. Suggested that TBAC fund such a peer review. He has given contact information for a potential reviewer (MGT) to Ezekiel Patten. Doug Failing. Executive Director. Metro Highway Program: Presented Metro Highway Program and upcoming contract opportunities. Highway Bench Program: Metro received 105 proposals. Recommendations will go to the Planning Committee and be placed on the 10/28 Metro Board Agenda High Desert Corridor: From Highway 14 to Highway 18 through Victorville, Apple Valley. Caltrans is the lead agency for the environmental clearance phase. SR 138 Enhancements: Palmdale to San Bernardino - opportunities in construction but not in design. 1-5 from Highway 14 to the Kern County Line: Caltrans solicitation for construction contract is expected within the next six months. Soundwall Program: Design mostly completed. Metro to solicit CM and construction contracts. Arroyo Verdugo soundwalls, Las VirgeneslMalibu street improvements, South Bay street improvements, particularly in the Carson/Torrance area. Many projects will be contracted through local COG's. HOV Lanes (through Caltrans): 1-5/SR-14, 1-5 between Highways 118 and 134, 1-5 South, 1-5 at Carmenita, 1-405 N, 1-10, SR-60 improvements - nearly complete SR-71 design suspended, Caltrans to perform Value Engineering 1-710 south: Three upcoming procurements: • Utility Corridor Study (5. of 1-405) TRANSPORTATION BUSINESS ADVISORY COUNCIL MEETING MINUTES October 7, 2010 • Utility Corridor Study (N. of 1-405) • Freight Corridor Study 1-710 Gap Closure Study: Metro to procure EIRIEIS study. 1-605 Hot Spots: Feasibility study is under contract and will begin in October 2010. Hot Lanes: Three proposals have been received and are being evaluated, final recommendations will be made in late 2010 or early 2011. SBE Goals: for 1-605 Hot Spots the Metro SBE goal was 26%, and Metro has set a goal of 25% for its contracts, but Caltrans is responsible for setting goals wherever they are the lead authority. Metro is working with Caltrans at the Board level to assist with setting goals. Small business CM Bench: Metro will be shaping CM solicitation to encourage small business participation but it may not be a Bench Program. Intent is to produce a set of solicitations which will result in greater spreading of work than has historically been achieved through Bench Contracts. VI. METRO Contracting Opportunities - Tashai Smith Presented contract look-a heads and current solicitations. There is no Award Tracker this month. Encouraged members to check the Metro.net website on a daily basis since many projects are coming soon. Drew attention in particular to 1-710 Utility Study South (22% SBE goal), and Van Nuys Corridor Alternatives Analysis Environmental Clearance and Conceptual Engineering (25% SBE goal). VII. Committee reports: Legislative Affairs - Ezekiel Patten Ezekiel Patten and Tashai Smith announced passage of SB 1341, which was sponsored by Metro. Bill amends State public contracts provisions to give Metro the authority to apply existing SBE program to state and locally-funded competitively-bid projects, which could not be done in the past due to Prop 209. Also gives Metro the authority to grant up to 5% bidder's preference on state and locally funded projects to bidders who are certified SBE's or who meet SBE goals. Bill goes into effect 1/1/2011. Among implementation measures that Metro is proposing to the Board is an increase in the SBE owners' personal net worth ceiling from $250,000 to $1.3 million. Commodities· Ezekiel Patten Reported on meeting with Bruce Feerer regarding potential use of P-Card for small procurement payments. Effort is continuing. Professional Services· Carlos Morgner Red Line Canopy Installation Program - $6 - $7million per station. CM contract for soundwalls is coming in the near future. Construction· Kenneth Wong TRANSPORTATION BUSINESS ADVISORY COUNCIL MEETING MINUTES October 7,2010 Construction contract solicitation for soundwall projects is expected late December/early January. Will inquire further with JK Murthy regarding funding and solicitation for Century Division. Old Business DEOD Award Tracker: None submitted for last 3 months Disparity Study comments: ad hoc committee to meet next week to discuss John Harris proposal Meet the Primes: date changed to 1/27. Keith Compton reported that currently there are no plans to invite ACS to the 2011 "Meet the Primes" event because of complaints from small businesses. Rod Garcia suggested that items from previous month's minutes which were referred for private discussion be made into action items. IX. New Business None X. Public Comments Jackie Nutting, ABC LANentura: and Eric Christen, CFEC urged members to oppose the Project Labor Agreement currently being negotiated for Exposition Light Rail Phase II. Linda Wright gave assurances that all concerned parties would be given a voice in the development of the PLA. Matter referred to ad hoc committee.
