MISSOURI ETHICS COMMISSION 1998 REPORT This report is published pursuant to Section 130.056.1.(8) RSMo., which requires the publication of a compilation of amounts contributed and expended for the influencing of nominations and elections, and Section 105.955, RSMo, which requires the publication of a summary of the written opinions issued by the Missouri Ethics Commission. Accordingly, this report contains a compilation of the campaign finance reports filed with the Commission, and the written opinions issued by the Commission during the calendar year 1998. The individual campaign finance reports containing the specific data from which the information in this report was compiled are available for public review during regular business hours at the offices of the Missouri Ethics Commission. Additional information regarding campaign finance reporting requirements and written opinions of the Commission may also be obtained by contacting the Commission office. Introduction Because this document is a compilation of the amounts contributed and expended to influence nominations and elections pursuant to Chapter 130, RSMo, it can only include information that has been reported to the Missouri Ethics Commission by the committees and persons that are required by state statute to file such reports. It therefore does not contain information concerning federal elections or local elections held in Missouri in 1998 for which there was no state reporting requirement. Section 130.026 RSMo, defines under what circumstances the Missouri Ethics Commission functions as the appropriate election authority or officer for candidates, committees, and ballot measures, and therefore establishes who is to file campaign finance reports with the Commission. The Missouri Ethics Commission is the appropriate filing officer for: 1) candidates for statewide office; 2) statewide ballot measures; and 3) certain local elections as provided by the statute. Therefore, campaign finance reports for these three types of events are to be filed with the Commission. The Missouri Ethics Commission is not the appropriate election authority or officer for the receipt of campaign reports for the following elections: 1) city and county elected offices in cities and counties of less than 100,000 population; 2) school districts and other special districts’ elected offices; and 3) ballot measure elections which are conducted on less than a statewide basis. Information concerning these elections and ballot measures are therefore not reported to the Commission and could not be included in this compilation. Information concerning those elections or committees that do not report to the Missouri Ethics Commission can be obtained through the local county clerk’s office or local election authority. U.S. Congressional and Presidential candidates file their reports with the Federal Elections Commission rather than the Missouri Ethics Commission. This document therefore does not contain information on federal candidates. However, copies of those reports are on file in the Commission’s office. The information contained in this document is based solely on the data supplied by candidates and committees in campaign finance disclosure reports filed with the Missouri Ethics Commission. Those disclosure reports are routinely audited, within the scope of authority granted to the Commission by statute. However, in this compilation, minor variations in the compiled numbers may occur due to mathematical rounding of the numbers. B. Definitions On the following pages the terms "receipts", "expenditures", and "contributions" are used. Provided below are definitions of each of these terms. 1. Receipts: The total of all contributions received and other receipts reported in support of or in opposition to a candidate or ballot measure for the election. 2. Expenditures: The total expenditures in support of the candidate(s) reported in support of or in opposition to a candidate or ballot measure for the election. Contributions: The contributions made in support of or in opposition to other candidates, political parties, ballot issues, committees, or organizations reported for the election. 1998 Election Year The year 1998 was a major election year. The position of State Auditor as well as all of the House of Representative seats were up for election. Half of the State Senate seats as well as half the Circuit Judge districts also held elections. Other positions up for election included, Associate Circuit Judge, County Clerk, and numerous county positions. On the following pages the elections are listed by office sought. Each candidate who ran in a primary election owed the following reports: April Quarterly, July Quarterly, a 7 day before the primary, and a 30 day after the primary campaign financial disclosure report. In general, each candidate who ran in the general election owed the following reports: October Quarterly, a 7 day before the general and 30 day after general campaign finance disclosure report. The figures listed on the following pages were obtained exclusively from reports, including amendments to reports, filed with the Missouri Ethics Commission. Such reports represent the only valid source of receipts, expenditures, and contribution information for Commission purposes. Specifically, the figures were obtained from information contained on the CD Summary page of each report, which is a summary of all activity conducted by a committee during a given time period. The receipts were obtained from Line 7 of each CD Summary page. The expenditures were obtained from Line 14 of each CD Summary page. The contributions were obtained from Line 19 of each CD Summary page. Therefore the following figures can reflect only the information contained in reports filed with the Commission on the day this compilation was made. Reporting information concerning candidates who were disqualified or withdrew is not listed in this compilation. The opinions issued by the Commission have been divided into topics based on general subject matter. These topics are lobbying, campaign finance disclosure, conflict of interest, and personal financial disclosure. For additional information on any of the opinions contact the office of the Missouri Ethics Commission. Lobbyist Campaign Finance Conflict of Interest Personal Financial Disclosure Lobbying Opinion Opinion Summary Number 98.01.100--1 Individual’s position as Executive Director and paid lobbyist would create conflict of interest. 98.01.101--2 Members of Community Bridge Corporation should register as lobbyists if activities are performed which are not exempt under definition of "legislative" lobbyist. 98.05.102--3 Information sent by elected official detailing golf tournament is considered solicitation to play and must be reported on lobbyist’s report. Campaign Finance Disclosure Opinion Number Opinion Summary 98.04.100-1 Candidates for federal office are considered "candidates" under Chapter 130 and cannot form, control, or direct a Missouri non- federal committee. 98.05.101—2 District population figures must be obtained from county election authority. 98.07.102—3 Corporation must report expenditures under provisions of 130.047, RSMo. 98.11.103--4 Expenses incurred by aide may be paid from campaign committee provided they are ordinary and necessary expenses incurred within duties of elective office. Conflict of Interest Opinion Number Opinion Summary 98.01.100--1 Individual’s position as Executive Director and paid lobbyist would create conflict of interest. 98.01.102--2 Purchasing of clinic (previously owned by doctor who resigned from Hospital’s Board of Trustees) by Hospital would not violate conflict of interest laws. 98.03.103--3 Terms "Executive" and " Administrative" within Section 105.454 refer to type of agency or organization in which employee or official serves, not to a particular level of responsibility within agency; former employee or official would not necessarily be barred from working for company regulation by PSC, but employee or official would be required to follow restrictions of 105.454(5). 98.04.104--4 County clerk may not retain fee office unless bidding procedure is used and bid is lowest received. 98.04.105--5 State Representative cannot continue to operate home care services company, which received funds from Division of Aging, unless bidding procedure is used and bid is lowest received. 98.04.106--6 Board member should recuse himself or herself on any matter coming before board where he or she has interest. 98.04.107--7 Confidential information shall not be disclosed which is obtained in the course of or by reason of employment or official capacity which would result in financial gain. 98.05.108--8 Alderperson falls under provisions of Section 105.458 and therefore cannot perform any service for political subdivision for compensation other than compensation provided for in performance of official duties. 98.06.109--9 No inherent conflict in working for brokerage firm while being elected official. 98.08.110--10 Individual is prohibited from working for state agency for one year; however, bid may be made on contract during one year period. 98.11.111--11 No conflict exists for employee of company to be member of MO Employment and Training Council. 98.11.112--12 No conflict in allowing students to attend functions at roller rink owned by school board member. 98.11.113-13 No prescribed method of public notice for sale under Sec. 105.454 RSMo. MISSOURI ETHICS COMMISSION 1998 REPORT State Auditor Election 1. Primary Election The primary election for the office of State Auditor was held on August 4, 1998. A total of 5 candidates filed for office. General Election The general election for the office of State Auditor was held November 3, 1998. A total of four candidates ran for election in the general election. The two candidates that were successful in the primary election and advanced to the general election were: Claire McCaskill and Charles Pierce. In addition, Gerald Geier and George Weber ran in the general election. MISSOURI ETHICS COMMISSION 1998 REPORT State Senate Election 1. Primary Election The primary election for the office of State Senator was held on August 4, 1998. Senate seats are elected by district, with the even numbered districts having elections in 1998. A total of 42 candidates ran in the primary election for 17 Senate seats.
