Teamsters 22 MONTANA PREVAILING WAGE REQUIREMENTS The Commissioner ofthe Department ofLabor and Industry, in accordance with Sections 18-2-401 and 18-2-402 Montana Code Annotated, has deter- mined the standard prevailing rate ofwages for the occupations listed in this publication. The wages herein specified are controlling as to the prevailing rate ofwages for the purposes of 18-2-401, et seq., Montana Code Aimotated. It is required that each employer pay, as a minimum, the rate ofwages includ- ing fringe benefits for health and welfare, pension contributions, vacation, training, travel allowance, and per diem, applicable to the locality inwhich the work is being performed, provided in the attached wage determinations. A. Apprentices Wage rates for apprentices registered in approved federal or state apprentice- ship programs are contained in those programs. However, apprentices not registered in approved federal or state apprenticeship programs will be paid the prevailingwage rate. B. Fringe Benefits Section 18-2-405 ofthe wage and hour laws states that..."whenever the em- ployer is not signatory to a collective bargaining agreement, those monies des- ignated as fringe benefits shall be paid to the employee as wages." This section does not apply to that portion ofthe prevailing wage designated by the Montana Department ofLabor and Industry as health, welfare, or pen- sion benefits which the employerwould otherwise contribute to federally ap- proved Employee Retirement Income Security Act (ERISA) plans. Forbuilding construction occupations, thevacationbenefit amount is in- cluded in the prevailingwage rate. The vacation amount is listed under bene- fits for informational purposes only. Vacation can be deducted from the wage rate, after taxes, provided the employer is signatory to a collectively bar- gaining agreement which contains avacation fund and the benefit is then paid into the fund. Ifan employer is not signatory to a collectively bargained agreement, the employer must pay the full prevailingwage amount with no deduction forvacation. Vacation benefits are not to be considered a part of the hourly rate ofpay for overtime purposes unless there is a collectively bar- gained agreement in effect that specifies that fringe benefits are to be com- puted on an hours-paid basis. The other fringe benefits (health and welfare, pension, apprenticeship train- ing, travel, and per diem) are to be paid in addition to the prevailingwage rates. Wages C. Posting Notice of Prevailing Section 18-2-406, Montana Code Annotated, provides that contractors, sub- contractors, and employers who are performingwork orproviding services under pubhcworks contracts as provided in this part shall post in apromi- nent and accessible site on the project orwork area, not later than the first day ofwork, a legible statement ofallwages to be paid to the employees on such site orwork area. D. Employment Preference Section 18-2-403, Montana Code Aimotated requires contractors to give pref- erence to the employment ofbona fide Montana residents in the perfor- mance ofwork onpublicworks projects. E. Prevailing Wage Schedule Employers are surveyed biennially to determine prevailingwage rates. This publication covers only building construction industries in the specific district mentioned herein. Heavy and highway industry rates are contained in a sepa- rate pubhcation. Services occupations willbe surveyed in alternate years and are contained in apublication dated July 1, 1993. These rates will remain in effect until superseded by a more current publication. F. Computing Travel Benefits Travel pay, for the purposes ofpublic works projects, shall be determined by measuring the road miles over the shortest practical maintained route from the county courthouse ofthe following cities or the employee's home, which- ever is closer, to the center ofthejob.
