RE: Public Records Request for reports filled and arrest logs relating “Revenge porn” cases from
10-1-13 to 11-19-18.

Dear Ms. Tolentino

The San Jose Police Department is in receipt of your public records request received on November
19, 2018 for reports filed for non-consensual pornography or “revenge porn” investigations and
arrest logs relating to charges of non-consensual pornography or “revenge porn” from October 1,
2013 to the date this request is processed. In our Records Management System (RMS) this charge is
categorized under Penal Code 311, which is an obscene material. After running a browse from
October 1, 2013 to November 19, 2018, the numbers of reports are 511. It appears that there is no
way to differentiate between violations of PC 647(j)(4) and other violation that would be categorized
in our RMS under 311, without reviewing each and every report.

Our records for arrest logs are available for the time period of October 23, 2016 to October 29, 2016
and January 1, 2017 to November 19, 2018. I will send you the CD ROM at no cost to the mailing
address provided above.

If you disagree with the Department’s response to your request, you may express your concern to the
