INTRODUCTION 1.1. GENERAL Italian Presidential Decree no. 90 of 15 March 2010, Article 119, establishes that the Directorate of Air Armaments and Airworthiness (DAAA), in accordance with Article 745 of the Italian Navigation Code, shall be responsible for certifying, registering and authorizing Military Aircraft for air navigation. The DAAA, as National Military Airworthiness Authority (NMAA), takes part in the O Military Airworthiness Authorities Forum (MAWA Forum) of the European Defence S U Agency (EDA). The aim of the Forum is to establish a common regulatory framework L' L among the European Military Airworthiness Authorities in order to harmonise military E D airworthiness requirements, processes and procedures across Europe. The MAWA A developed a set of European Military Airworthiness Requirements (EMARs), M I published by the EDA, to be implemented by each participant Member State (pMS) in R P its own domestic regulation framework, for the purposes of managing the initial, A' continued and continuing airworthiness. T I D In this context, the DAAA is responsible for: I L A - certifying the initial and continued airworthiness of military aircraft and related V A products, parts and appliances; L E - approving design and production organisations; N R - authorising Military Permits to Fly (MPtF). A C I F 1.2. PURPOSE RI E V The purpose of this Technical Publication (TP) is to adopt at National level the - requirements that EMAR 21 - Section A (“Certification of military aircraft and related A T products, parts and appliances, and design and production organisations”) A P establishes in order to govern the obligations and privileges of the applicant for, and M holder of, any certificate issued or to be issued in accordance with this regulation. A T S This publication includes 2 Annexes: A I P • Annex 1: EMAR 21 Section A “Technical Requirements”; O C • Annex 2: EMAR 21 “Acceptable Means of Compliance (AMC) and Guidance Material (GM)” for all requirements listed in Annex 1. 1.3. T I D This TP does not apply to RPASs enclosed in the categories “Mini” and “Micro”, as I L A defined in the AER(EP).P-7 (Section 4), and related products, parts and appliances. V A L 1.4. VALIDITY E N The present TP shall enter into force from the 1st of January 2017. R A C 1.5. DEFINITION AND ACRONYMS I F I R For the purposes of the present TP, EMAD 1 acronyms, definitions and terms shall E V apply. - A T 1.6. P O C Where not specified, the Standards and Requirements listed above shall be understood to be in their most recent applicable version as available on EDA website: http://www.eda.europa.eu/experts/airworthiness/mawa-documents, and on DAAA website: http://www.difesa.it/SGD-DNA/Staff/DT/ARMAEREO/Biblioteca/Pagine/default_.aspx. 1 For this purpose, the DAAA will issue a specific directive. 2 AER(EP).P-21 2. MEANS OF ADOPTION The present TP is issued in order to adopt EMAR 21 - Section A requirements, contained in Annex 1. 2.1. ADOPTION TABLE The following table contains all the means of adoption used in order to implement EMAR 21 - Section A requirements. Across EMAR 21, each time 21.A.101 A I “airworthiness code” appears, it generally P 21.A.103 O refers to the applicable airworthiness C Subpart H 21.A.175 requirements, as established in accordance with 21.A.17A and 21.A.101. Subpart P 21.A.701 (a)(2) All relevant information shall be held for a Subpart B 21.A.55 minimum period of ten years after the removal of service of the last aircraft of the type Subpart D 21.A.105 (b) certified. This period may be prolonged if any investigation is on-going after this period. 3 AER(EP).P-21 When appropriate airworthiness codes are not Subpart D 21.A.101 (b) available and the Type Certification Basis is established in accordance with 21.A.17A (a)(3), an applicant for a change to a type- certificate shall demonstrate that the changed product complies with the airworthiness requirements in the latest version of the Type Certification Basis. Authority shall not grant the privilege of Subpart J 21.A.263 (c)(6) O approving the conditions regarding the S U issuance of a MPtF per 21.A.710 (a)(2) in case L' of initial flight of: L E - a new tipe of aircraft; D A - a significantly changed aircraft or M significant STC; RI P - significantly modified flight and/or piloting A' characteristics. A T A EMAR 21 Edition 1.2 has been produced to address the EASA Part 21 amendments P M from M6 (2011) up to and including Commission Regulation (EU) No 69/2014 and A the corresponding AMC & GM. In deliberating the amendments, Task Force 2 have T S engaged with EASA to better understand the rationale for some of the amendments, A as a result EMAR 21 Edition 1.2 maintains coherence with the corresponding version I P of EASA Part 21, deviating only where it is necessary for use within a military O airworthiness context. C Specifically EMAR 21 Edition 1.2 does not include the EASA Part 21 amendment in relation to European Light Aircraft (ELA)1 or ELA2 aircraft as these are not deemed to be representative of typical military aircraft. The EASA Part 21 amendment relating to ‘standard changes’ have also not been included as this is considered inappropriate for use within a military airworthiness context. The EASA Part 21 amendment relating to Operational Suitability Data (OSD) has not been fully incorporated into EMAR 21 Edition 1.2, although it is recognised through Edition Number : 1.2 Edition Date: 4th Oct 2016 Status: Approved Page 3/119
