Notes November 2013 iii CONSTRUCTION OF REHABILITATION MEASURES AT MAHLATJANE, MAFEFE Part T1: Tendering procedures Tender (MTK 18/2013) 1 Part 1: Tendering procedures CONSTRUCTION OF REHABILITATION MEASURES AT MAHLATJANE, MAFEFE T1.1 Tender Notice and Invitation to Tender Mintek, on behalf of the Department of Mineral Resources, is in the process of rehabilitating several abandoned mines around the country. In this regard, Mintek invites tenders for The Construction Of Abandoned Mine Rehabilitation Measures At Mahlatjane In The Mafefe District, Limpopo Province (Tender No. MTK 18/2013) It is estimated that tenderers should have a CIDB contractor grading designation of 6CE or higher. Only tenderers who are registered with the Construction Industry Development Board in an appropriate contractor grading designation as well as registered with the Department of Labour in terms of the requirements of the Asbestos Regulations 2001 are eligible to submit tenders. Tenders are available for download from Mintek’s website www.mintek.co.za Documents are also available at the offices of Mintek which is located at: 200 Malibongwe Drive RANDBURG 2125 Documents may be collected during working hours after 10h00 on 3rd December 2013. Joint ventures are eligible to submit tenders provided that: 1. every member of the joint venture is registered with the CIDB; 2. the lead partner has a contractor grading designation in the 6CE class of construction work; and 3. the combined contractor grading designation calculated in accordance with the Construction Industry Development Regulations is equal to or higher than a contractor grading designation Tender 3 Part T1.2: Tender data CONSTRUCTION OF REHABILITATION MEASURES AT MAHLATJANE, MAFEFE determined in accordance with the sum tendered for a 6CE class of construction work or a value determined in accordance with Regulation 25 (1B) or 25(7A) of the Construction Industry Development Regulations. 4. every member of the joint venture is registered with the Labour Department (as required by the Asbestos Regulations 2001) Only those tenderers who score a minimum score of 65 points in respect of the Functionality criteria will be considered. The Functionality Criteria is contained in Table A at the end of Part T2.1 – Tender Data The persons named in the Schedule of Key Persons of tenderers who satisfy the minimum quality criteria may be invited to an interview. Tender 4 Part T1.2: Tender data CONSTRUCTION OF REHABILITATION MEASURES AT MAHLATJANE, MAFEFE F.2.16 The tender offer validity period is 8 weeks F.2.18 The tenderer is to submit the priced bill of quantities quantities and offer in a separate envelope together with their tenders (in another sealed envelope). F.2.23 The tenderer is required to submit with his tender: 1) an original valid Tax Clearance Certificate issued by the South African Revenue Services; 2) Proof of registration with Department of Labour 3) Certificate of Contractor Registration issued by the Construction Industry Development Board (CIDB). 4) BBBEE Rating Certificate (as provided by an authorised agency) F.3.4 The time and location for opening of the tender offers are: Time 12h05 on 22 January 2014 MINTEK. Main Gate Security Reception 200 Malibongwe Drive RANDBURG 2125 Tender 5 Part T1.2: Tender data CONSTRUCTION OF REHABILITATION MEASURES AT MAHLATJANE, MAFEFE F.3.11 Evaluation of tenders in terms of Methods 1; 2; 3 and 4 of SANS 294 will be replaced by the following: As Mintek is a 3B PFMA Institution, the procedure for the evaluation of responsive tenders is based on Part Three and Part Four of National Treasury Implementation Guide (1 December 2011) – Preferential Procurement Regulations, 2011 pertaining to the Preferential Procurement Policy Framework (PPPFA) Act, Act No 5 of 2000. The following evaluation procedure will apply to this tender: Stage 1. Evaluation of Functionality Bids will first be assessed on the Functionality Criteria as contained in Table A at the end of this section. A minimum score of 65 is required for the tender to advance to Stage 2. Stage 2 Evaluation in terms of the 80/20 or 90/10 preference points systems (as prescribed in Preferential Procurement regulations 5 and 6). The 80/20 Preference point system will apply to tenders of a Rand value of up to R 1 million inclusive of all applicable taxes. The 90/10 Preference point system will apply to tenders of a Rand value in excess of R 1 million inclusive of all applicable taxes. Stage 2 follows two steps as follows; Step 1: Calculation of points for price. The PPPFA prescribes that the lowest acceptable bid will score 80 or 90 points for price. Bidders that quoted higher prices will score lower points for price on a pro-rata basis. The following formulae are to be utilized in calculating points scored for price are as follows: For 80/20 Preference point system. Ps = 80 1 - Pt-Pmin Pmin For 90/10 Preference point system. Ps = 90 1 - Pt-Pmin Pmin Where Ps = Points scored for comparative price of bid or offer under consideration Pt = Comparative price of bid or offer under consideration. Pmin = Comparative price of lowest acceptable bid or offer Points scored must be rounded off to the nearest 2 decimal places. A contractor is not allowed to sub-contract more than 25% of the contract value to another enterprise that does not have equal or higher B-BBEE status level, unless the intended sub- contractor is an EME that has the capability and ability to execute the sub-contract The points scored for price must be added to the points scored for B-BBEE status levels of contribution to obtain the bidder’s total points score out of 100. A contract must be awarded to the bidder who scored the highest total number of points in terms of the preference points system. In the event that two or more bids have scored equal points, the successful bid must be the one that scored the highest points for b-BBEE. If two or more bids have equal points, including equal preference points for B-BBEE, the successful bid must be the one scoring the highest points for functionality. In the event that two or more bids are equal in all respects, the award must be decided by the drawing of lots. F.3.13.1 Tender offers will only be accepted if: a) the tenderer has in his or her possession an original valid Tax Clearance Certificate issued by the South African Revenue Services or has made arrangements to meet outstanding tax obligations b) the tenderer is registered with the Construction Industry Development Board in an appropriate contractor grading designation; c) the Tenderer is registered with the Department of Labour as being permitted to deal with asbestos; d) the tenderer is not in arrears for more than 3 months with municipal rates and taxes and municipal service charges; e) the tenderer or any of its directors is not listed on the Register of Tender Defaulters in terms Tender 7 Part T1.2: Tender data
