The wages specified herein control the prevailing rate ofwages for the purposes of 18-2-401, et seq., Montana Code Annotated. It is required that each employer pay, as a minimum, the rate ofwages, including fringe benefits for health and welfare, pension contributions, vacation, training, travel allowance, and per diem applicable to the district in which the work is being performed, as provided intheattachedwagedeterminations. Definition of Building Construction ForthepurposesofPrevailingWage,theCommissionerofLaborandIndustryhasdeterminedthatbuilding constructionoccupationsaredefinedtobethoseperformedbyapersonengagedinarecognizedtradeor craft,oranyskilled,semiskilled,orunskilledmanual laborrelatedtothemaintenance,repair,orconstruction ofapublicbuildingorfacility,anddoesnotincludeengineering,superintendence,management,office,or clericalwork. D. Definition of Public Works Projects Workperformedintheareasofconstruction,repairandmaintenance,orservicesinexcessof$25,000to publicschoolbuildings,stateandcountyroads,collegesanduniversities,statefacilities,andotherprojects wherepublicftindsareused. ThispublicationcoversonK buildingconstructionoccupations. Heavy and highwavindusuy ratesare containedinaseparatepublication. Nonconstructionservicesratesarecontained inapublicationdated August 13.1999. All oftheserateswill remainineffectuntil supersededbyamorecurrentpublication. F. Rates to use for Projects Ratestobeused ona public works projectarethosewhich are in effectatthe timetheproject and bid specificationsareadvertised. G. Fringe Benefits Section 18-2-412ofthewageandhourlaws statesthat: "a contractor or subcontractor may: (a) pay the amount offringe benefits and the basic hourly rate ofpay that is part ofthe standard prevailing rate ofwages directlyto the workeroremployee in cash; (b) make an irrevocable contribution to a trustee ora third person pursuant to a fringe benefit fund, plan, or program that meets the requirements ofthe Employee Retirement Income Security Act of 1974 orthat is a bona fide program approved bythe United States department oflabor; or (c)make payments usinganycombination ofmethods set forth in subsections (1 )(a) and (1)(b) so that the aggregate ofpayments and contributions is not lessthan the standard prevailing rateofwages, including fringe benefits for health and welfare and pension contributions that meet the requirements ofthe Employee Retirement Income Security Actof 1974. travel, orother bona fide programs approved bythe United Statesdepartment oflabor, that is applicable to the district forthe particulartype ofwork being performed. (2)The fringe benefit fund, plan,orprogram described in subsection (1)(b) must provide benefits to workers oremployees for health care, pensions on retirementordeath, life insurance,disability and sickness insurance, orbona fide programs that meet the requirements ofthe Employee Retirement Income Security Act of 1974 or that are approved bythe United States department oflabor." Vacationbenefitamountislistedforinformationpurposesonlyunlessothcrvvisespecified, itisincludedin theprevailingwagerateandisnotto beincludedincomputationsforhourh fringebenefits,orsubtracted fi^omthehourlyrateaftertaxesunlesstheemployerissignator>'toacollectivebargainingagreementwhich containsavacation fiind andthebenefit isthenpaid intothefund. Non-signator> employers must pay the prevailing rate. Vacation should not be included in any overtime calculation. Other fringe benefitsspecified(healthandwelfare, pension,apprenticeshiptraining, travel, andperdiem)arctobepaid inadditiontotheprevailingwagerates. Vacation,healthandwelfare,pension,apprenticeshiptraining, travel, andperdiembenefitsarenottobeconsideredapartofthehourlyrateofpayforovertimepurposes unlessthere isacollectively bargainedagreementineffectthatspecifiesthatftingebenefitsaretobecom- puted onanhours-paidbasis. MontanaPrevailingWage Page ii Effective July 1. 2000 H. Prevailing Wage Districts Montanacountiesareaggregatedinto 1 districtsforthepurposeofprevailingwage. Amapsliowingthese districtsfollows: I. Computing Travel Benefits Travelpay,forthepurposesofpublicworksprojects, shallbedeterminedbymeasuringtheroadmilesover theshortestpracticalmaintainedroutefromthecountycourthouseofthefollowingcitiesortheemployee's home,whicheveriscloser,tothecenterofthejob. Eachcityshallbeconsideredthepointoforiginonlyfor jobswithinthatdistrict(asshownbelow). Travelpaywillbeginatmilezeroifaprojectisoutsideofthefree zone. District 1 - Kalispell: includes Flathead, Lake, Lincoln, and Sanders counties District2 - Missoula: includes Mineral, Missoula, and Ravalli counties District 3 - Butte: includes Beaverhead, Deer Lodge, Granite, Madison, Powell, and Silver Bow counties District4-Great Falls: includesBlaine, Cascade, Chouteau, Glacier, Hill, Liberty, Pondera, Teton, and Toole counties District 5 - Helena: includes Broadwater, Jefferson, Lewis and Clark, and Meagher counties District 6 - Bozeman: includes Gallatin, Park, and Sweet Grass counties District7-Lewistown: includes Fergus,GoldenValley,JudithBasin,Musselshell, Petroleum, and Wheatland counties District 8 - Billings: includes Big Horn, Carbon, Rosebud, Stillwater, Treasure, and Yellowstone counties District 9 - Glasgow: includes Daniels, Garfield, McCone, Phillips, Richland, Roosevelt, Sheridan, and Valley counties District 10 - Miles City: includes Carter, Custer, Dawson, Fallon, Prairie, Powder River, and Wibauxcounties MontanaPrevailingWage Pageiii EffectiveJuly 1,2000 Apprentices J. Wage rates for apprentices registered in approved federal or state apprenticeship programs arecontainedinthoseprogramsandarenot subjectto stateprevailingwagerates. Howe\'er. apprenticesnotregistered inapprovedfederal orstateapprenticeshipprogramswill bepaidthe prevailingwageratewhenworkingonapublic workscontract. K. Posting Notice of Prevailing Wages Section 18-2-406. Montana Code Annotated, provides that contractors, subcontractors, and employers who are performing work or providing services under public works contracts as provided in this part shall post in a prominent and accessible site on the project or work area, not later than the first day ofwork, a legible statement ofall wages to be paid to the employ- ees on such site or work area. L. Employment Preference Section 18-2-403, Montana Code Annotated requires contractors to give preference to the employment ofbona fide Montana residents in the performance ofwork on public works contracts. M. Building Construction Occupations - Definitions Note: Welders receiverateprescribedforcraftperforming operation to which weldingisincidental. ASBESTOS AND INSULATION Heatand Frost Insulator -D.O.T. 863.381-014 Covers boilers, tanks, pipes, and refrigeration units with insulating materials such as asbes- tos, cork, plastics, and magnesia. Asbestos Removal Worker - D.O.T. 869.684-082 Removes asbestos from ceilings, walls, beams, boilers, and other structures, following hazardous waste handling guidelines. Asbestos Removal Foreperson - D.O.T. 869.134-026 Supervises and coordinates activities ofworkers engaged in removing asbestos from ceilings, walls, beams, boilers, and other structures.
