Box 201706 MT Helena, 59620-1706 RE: Montana Public Defender Commission Report to the Governor, Supreme Court and Legislature Dear Governor Schweitzer, Supreme Court Justices, and Legislators: Pursuant to 47-1-105 (9), MCA, the Office of the State Public Defender (OPD) must provide a biennial report entitled the Montana Public Defender Commission Report to the Governor, Supreme Court and Legislature OPD is reporting information from the . current biennium because the agency had no activity in the previous biennium. The Office of the State Public Defender was established under Title 47 by the 2005 Legislature, and OPD assumed public defender operations throughout the state as of July 1,2006. Description ofReport 1. All policies and procedures in effect for the operation and administration of the statewide public defender system and all standards established or being considered by the commission or the chiefpublic defender. A copy ofthe policies and procedures developed by OPD and the current Standards are attached. This information is also available at http://www.publicdefender.mt.gov/docs/policy/PoliciesTableofContents.pdf. 2. The number of deputy pubHc defenders and the region supervised by each; the number ofpublic defenders employed or contracted within the system, identified ANEQUALOPPORTUNITYEMPLOYER' Page Two by region; and the number ofattorney and non attorney staff supervised by each deputy public defender. The number of new cases in which counsel was assigned to represent a party, identified by region, court and case type; and the total number of persons represented by the office, identified by region, court and case type. We expect this information to be available prior to the beginning ofthe 2007 Legislative session at http://www.publicdefender.mt.gov/docs/reports/reportcasecountscost.pdf 4. The annual caseload and workload of each public defender, identified by region, court and case type. Annual information is not available at this time, because OPD has only been in operation since July 1, 2006. 5. The training programs conducted by the office and the number of attorney and non-attorney staff who attended each program; and the continuing education courses on criminal defense or criminal procedure attended by each public defender employed or contracted within the system.
