ThisMemorandumofUnderstanding(hereinafter"MOU")isenteredintobytheCity and County of San Francisco (hereinafter "City") through its designated representative and the Stationary Engineers, Local 39, International Union of OperatingEngineers (hereinafter"Union"). I.A. RECOGNITION 2. Thetermsandconditionsofthisagreementshallapplytoemployeesemployedbythe CityandCountyofSanFranciscointheclassificationssetforthherein. Theparties recognize that neither the San Francisco Unified School District nor the San Francisco Community College District has authorized the City to bargain on their behalf. 3. Theprovisions ofthis agreement shall applyonlytoactivecoveredemployees. The Union shall be considered the recognized bargaining agent for any classes certified to it by the Civil Service Commission during the term of this MOU. However, application of the provisions of this MOU shall be extended only to classificationsaccretedtobargainingunitsalreadycoveredbythetermsofthisMOU pursuant to the procedures set forth in the Employee Relations Ordinance. Upon requestoftheUnion,theCitywillmeetandconferconcerningproposedchangesto bargainingunits. 5. The Cityshall provide, upon request, a writtenlist ofall newhires andseparations for all classes represented bythe Union. This list shall be provided on a quarterly basis inwrittenform,orinanagreeduponexcel electronicformat. I.B. INTENT 6. It is the intent of the parties signatoryhereto that the provisions of this MOU shall not become binding until formally adopted by the Board of Supervisors acting in accordancewithprocedures,termsandprovisionsoftheCharterapplicablethereto. 7. Moreover,itistheintentoftheMayoractingonbehalfoftheCitytoagreetowages, hours, and other terms and conditions of employment as are within the Mayor's jurisdiction, powers, and authority to act as defined by the Charter, state law, CaliforniaConstitutionandotherapplicablebodiesofthelaw.TheMayordoesnot intendorattempttobindanyboard,commissionorofficertoanyprovisionsofthis agreement overwhichtheMayorhas nojurisdiction. I.C. NO STRIKE PROVISION 8. DuringthetermofthisagreementtheCitywillnotlockouttheemployeeswhoare covered by this MOU. This Union and the employees shall not strike, cause, encourage,orcondoneaworkstoppage,slowdown,orsympathystrikeasdefinedby CharterSectionA8.346. I.D. OBJECTIVE OFTHE CITY 9. Itisagreedthatthedeliveryofmunicipalservicesinthemostefficient,effective,and courteous manner is of paramount importance to the City and County and its employees.Suchachievementisrecognizedtobeamutualobligationoftheparties tothis MOUwithintheirrespectiveroles andresponsibilities. 10. The Union recognizes the City and County's right to establish and/or revise performancestandardsornorms,notwithstandingtheexistenceofpriorperformance levels, norms orstandards. Suchstandards, developedbyusual workmeasurement MemorandumofUnderstanding ByandBetween TheCityandCountyofSanFranciscoandStationaryEngineers,Local39 July1,2014–June30,2017 2 ARTICLEI-REPRESENTATION procedures,maybeusedtodetermineacceptableperformancelevels,preparework schedules,andtomeasuretheperformanceofeachemployeeorgroupofemployees. I.E. MANAGEMENT RIGHTS 11. ExceptasotherwiseprovidedinthisAgreement,inaccordancewithapplicablestate law, nothing herein shall be construed to restrict any legal City rights concerning directionofitsworkforce,orconsiderationofthemerits,necessity,ororganization ofanyserviceoractivityprovidedbytheCity. 12. The City shall also have the right to determine the mission of its constituent departments,officers,boardsandcommissions;setstandardsofservicestobeoffered to the public, and exercise control and discretion over the City's organization and operations. TheCitymayalsorelievecityemployeesfromdutyduetolackofwork orfunds,andmaydeterminethemethods,meansandpersonnelbywhichtheCity's operationaretobeconducted. 13. ItisunderstoodandagreedthatexceptasspecificallysetforthinthisAgreementthe City retains all of its powers and authority to manage municipal services and the work for performing those services. In no event shall the exercise of anyof these rightsconflictwithanyapplicableStatute,CharterProvision,CivilServiceRuleor anyotherpertinent provisionoflaw. 14. The exercise of these rights shall not be subject to the grievance procedure. However,theexerciseofsuchrightsdoesnotprecludeemployeesfromutilizingthe grievanceproceduretoprocessgrievancesregardingthepracticalconsequenceofany suchactionsonwages,hours,benefitsorothertermsandconditionsofemployment specifiedinthis Agreement. I.F. OFFICIAL REPRESENTATIVES ANDSTEWARDS Official Representatives 15. TheUnionmayselect uptothenumberofemployeesasspecifiedintheEmployee RelationsOrdinanceforpurposesofmeetingandconferringwiththeCityonmatters within the scope of representation. If a situation should arise where the Union believes that more than a total of five (5) employee members should be present at such meetings, and the City disagrees, the Union shall discuss the matter with the EmployeeRelationsDirector. Thepartiesshallattempttoreachagreementastohow manyemployees shall beauthorizedtoparticipateinsaidmeetings. MemorandumofUnderstanding ByandBetween TheCityandCountyofSanFranciscoandStationaryEngineers,Local39 July1,2014–June30,2017 3 ARTICLEI-REPRESENTATION 16. 1. Theorganization'sdulyauthorizedrepresentativeshallinform,inwriting,the department head or officer under whom eachselectedemployeememberis employedthat suchemployeehas beenselected. 17. 2. No selected employee member shall leave the duty or work station, or assignmentwithoutspecificapprovalofappropriateEmployerrepresentative. 18. 3. In scheduling meetings, due consideration shall be given to the operating needsandworkschedulesofthedepartment,division,orsectioninwhichthe employeemembers areemployed. Stewards 19. The Union shall, at least annually, furnish the Citywith an accurate, written list of stewards and alternate stewards to the appropriate department. The Union may submit amendments to this list at any time because of the permanent absence of a designatedsteward. IfastewardisnotofficiallydesignatedinwritingbytheUnion, nonewill berecognizedforthat areaorshift. 20. TheUnionrecognizesthatitistheresponsibilityofthestewardtoassisttheBusiness Representativeintheresolutionofgrievances at thelowest level possible. 21. Upon notification of a designated management person, stewards or designated officers of the Union, subject to management approval which shall not be unreasonablywithheld,shallbegrantedreasonablereleasetimetoassisttheBusiness Representative in investigating and processing grievances and appeals. Stewards shall advise their supervisors of the area or work location where they will be so engaged. TheUnionwillattempttoinsurethatstewardreleasetimewillbeequitably distributed. 22. Stewardsshallberesponsiblefortheperformanceoftheirworkload,consistentwith releasetimeapprovedpursuant torules establishedherein. 23. In emergency situations, where immediate disciplinary action is taken because of alleged violation of law or a City departmental rule (intoxication, theft, etc.), the steward shall not unreasonably be denied the right to leave his/her post or duty if requestedbytheBusiness Representativeforpurposes ofrepresentation. 24. Business Representatives and Stewards shall not interfere with the work of any employee. It shall not constitute interference with the work of an employee for BusinessRepresentativesandStewards,inthecourseofinvestigatingorprocessinga grievance,ordisciplinaryaction,tointerviewanemployeeduringanemployee'sduty time. MemorandumofUnderstanding ByandBetween TheCityandCountyofSanFranciscoandStationaryEngineers,Local39 July1,2014–June30,2017 4 ARTICLEI-REPRESENTATION I.G. GRIEVANCE PROCEDURE 25. The following procedures are adopted bythe Parties to provide for the orderlyand efficient disposition of grievances and are the sole and exclusive procedures for resolvinggrievances as definedherein. 26. Agrievanceisdefinedasanallegationbyanemployee,agroupofemployeesorthe UnionthattheCityhasviolated,misappliedormisinterpretedatermorconditionof employment providedinthis Agreement. 27. Agrievancedoes not includethefollowing: 28. 1. Performanceevaluationsprovidedhowever,thatemployeesshallbeentitled to submit written rebuttals to unfavorable performance evaluations. Said rebuttal shall be attached to the performance evaluation and placed in the employee's official personnel file. Employees are required to submit a rebuttal to an unfavorable performance evaluation within twenty (20) workingdays from thedatetheyreceivedtheperformanceevaluation. 29. 2. Written reprimands, provided however, that employees shall be entitled to append a written rebuttal to anywritten reprimand. The appended rebuttal shall be included in the employee's official personnel file. Employees are requiredtosubmitwrittenrebuttalswithintwenty(20)workingdaysfromthe dateofthereprimand. TimeLimits 30. The time limits set forth herein maybe extended byagreement of the parties. Any suchextensionmustbeconfirmedinwriting. Forpurposesofcalculationoftimea "day"is definedas a"calendarday,”includingweekends andholidays. 31. In the event a grievance is not filed or appealed in a timely manner it shall be dismissed. FailureoftheCitytotimelyreplytoagrievanceshallauthorizeappealto thenext grievancestep. 32. OnlytheUnionshallhavetherighttofileagrievanceonbehalfofanemployee(s). MemorandumofUnderstanding ByandBetween TheCityandCountyofSanFranciscoandStationaryEngineers,Local39 July1,2014–June30,2017 5 ARTICLEI-REPRESENTATION NON-DISCIPLINARYGRIEVANCES Steps oftheProcedure– 33. Exceptforgrievancesinvolvingmultipleemployeesordiscipline,allgrievancesmust beinitiatedat Step1ofthegrievanceprocedure. 34. A grievance affecting more than one employee shall be filed with the Appointing Officer or designee. Grievances affecting more than one department shall be filed withtheEmployeeRelationsDivision. IntheeventtheCitydisagreeswiththelevel at which the grievance is filed it may submit the matter to the Step it believes is appropriateforconsiderationofthedispute. 35. The grievant mayhave a Union representative present at all steps of the grievance procedure. 36. Step1: ImmediateSupervisor An employee shall discuss the grievance informally with his/her immediate supervisorassoonaspossiblebutinnocaselaterthantwenty(20)daysfromthedate of the occurrence of the act or the date the grievant might reasonably have been expectedtohavelearnedoftheallegedviolationbeinggrieved. 37. If the grievance is not resolved within seven (7) days after the informal discussion with the immediate supervisor, the grievant will submit thegrievanceinwritingto the immediate supervisor on a mutually agreeable grievance form. The grievance will set forththefollowing: 1. facts ofthegrievance; 2. the terms and conditions of employment claimed to have been violated, misappliedormisinterpreted,and 3. theremedyorsolutionbeingsought bythegrievant. 38. The immediate supervisor shall respond in writing within ten (10) days following receipt ofthewrittengrievance. 39. Step2: AppointingOfficer Agrievantdissatisfiedwiththeimmediatesupervisor'sresponseatStep1mayappeal totheAppointingOfficerordesignee,inwriting,withinfifteen(15)daysofreceipt oftheStep1response. TheAppointingOfficerordesigneeshallrespondinwriting within fifteen(15)days ofreceipt ofthegrievance.
