AN ACT TO AMEND THE TRADE MARKS ACT (CAP. 15.23) AND TO
VALIDATE ACTS DONE UNDER THE TRADE MARKS ACT (CAP. 180)
AND THE REGISTRATION OF UK TRADE MARKS ACT (CAP. 179).

BE IT ENACTED by the Queen’s Most Excellent Majesty, by and
with the advice and consent of the Legislative Assembly of
Montserrat and by the Authority of the same as follows—

1. Short title
This Act may be cited as the Trade Marks (Amendment
and Validation) Act, 2013.
2. Interpretation
In this Act—
“former Acts” means the Registration of United
Kingdom Trade Marks Act (Cap. 179) and the
Trade Marks Act (Cap. 180) of the 1962
Revised Edition of the Laws of Montserrat;
and
“principal Act” means the Trade Marks Act (Cap.
15.23).

3. Section 2 amended
The definition of “Registrar” in section 2 of the principal
Act is deleted and the following is substituted—
““Registrar” means the Registrar of Trade
Marks;”.
4. Section 2A inserted
The principal Act is amended by inserting immediately
after section 2 the following—
“Appointment of Registrar
2A. The Governor acting on the advice of the
Cabinet shall appoint a Registrar of Trade
Marks.”.
5. Validation of acts done under former Acts
(1) The registration of the trade marks set out in the
Schedule is validated.
(2) The Registrar may by Order amend the Schedule by the
addition of trade marks but shall not amend the Schedule
to remove trade marks.
(3) An Order under subsection (2) is subject to negative
resolution.
(4) Any other act purportedly performed by the Registrar
and the staff of the Registrar’s Office under the former
Acts from 28 February 2000 to 2 January 2012, which
would have been validly performed under the principal
Act, is validated.
(5) A trade mark registered or renewed under the former
Acts from 28 February 2000 to 2 January 2012 is valid
for fourteen years.
6. Validation of appointment
The appointment of a Registrar by the Governor (GN.
312- No. 2011) and all acts performed by the Registrar
under the authority of that appointment which would
have been validly performed under the principal Act are
validated.
