SUMMARY OF THE REASONS FOR DECISION:

The video recording focuses on the explicit depiction of sexual activity and depicts a
number of acts of serious violence and sequences depicting violence and coercion in
association with sexual activity. The manner of presentation is sadistic, salacious and
titillatory.

Section 14 of the New Zealand Bill of Rights Act 1990 does apply to this publication
and limitations on its availability must be reasonably justified. In terms of Section 3(3)
of the FVPC Act, the Classification Office has given significant weighting to the extent
and degree to which, and the manner in which, the publication presents acts of
violence, and acts of violence and coercion in association with sexual activity.
Considerable weighting is also given to the depiction of physical conduct in which
sexual satisfaction is derived from inflicting cruelty and pain. The Classification Office
finds that the availability of the video recording is likely to be injurious to the public
good.
