The DVD contains a number of scenes that explicitly depict sexual activity involving men, women and a selection of animals. In some instances urination is used as part of the sexual activity. The main purpose of the publication is the sexual titillation and arousal of viewers. The depiction of bestiality as a pleasurable form of activity breaks down the taboos that surround the act and encourages experimentation with similar acts by making bestiality seem both possible and desirable. The use of urine has the same encouraging effect. The classification of this publication interferes with the right to freedom of expression set out in the New Zealand Bill of Rights Act 1990. However, this is an outcome that is consistent with Parliament's clear intention in s3(2) of the Films, Videos, and Publications Classification Act 1993. The classification is a reasonable limitation on the freedom of expression that reflects the concern of a free and democratic society to limit the availability of publications that promote and support bestiality or the use of urine in association with sexual conduct.
