Evidence of eligibility of sponsoring entity Statement describing sponsoring entity The Sponsoring entity of the proposed charter school is Sendero Academy, Inc., a secular non-profit corporation founded for the purpose of developing educational programs tomeet the growingneeds of students in the Northwest Leon Valley area of San Antonio. SenderoAcademy, Inc.'s primary operational objective is to operate a charter school, which will provide education for students of grades K - 12 designed to encourage and prepare students to seek and excel in higher education. Staff members and community leaders of an extraordinarily successful private school, Sendero Christian Academy, formed the non-profit corporation when it became apparent that the educational needs of the community exceeded what could be provided by the private school alone, and that a state funded, secular education provided with an equally positive learning environment and a similarly challenging curriculum could allow more ofthe community's children to achieve individual success. Sendero Academy was organized in October of 2000 and received its Certificate of Incorporation from the Secretary of States Office on December 6, 2000. The Internal Revenue Service has sent a letter to Sendero Academy acknowledging that our application for 501 (c)(3) status has been received and is being processed. We are awaiting a final determination letter from the IRS. (See ATTACHMENT 1) The Articles of Incorporation and By-Laws of Sendero Academy, Inc. are included as ATTACHMENTS 2 and 3, respectively. Biographical Affidavits for each member of the governing board are included as ATTACHMENT 4. History of sponsoring entity ks the sponsoring entity is a newly formed corporation, it has no financial or credit history. Neither the corporation nor any of its board members has been involved in any litigation that reflects on the corporation in any way, and no liens or sanctions have ever been placed against the corporation or any of its Directors. The Corporation is too young to have filed any returns or other documents with the IRS, except for the application for non-profit status. 2. Raul Garcia will be the Director of the school and a member of the Board of Directors. Garcia was the pastor of EI Sendero Assembly of God for fifty years. Garcia founded the church after returning from service in World War II and it has grown to become among most respected· churches in San Antonio. The manner in which officers are selected and removed from office; The Board of Directors elects officers at its annual meeting. The Board of Directors may remove any officer at any time by a majority vote. When removal of an officer is to be considered by the Board, this shall be listed on the Agenda for the board meeting at which the issue will be discussed, and this agenda will be posted in accordance with the Open Meetings Act. The manner in which members of the governing body are selected and removed from office The Board of Directors of the sponsoring entity shall be the governing body of the school and the Board selects and removes its own members. New members to the Board of Directors are chosen by a majority vote of a quorum of the existing Board members. Any member of the Board of Directors may be removed at any time that the Board discerns it is in the best interest of the corporation and the school to do so. Removal is by a majority vote. When removal of a Board member is to be considered by the Board, this shall be listed on the Agenda for the Board meeting at which the issue will be discussed, and this agenda will be posted in accordance with the Open Meetings Act. The Board member whose removal is to be discussed will be notified by mail at least 72 hours prior to the meeting. The manner In which vacancies on the governing Board are filled The remaining Board of Directors fills vacancies on the board due to death, retirement, or removal. The Board will suggest suitable candidates to fill vacancies, and such candidates will then be invited to apply for the position. The candidates will submit resumes and a written declaration of their reasons for wanting to serve on the Board, as well as any other information as the Board may request. If candidates pass a required criminal history check, they may then be admitted to the Board by a majority vote of a quorum of the remaining Board members. The term for which members of the governing body served I 008 9 Each member of the governing body shall serve for two years. Whether the terms are to be staggered Terms for Directors are staggered such that Directors are elected on a rotating basis, with one half ofthe directors elected each year. Include any plans for further recruitment of founders or organizers of the school. All accept two of the original seven seats of the Board of Directors have been filled. The Founders are seeking to fill the final seats with a qualified individual. The founders feel that a responsible parent would ideally fill one of the seats and eligible candidates are being sought at this time. Explain the manner in which the charter schools will conduct textbook selection. A committee comprised ofthe Director, Principal, and teachers from each ofthe five disciplines (appointed by the Director) will review textbooks and make recommendations for approval. All committee decisions shall be based on philosophy, objectives, and methods ofinstruction in the subject area under consideration. Texts mnst support the learning ofTEKS. Textbooks must respect the right ofethnic, religious or racial groups' values and practices. After the initial selection oftextbooks, textbooks shall be reviewed and adopted based on a five (5) year plan. Order ofadoption for textbooks shall be: 2003-04 - Science 2004-05 - English 2005-06 - Mathematics 2006-07 - Social Studies 2007-08 - Electives 3. Community Support Provide Information on the manner in which community groups are Involved in the charter school planning process. 10 Evidence of community support for the existence of an Open Enrollment Charter School in the leon Valley area became apparent as the private, Sendero Christfan Academy ,school filled to capacity . long lists of families joined waiting . lists, even families who would not normally place their children in a private religious school because .they· could not' afford tuition or pre.ferred a secular education. (Students enrolled in the private school attend an additional class of Biblical studies daily. Students at the i;ha~r school will not be taught religious classes of any kind.) It was this outcry for alternative public education that was the impetus for our efforts to found :he charter school. We have collected lists of names of families directly from'the community who understand the need for the school and support its operation. Most of these families are waiting to enroll children in the charter schqolwhen it is approved. (These are included as part of ATTACHMENT 10) Although the new charter school will provide no religious teaching, there is also tremendous support for the publicly funded school from the EI Sendero Assembly of God Church. Church members have realized that the education needs of the community extend well beyond what the private Christian school can provide, and have pledged to support the public school in a variety of ways. Church members have pledged $10, 000 in startup funds, a very generous display of community support. (See ATTACHMENT 10) The EI Sendero Assembly of God Church has also shown its support for the new school by making available its excellent school facilities for lease and by offering to lease to the charter school as much space as it needs to operate independently. A meaningful partnership will be developed with the private school, the Sendero Christian Academy. As the idea and need for the school arose from the success of the private school and both schools will use the same kind of curriculum, the schools can often work together to provide project-based educational opportunities that will benefit the students of both schools as well as the surrounding community. (There will be no co-mingling of finances between the charter school and the private school and there will be no religious teaching of any kind included in any shared curriculum.) We will also form a student transportation partnership for the use of the private school's buses, as both schools draw their students from the same neighborhoods and the private school's demand for transportation are more minimal that the public school's needs are anticipated to be. Sendero Preparatory Academy has budgeted a professional bus driver as our part of the transportation cooperative effort (See ATTACHMENT 10). local bUSinesses have always had good relationship with the private school and have assured us that the same consideration will be extended to the charter school. The school and its operators have excellent relationships with area creditors, and the public school, although it has no credit history, has been offered loans to show they will support the public school and are confident in its success.
