EMPLOYMENT CONTRACT BETWEEN HiGH Point REGIONAL BOARD OF EDUCATION AND Dr. Scott D. RIPLEY This Agreement is made and entered into this January 21, 2019 by and between the High Point Regional Board of Education, Sussex County, New Jersey (hereinafter referred to as “Board”) and Dr. Scott D. Ripley (hereinafter referred to as “Superintendent’), residing at IN, Wantage, New Jersey 07461. WHEREAS, the Board is duly constituted and a validly existing Board of Education pursuant to Title 18A of the New Jersey Statutes; and WHEREAS, the Board is authorized by N.J.S.A. 18A:17-15 to appoint for a term of not less than three nor more than five years, a superintendent of schools by the recorded majority vote of the full membership of the Board; and WHEREAS, the Board desires to provide the Superintendent with a written employment contract in accordance with law and in order to insure the continuity of leadership within the Education; and WHEREAS, Dr. Scott D. Ripley will perform the duties and responsibilities of the Board's Superintendent of Schools; and WHEREAS, the Board and the Superintendent agree that a written employment contract is necessary specifically to describe their relationship and to serve as the basis of effective communication between them; and NOW, THEREFORE, in consideration ofthe following mutual promises and cbiigations of tho patties and the rendering of sericos by the Superintendent as stated horain, the pares hereto agree as folows: 4. TERM ‘Tho Bard hereby agrees to employ snd Dr. Scott D. Ripley hereby accepts employment 3s ‘Superintendent for @ term commencing July 1, 2019 and ending June 30,2022. 2, PROFESSIONAL CERTIFICATION AND FOSITION ‘The Superiniendent hos, and shall hold throughout the term of this Agreement, a valld certficatlon to act as a Superintondent inthis State and shall give his best professional sorvices and faithfully perform the duties and discharge the cosponsiliies assigned to him 25 ‘Superintendent by the Boer, the School Code and the laws of tie State for twelve (12) months coffull and regular sence each year of this contract in & competent and profsslonal manner In the event thatthe cortifeate ofthe Superintondont Is revoked, this contrat shall be nl and ‘id as ofthe date of he revocation 3. POWERS, DUTIES AND RESPONSIBILITIES ‘The folowing shall be the powers, duties and responses ofthe Superintendent: (2) The Superintendent shall have general supervision over ll aspects, including tha fiscal ‘perations and Instructional programs, ofthe schools of the Board under rues and regulations rescrbed by the Siale Board of Educaten, and shill keep himself ivormed as to their condition and progress and shall report thereon, rom tine to me, to, and as diecied by the Board {) "The Superintondent shall fish recommendations fo the Board on all mattars having to do with appointment, trans Promotion, reduction, or termination of personnel employed or tobe ‘employed by tho Board, all such recommendations being, where applicable undor law and regulation, subject fo finsl approval by the Board. (©) The Superintendent shall have a seat on the Board andthe right of meetings of the Board and its commitees, but shall have no voto. (0) The Superintendent shall have the right to legal assistance fram the Board appointed _attorney(), in carrying out hs duties atthe expense ofthe Board (0) The Superintendent, as a recognized expert inthe field of education, shal be permitted to engage in activities such as teaching at the university level, consultative work, speaking engagements, wring and publishing inthe field of education, mentoring, or other professional ‘work for compensation so long a5 such activities do nat interfere with his abiliy to menage the istic. 4. PROFESSIONAL DEVELOPMENT ‘The Board encourages the continuing professional development of tho Superniondent. The ‘Supovintendent may, therefore, become a mamber of the New Jersey Associaton of Schoat Aiministretors, the American Association of School Administrators, tho Sussex County ‘Association of School Administrators, the National Association of Secondary School Principals and the New Jersey Principals and Supenisors Association, as well as represent the High Polat Regional High Schoo! Soar of Education atthe Garden State Coatlon of Schools. The Board hall pay the ties chergod for memborship. Board approvals requled forthe following actives: ‘Attendance at conferences and conventons ». Payment of membership dues far professional organizations ©. Acquisition of professional books, perosicals. or education information sarveas 4. Exponses in connection wth maatings, conforances,vstaone, seminars, or other actives Undertaken for professional improvement, ‘The Superintendent shall also attend meetings, subject to Board approval which shall nol be Luneasonably withheld, sponsored by the New Jersey Depertment of Education, the Educational Improvemont Center, the Executive County Suporintendent, the Naw Jecsey Association of ‘School Administrators, the Amerlcan Association of School Administrator, the New Jersey ‘School Boards Assocation, the National Association of Educational Negotatrs and colleges or commercial enterprises which are atonded for the benefit of the schoo! astet. Travel reimbursement shal be granted in accordance with law. The Suporntendent shall be permited {o allond two State conferences and one nallonal canferanca per year, 5. COMPENSATION ‘A. Tho Board shall pay the Superintandent for the three years ofthis Agreement as fllows: sly 1, 2019 June 30, 2020 $178,183 July 1, 2020~ June 30,2021 $181,747 + 1 qualitative meri goal July 1, 2021 —.June 20, 2072 $185,382 + 1 quantitative & 1 qualitative merit goal ‘The annual salary shall be paid to the Superintendent In equal instalments in accordance with the policy of the Board goveming selary payments to the msjoily of professionel employess regulerly employed by the Board, or as otherwise agread between the parties hereto. If itis, ever necessary to calculate 2 per diem rate, it shall be calculated as 1/260:h of tho ‘Superintendent's current contracted salary. During the term of this Agreement, including any ‘extension or any adaltonal tom, the Superintendent shall not be reduced in compensation, Including salary and benefits. B. Merit Increases; As per Article 5A above, the Superintendent may receive @ merit bonus in addltion to his annual base salary. The metit bonus will be based upon his achlevement of quantitative merit ctiteria andior qualitative merit criteria, The Board and ‘Superintendent shall select quantltative met cleria and quallallve merit erteria ae set forth in 5A, depending on the contract year. The Executive County Superintendent stall approve or ssapprove the selection of quanitave morit and/or qualitative merit criteria and the data that forms the basis of measuring the achievement of quantitative merit and/or qualitative merit criteria, The Superintendent shall receive a merit bonus in the amount of 3.93% of his annual base salary for each quantilaive merit criterion achieved, andlor a merit bonus inthe amount of 2.5% of his annual base salary for each qualtative merit erterion achieved. The Board shall ub resolution to the Executive County Superintendent certifying thatthe quantitative merit andor qualitative merit efteria have heen satisfied and shall await a confirmation of the satisfaction ofthat entero from the Executive County Superintendent prior 19 payment ofthe merit bonus. The merit bonus shall be pald within 30 days of the Executive County Superintendent approval. The Board's obligation to pay the merit bonus shall survive the termination ofthis Employment Agreement. ©. Due to the nocassly ofthe Superintendent tobe in constant contact with the district and ‘the Board, the Superintendent wif receive 8200.00 por month relmbursamant for call phone use and charges, D. The Suporintondent will receive $100.00 per month for maintenance and cost of home WIFlcompater necessities 6. VACATION, SICK, PERSONAL DAYS AND BEREAVEMENT LEAVE. {A) Vacation Days The Superintendent shall be granted 25 vacation days annually, all of which hall be aveiiable to the Superintendonl an July 1 of each year. Upon separation fom service, ‘he Superintendent shall be paid forall unused accumulated vacation days, for a maximum of fity (60) days atthe rate of 11260 of his then annual salary (B) Sick Days The Suporiniondent shall be allowed 14 days sick leave annually. The unused Porton of such leave, at the end of any year, shall be cumulative. Upon the Superintendents retirement withthe Distic, the Board wil yay all accumulated sick days at $150.00/day up to a maximum total of $15,000.00 dollars. (C) Personal Days The Superintendent shal be granted five (5) non-cumulallve personal days each year of this Agreement. Unused personal days shall be converted to sick days: one personal day shall be equivalent to % sick day. The accumulation of sick days is governed by 18307, (©) Bereavement Leave: (0) In the caso of absence of the Superintendent because of the death of a member of his mmadiate family ora relative who, immediately plar fa his daath or lastlnass lived in the household ofthe Superintendent, the ful salary ofthe Superintendent shall be paid for a period not to excaed five (5) school days, consecutively or as designated by the employee and In ‘sonnection with the sottlament of an state or provieion for survivors of the deceased. Ifthe absence continues for a longer period, the matter shall be referred to the Board te determine whether o not the Superintendents salary should be paid for any addtional days. Such ‘determination shall take place on @ case by case basis. The ‘erm “Immediate Family" as used in this section includes spouse, sibiings, parents, grandparents, children and grandchildren, ‘unt, unele, niece, or nephew of either spouse. (In the case of absence of the Superintendent because ofthe crcl iiness of a member ihe Superintendent's immediate family, the provisions of paragraph (), above, shall apply. (ii) In the case of absence of the Superintendent because of major surgery to an immediate family member requling the presance of tha Superintendent, the Superintendent will be permitted to use one ofthe cca ilness days set forth in paragraph (I shove, 7 HOLIDAYS Superinlandnt shall have the following school holidays: July 4 Chiistmas Day Labor Day New Year's Eve Day ‘Teachers Convention Naw Year's Day “Thanksgiving Day ‘Washington's Birthday Day afer Thankegiving Gad Friday Christmas Eve Day Memorial Day 8, HEALTH BENEFITS ‘The Board shall provide the Superintendent wih the same level of benefits provided to other tistrict ceriieated professional employoes. (@) Full Health and Proscrition Coverage ‘The Board shall provide the Superintendent, and where appropriate, family coverage, ‘medical, surgical and Major Medical benafis under one ofthe health plans the Board of ‘Education offers al istrict employees and prescription coverage. Pursuent io PL 2011, ¢. 78, the Superintendent shall contbute an amount toward payment of premiums as tha ofthe othor istrict cortifcated employaes (Tier 3, atthe execution of thi contract). (b) Dental Coverage “The Board shall pay the premium (subjact ta Chapler 78 contibutons) for coverage of the Suporintondant and his family in the dental plan the Board of Education offers all dlc ‘employees. (Currently the Detta Dental Plan), (©) Description to Superintendent ‘The Board shall provide to the Superintendent a descrintion of the health care insurance ‘coverage provided under this Agreement, Including the conditions and limits of such coverage as furished by the plans liste in paragraphs (a) and (b), ebove, when requested 8 TRAVEL “The Superintondent shall be paid a reasonable allowance of $125.00 por month as reimbursement for use of his vehicle in the performance of his duties. 10, DISTRICT GOALS and OBJECTIVES Prioe to Septemiber 1 of each year ofthis contract, the partes shell mest to establish the atic, ‘goals and objectives for the ensuing school yaar. Said goals and objectives shall be reduced to ‘writing and shall be among the criteria by which the Superintendent is evaluated, as hereinafter provided. 14. EVALUATION The Board shall evaluate and assess In writing the performance of the Superintendent atleast once a year on or before July 1 of each yesr during the term of this Agreement, The evaluation ‘and aseesement shall be based upon the goals and objectives of the Board for the year in ‘question, the responstbildes of the Superintendent and other such criteria as the State Board of Education shal by reguiation prescribe. The Board and the Superintendent shall mutually sgree Upon the evaluation format in each yaar of this contract. A copy of the evaluation shall provided to the Superintendent. The Board and the Superintendent shal then meat lo discuss the fingings. The evaluation process shall be performed in accordance with NLA. 83-2. 42, REAPPOINTMENT AND TERMINATION ‘The Board and the Superintendent hereby agree thatthe following provisions wll be applicablo forthe term ofthis Agreement, or any extension or renewal ofthis Agreement. TERMINATION OF EMPLOYMENT CONTRACT A. Such suspension shall be with pay pxor 0 indictment, and may be with or without pay, atthe Boars discretion, subsequent fo indictment, unless the Board cortiis contracusl tenure charge. ©. Nothing in this Agreement shall affect the Board's rig with regard fo susponsion under NALS.A, 184:6-8.3 and applicable cave law. D.
