Connors retiredandMichaelJ. CarrolljoinedRandolphashis successor. However,Mr. Connors'experience wasnotlosttotheTown,ashewaselectedagaintotheBoard. JamesBurgesswasalsoelectedagain to the Board, bringing his many years ofservice backto servethe citizens. LiketownsthroughouttheCommonwealth,Randolphisconfrontedwithsignificantfinan- cialchallenges. AfteraProposition2 1/2 override questionnarrowly failedattheballot, the Board continuedto act financially conservatively. Spending controls were adopted forthe agencies with- inthe Board'spurviewbefore the end ofthe fiscal year, close adherence to municipal finance laws wasreinforced, andanewbudgetingsystemwasimplementedinthefalltopreparetheFY08budg- et. In additiontofinancial matters, the Boardgrappledwith amyriadofissues, examplesofwhich are citedbelow: EconomicDevelopment-TheBoardactedtosupportgrowthofthecommercialtaxbaseby: • working with Pearl Meat Packing on their relocation to Randolph with an application to the EconomicAssistance Coordinating Council foraTIF; and, • workingtofacilitaterelocationofanotherfirmtovacantindustrial spacein Randolphby sched- ulingconsolidatedmeetingswiththefirmandrepresentativesofallagenciesthatareinvolvedin the permitting process to review the projectpriorto any applications being prepared inorderto givethe firmencouragementandguidance on developingtheprojecthere. Community Development—The Boardactedtoenhance thequality oflifeby: • obtainingtheapprovalofTownMeetingofthecreationofthepositionofTownPlanner,whowill also intenselypursueeconomic development; and, • providingdirection toMPIC indevelopingplanstoimprovethecharacterofdesignandappear- ance ofthe Crawford Square Business District, and seekfundingthroughaPWED grant. Public Safety and Emergency Management - The Board acted to protect the towns' people by adopting NIMS (National Incident Management System), and the associated standards for staff development. RoadCommissioners-TheBoard actedtodirectthe maintenance oftheTown'sroadwaysby: • supervising traffic improvements thatwere made possible by ahostcommunity agreement with amajorbusiness to mitigate traffic impacts; and, • working with the Massachusetts Highway Department on reconstruction of sections of North Main Street. AdministrationandManagementofTownGovernment-TheBoard'sactionsasChiefOperating Officers include: • approved the recommendation ofthe Computer Needs Study Committee on the acquisition of computer hardware and software that substantially upgraded the Town's accounting,, utility bilhng, realproperty assessing andcollectionprocesses; • adopted aComputerUse Policythat strengthens security; • working with the Planning Board toprocess the surety thatwas postedby adeveloperofa sub- division, butwhodefaulted, afterwhich theTowncompletedthe subdivision; • workingwiththeFinanceCommitteeandotherelectedofficialstopreparetheoperatingandcap- ital outlay budgets forfiscal year2007; • extending support to the School Committee in its' efforts to improve the Randolph school sys- tem; • fulfilling the ongoing responsibilities of the local licensing authority (livery permits, beer and winepermitsandliquorlicenses,entertainmentpermits,automobiledealerlicenses,etc.)andthe appointing authority (members ofmultiple committees, keyemployees, constables, etc.); and, • attendingtothenumerousdiverseneedsofthecitizensofRandolphwhocontactedtheBoardfor assistance andhelp. Carroll, ViceChairmanandClerk Executive Secretary 2 ONEHUNDREDAND SEVENTYFIRSTANNUALREPORT REPORT OF THE TOWN COUNSEL This year was a very active and successful year for the Law Department: 1. Advice & Legal Documents. Numerous advisory opinions were rendered throughout theyeartovariousTownofficials andBoardsrelatingtoawidevarietyofissues andsub- jects. Frequent and ongoing attention was given to reviewing and/or drafting Bylaws, review of contracts as to form, contract documents and agreements, easements, zoning covenants, procurement documents, public road documents, proposed Town Charter, Warrants for Town meetings, compliance with the State Ethics Act, Wireless ConmiunicationTowerissues (includingNationalGrid,TowerVentures,D&FRealtyand Nextel), subdivision control issues, issues regarding constructive approvals arising from changesinmembershipofregulatoryboards, andotherlegaldocuments. We assistedthe transitionto theTown's newExecutive Secretary. 2. LaborIssues. We provided advice from time to time regarding the interpretation and application ofcollective bargaining agreements and the processing ofunion grievances. We alsoprovidedadvice andassistanceregarding avarietyofpersonnelissuesrelativeto applicable federal and state law, the requirements ofthe Town's personnel bylaws, non- unioncontracts, andcivil service issues. 3. AdministrativeAgencyProceedings. TheTownwasinvolvedinanumberofadminis- trative agency proceedings, including issues before the Massachusetts Civil Service Commission, the Massachusetts Alcoholic Beverage Control Commission, State Labor Relations Commission, Attorney General of the Commonwealth, and Department of Revenue. 4.Projects. Weassistedwiththeproposedgovernmentrestructureleadingtothenewpro- posed charter, various road layout issues. Tax Incentive Financing Agreements for eco- nomic development, landfill and trash collection issues, ballot questions and election issues. BuildingDepartmentcodeenforcementissues, draftingissuesrelatedtoCrawford SquarezoningdistrictandupdatingtheTown'szoningbylaws,andimplementationofthe new zoning bylaws, DPW Sewer and Water regulations, issues regarding condemnation ofderelictbuildings, and40B Comprehensive Permitproceedings. 5. Litigation & LaborArbitrations.
