Medical University, Chennai .. 47-50 Ex-IV-1-12(E) [ 11 ] 12 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY BILLS INTRODUCED IN THE LEGISLATIVE ASSEMBLY OF THE STATE OF TAMIL NADU Under rule 130 of the Tamil Nadu Legislative Assembly Rules, the following Bill which was introduced in the Legislative Assembly of the State of Tamil Nadu on 11th January, 2018 is published together with Statement of Objects and Reasons for general information:— L.A. Bill No. 4 of 2018 A Bill further to amend the Tamil Nadu Transparency in Tenders Act, 1998. BE it enacted by the Legislative Assembly of the State of Tamil Nadu in the Sixty-eighth Year of the Republic of India as follows:— Short title and 1. (1) This Act may be called the Tamil Nadu Transparency in Tenders (Amendment) commence- Act, 2018. ment. (2) It shall be deemed to have come into force on the 17th day of October 2017. Amendment of 2. In section 16 of the Tamil Nadu Transparency in Tenders Act, 1998, after clause Tamil Nadu Act section 16. (i), the following clauses shall be added, namely:- 43 of 1998. “(j) of consultancy and fi nancial services from the Tamil Nadu Water Investment Company Limited or the Tamil Nadu Infrastructure Fund Management Corporation Limited or the Tamil Nadu Urban Infrastructure Financial Services Limited, with the prior approval of the Government: Provided that a committee, consisting of the Secretary to Government of the Department concerned, the Secretary to Government, Finance Department and the Managing Director or the Chief Executive Offi cer concerned, of the Tamil Nadu Water Investment Company Limited or the Tamil Nadu Infrastructure Fund Management Corporation Limited or the Tamil Nadu Urban Infrastructure Financial Services Limited, as the case may be, shall determine the fee for the services to be procured; (k) of coal from the Coal India Limited or the Singareni Collieries Company Limited or any other similar Public Sector Undertakings; (l) of services of chartering of vessels owned by the Shipping Corporation of India Limited.”. Repeal and 3. (1) The Tamil Nadu Transparency in Tenders (Second Amendment) Ordinance, Tamil Nadu Saving. 2017 is hereby repealed. Ordinance 6 of 2017. (2) Notwithstanding such repeal, anything done or any action taken under the Tamil Nadu Act Tamil Nadu Transparency in Tenders Act, 1998, as amended by the said Ordinance, 43 of 1998. shall be deemed to have been done or taken under the said Act, as amended by this Act. TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY 13 STATEMENT OF OBJECTS AND REASONS. According to section 16 of the Tamil Nadu Transparency in Tenders Act, 1998 (Tamil Nadu Act 43 of 1998), the provisions of sections 9 and 10 of the said Act, relating to invitation, evaluation and acceptance of tender by the Tender Inviting Authority shall not apply to the procurement specifi ed therein. The Government considered it necessary that the exemption provided under the said section 16 has to be extended to the procurement of consultancy and fi nancial services from the Tamil Nadu Water Investment Company Limited or the Tamil Nadu Infrastructure Fund Management Corporation Limited or the Tamil Nadu Urban Infrastructure Financial Services Limited and that the procurement of coal from the Coal India Limited or the Singareni Collieries Company Limited or any other similar Public Sector Undertakings and procurement of services of chartering of vessels owned by the Shipping Corporation of India Limited shall also be exempted from sections 9 and 10 of the said Tamil Nadu Act 43 of 1998. Therefore, the Government decided to amend section 16 of the said Act for the above said purpose. 2. Accordingly, the Tamil Nadu Transparency in Tenders (Second Amendment) Ordinance, 2017 (Tamil Nadu Ordinance 6 of 2017) was promulgated by the Governor on the 16th October 2017 and the same was published in the Tamil Nadu Government Gazette. Bill No. 5 of 2018 A Bill to amend the Tamil Nadu Local Authorities Entertainments Tax Act, 2017. BE it enacted by the Legislative Assembly of the State of Tamil Nadu in the Sixty-eighth Year of the Republic of India as follows:— 1. (1) This Act may be called the Tamil Nadu Local Authorities Entertainments Short title and com- Tax (Amendment) Act, 2018. mencement. (2) It shall be deemed to have come into force on the 26th day of September 2017. Tamil Nadu Act 20 2. In section 3 of the Tamil Nadu Local Authorities Entertainments Tax Act, Amendment of of 2017. 2017 (hereinafter referred to as the principal Act), for sub-section (2) excluding the section 3. Explanations thereunder, the following sub-section shall be substituted, namely:— “(2) The entertainments tax on cinematograph exhibition shall be calculated at the following rates on each payment for admission to any cinematograph exhibition in the theatres located,— (i) within the limits of the Municipal Corporations, Municipalities, Special Grade and in the theatres, whether permanent or semi-permanent, within fi ve kilometers from the outer peripheral limits of such areas of the Municipal Corporations and Municipalities, Special Grade,— (A) at the rate of thirty per cent of the gross payment for admission exclusive of the amount of the tax for new fi lm; and (B) at the rate of twenty per cent of the gross payment for admission exclusive of the amount of the tax for old fi lm; (ii) in the areas other than those specifi ed in clause (i), at the rate of twenty per cent of the gross payment for admission exclusive of the amount of the tax for new or old fi lm.”. 3. In section 17 of the principal Act, to sub-section (1), the following Amendment of proviso shall be added, namely:— section 17. “Provided that the inspecting offi cer shall not enter any place of entertainment without the prior permission of such offi cer as may be authorised by the local authority concerned.”. Tamil Nadu 4. (1) The Tamil Nadu Local Authorities Entertainments Tax (Amendment) Repeal and saving. Ordinance 5 of Ordinance, 2017 is hereby repealed. 2017. (2) Notwithstanding such repeal, anything done or any action taken under the principal Act, as amended by the said Ordinance, shall be deemed to have been done or taken under the said Act, as amended by this Act. 16 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY STATEMENT OF OBJECTS AND REASONS The representatives of the Tamil Film Industry represented to the Government to resolve certain issues regarding levy of entertainments tax under the Tamil Nadu Local Authorities Entertainments Tax Act, 2017 (Tamil Nadu Act 20 of 2017) and other connected matters. The Government constituted a High Level Committee with Secretaries to Government of various Departments and the representatives of the Tamil Film Industry as its members, to resolve the issues raised by the Tamil Film Industry. 2. After detailed discussion, the Committee submitted its recommendations for the consideration of the Government. After careful examination of the recommendations, the Government decided to amend sections 3 and 17 of the said Tamil Nadu Act 20 of 2017, so as to levy entertainments tax on cinematograph exhibition on each payment for admission exclusive of the amount of the tax and also to permit the inspecting offi cer to inspect any place of entertainment only with the prior permission of the offi cer authorised by the local authority concerned. Accordingly, the Tamil Nadu Local Authorities Entertainments Tax (Amendment) Ordinance, 2017 (Tamil Nadu Ordinance 5 of 2017) was promulgated by the Governor on the 26th September 2017 and the same was published in the Tamil Nadu Government Gazette, Extraordinary, dated the 26th September 2017. 3. BE it enacted by the Legislative Assembly of the State of Tamil Nadu in the Sixty-eighth Year of the Republic of India as follows:— PART – I. PRELIMINARY. 1. (1) This Act may be called the Tamil Nadu Municipal Laws (Amendment) Act, 2018. Short title and commence- ment. (2) It shall be deemed to have come into force on the 28th day of December 2017. PART – II. AMENDMENT TO THE CHENNAI CITY MUNICIPAL CORPORATION ACT, 1919 Tamil Nadu 2. In section 414-B of the Chennai City Municipal Corporation Act, 1919, for the Amendment Act IV of expression “upto the 31st day of December 2017”, the expression “upto the 30th day of section 1919. 414-B. of June 2018” shall be substituted. PART – III. AMENDMENT TO THE TAMIL NADU DISTRICT MUNICIPALITIES ACT, 1920. Tamil Nadu 3. In section 375-B of the Tamil Nadu District Municipalities Act, 1920, for the Amendment Act expression “upto the 31st day of December 2017”, the expression “upto the 30th day of section V of 1920. 375-B. of June 2018” shall be substituted. PART – IV. AMENDMENT TO THE MADURAI CITY MUNICIPAL CORPORATION ACT, 1971. Amendment 4. In section 510-AAA of the Madurai City Municipal Corporation Act, 1971, for the Tamil Nadu Act of section expression “upto the 31st day of December 2017”, the expression “upto the 30th day 15 of 1971. 510-AAA. of June 2018” shall be substituted. 18 TAMIL NADU GOVERNMENT GAZETTE EXTRAORDINARY PART – V.
