March 23, 2010 The Wythe County Board of Supervisors held its regularly scheduled meeting at 9:00 a.m., Tuesday, March 23, 2010. The location of the meeting was in the Board Room of the County Administration Building, 340 South Sixth Street, Wytheville, Virginia. MEMBERS PRESENT: Wythe B. Sharitz, Chair Gary M. CITIZENS’ TIME Chair Sharitz welcomed the guests and citizens present at the meeting, and inquired if there was anyone present who wished to address the Board. Being no one present to address the Board, Chair Sharitz closed Citizens’ Time. MINUTES OF PREVIOUS MEETINGS The Board was presented with the February 9, 2010 minutes and the February 23, 2010 minutes for adoption. McRoberts NAYS: None PUBLIC HEARING – DHCD – COMMUNITY DEVELOPMENT BLOCK GRANT Chair Sharitz announced that the Board of Supervisors of Wythe County, Virginia (the "Board"), will hold a public hearing on Tuesday, March 23, 2010 at 9:05 a.m. in the Board Room of the County Administration Building. The general purpose of this hearing is to solicit public input on a proposed Community Development Block Grant (CDBG) proposal to be submitted to the Virginia Department of Housing and Community Development for Long Meadows Housing Development Project. Residents of the project area are encouraged to attend. The proposed Long Meadows Housing Development Project will include property acquisition, water line construction, and LMI housing. Chair Sharitz asked if anyone present wish to address the Board regarding this subject matter. Mr. Dalton appeared before the Board and presented specific information regarding the proposed Long Meadows Housing Development project. He reported that Mount Rogers Planning District Commission is preparing a proposal for the Board to submit to the Department of Housing & Community Development. The components are to apply for a $700,000 grant; $600,000 will be for purchasing the High Meadows subdivision on Route 52 South in Fort Chiswell. He reported that the road is paved and lots are built in the subdivision. He anticipates the housing study to be done by Mr. Kegley. He noted that there will be four to five lots sold at market value and the rest will be subsidized with low interest rates. He reported that the County will offer to wave tap fees for the low to moderate-income families and will also provide in-kind services for water inspections. 2 Board of Supervisors March 23, 2010 Mr. Dalton distributed a resolution for the Board’s consideration, which must accompany the grant application. He noted that Mr. Kegley is making applications to SERCAP and other agencies for funding to assist with building the homes. Supervisor Umberger asked for clarification for mixed income households. Mr. Dalton explained that the houses will be offered to different levels of income, from low to moderate income and some lots will be sold at fair market value which would be above the low to moderate-income levels. This would provide for a mixed use in community. Mr. Mike Hall, Chairman of the HOPE Board, appeared before the Board and spoke regarding the proposed project. He reported last year in the Town of Wytheville, six building permits were issued and of those six, five were for HOPE. He spoke regarding the Deer Field Subdivision and indicated that they are working on Phase II of it which will add 13 families to the Deer Field community. He reported that HOPE currently has 35 potential families it is working with for eligibility for the proposed project. Hearing no further comments, Chair Sharitz closed the public hearing. Supervisor Poole made a motion to adopt Resolution 2010-08 as follows: WHEREAS, pursuant to the public hearings held on March 8th and March 23rd, 2010, Wythe County wishes to apply for Seven Hundred Thousand dollars ($700,000) of Virginia Community Development Block Grant funds for Acquisition of an existing planned subdivision to be used for the Long Meadows Housing production Project; and WHEREAS, a property transfer agreement between Wythe County and Helping Overcome Poverty’s Existence (HOPE) inc, will be executed to allow HOPE to proceed with housing production and LMI benefit; and WHEREAS, Wythe County will waive tap, water inspection and connection fees for each house; and WHEREAS, it is projected that 24 housing unit lots will be made available for mix-income affordable homeownership opportunities with a minimum of 51% low-to-moderate income households; NOW THEREFORE BE IT RESOLVED, that the Wythe County Administrator is hereby authorized to sign and submit appropriate documents for the Community Development Block Grant application. McRoberts NAYS: None TREASURER’S REPORT Mr. Dalton informed the Board that Sam Crockett, Wythe County Treasurer, was at a Treasurer’s meeting today. He distributed an updated Revenue Statement, and presented the Treasurer’s Report as follows: 1. Trial Balance & Revenue Statement - The Board reviewed and accepted the Bank Statement, Trial Balance and Revenue Statement as submitted for the month ending February 28, 2010. Mr. Dalton informed the Board that 105% of the budget had been collected and over 5,000 stickers had been sold. SHERIFF REPORT 1. Homeland Security Program Grant – License Plate Reader – Deputy Keith Dunagan informed the Board that the Wythe County Sheriff’s Department was awarded $17,000 in federal funds by the Department of Homeland Security for the mobile tag reader. Supervisor Poole made a motion to accept the grant from the State Homeland Security Program for the License Plate Reader, and to amend and appropriate the funds into the police activity fund. McRoberts NAYS: None SUPERVISORS REPORTS 1. Wythe-Grayson Library Board – Supervisor Umberger stated she had attended the Wythe-Grayson Library Board Meeting last week in place of Supervisor McDaniel. 2. Virginia Sesquicentennial – Vice Chair Umberger informed the Board that the Virginia Sesquicentennial Committee met and discussed the possibility of reenacting some of the local historical events. She added that Tazewell has expressed a desire to join into the celebration, and they are still talking with Bland regarding the event. 6 Board of Supervisors March 23, 2010 3. Red Badge of Courage – Playgroup – Vice Chair Umberger informed the Board that she received a call from Mary Boenke, Chair of the playgroup that is part of Wythe County Educational Foundation. Supervisor Umberger stated that Ms. Boenke would like to bring in Barter Theatre to perform the Red Badge of Courage for the local children as it deals with the SOLs for Ninth and Tenth Grades, with the possibility of an evening production for the community. Vice Chair Umberger stated that she contacted G.W. Catron, President of the Historical Society, regarding this event as well. 4. Wythe-Grayson Library Board (continued) – Vice Chair Umberger added to her report that the Wythe-Grayson Library would be starting interviews for the new Director that day. 5. Trash – Vice Chair Umberger stated there is a problem with trash and litter all over the roadsides. Supervisor Poole indicated that they have just gotten the crew back for trash pick-up and they would be able to address Wytheville’s litter soon. Vice Chair Umberger stated that she had citizens even ask her about doing the roadside cleanup themselves. She stated they inquired about where to get the bags and items to do the trash pick-up. Mr. Dalton indicated that VDOT still offers the Adopt a Highway and Trash Collection Programs. He explained that they provide trash bags and pick-up from the roadsides, and the County convenience centers would accept the collected garbage bags. 6. Local Calls – Budget Cut Concerns – Supervisor Houseman stated he received many calls about the County Budget. He stated that citizens have asked that the schools, emergency services, and Sheriff’s Department not be cut. 7. Rural Retreat Rescue Squad – Supervisor Houseman informed the Board that he had also met with the Rural Retreat Rescue Squad regarding the request that is coming up later in the meeting. 8. Appreciation – Supervisor McDaniel – Supervisor McDaniel stated that he had been limited in what he was able to do since his injury, and he expressed appreciation to Supervisor Umberger and everyone else for their help. 9. Regional Jail Meeting – Supervisor Poole stated that she attended the regional jail meeting, dedication, tour, and luncheon for the new jail addition. She added her understanding that the jail would not be opening the entire wing at one time. 7 Board of Supervisors March 23, 2010 10. Petition – Liquor-By-The-Drink – Supervisor Poole stated that the committee had formed regarding Liquor-By-The-Drink. She stated that the group had met and petitions requesting this option for Wythe County are out in the community for signing. She commented that they hoped to get Liquor-By-The-Drink on the vote ballots by this fall’s election. 11. School Board and FRA Meeting – Supervisor McRoberts informed the Board that he was unable to attend the School Board meeting, but he did attend the Fire & Rescue Meeting. HE stated that there was no news on the MED3000 at this time. 12. Monthly Meetings – Supervisor Horney stated that he attend the monthly meetings that he is committed to; however, there was no action taken worthy of reporting. 13. Water Consolidation Committee – Chair Sharitz stated that they would need a Water Consolidation Committee to work with the Towns on the water line extension between Wytheville and Rural Retreat. Chair Sharitz appointed Supervisor Houseman, Vice Chair Umberger, and himself to serve on the committee. Mr. Dalton added that he would try to schedule a meeting of the group with the Towns following the Joint Meeting next week. 14. Joint Meeting – Chair Sharitz reminded the Board that there would be a Joint Meeting next Monday, March 29, 2010 at the County Administration Building. 15. NRMRWIB – Chair Sharitz referenced a letter from Ronnie Martin with the NRMRWIB requesting an alternate be appointed to the Board to represent Wythe County should the elected member be unable to attend. The letter explained that the appointee would need to be an elected official of in an administrator/city manager’s position. After the Board’s discussion of the WIB’s meeting schedule, Supervisor Houseman volunteered to serve as the alternate. Chair Sharitz asked that Mr. Dalton inform the NRMRWIB that Supervisor Houseman fill the needed appointment. 16. MRPDC – Chair Sharitz informed the Board that the MRPDC Spring Meeting would be April 1, 2010 at the Crossroads Institute in Galax. WATER COMMITTEE REPORT 1. Speedwell to Wytheville Water Extension Routes – Supervisor Horney explained that the Water met on Tuesday, March 16, 2010 and reviewed two routes for the Speedwell to Wytheville water extension. The committee recommended the Crockett route but requested community information meetings at the Administration Building to help determine which route should be taken. 8 Board of Supervisors March 23, 2010 Mr. Dalton explained that they do not have a good feel for who needs the water in the area. He stated that the committee felt if there were community meeting, they would provide that input. The consensus of the Board was for County staff to schedule the public input meetings concerning the water route. 2. Industrial Pretreatment Limits – Supervisor Horney noted that the Water Committee further reviewed the industrial pretreatment limits and recommended the revised limits be sent to the DEQ for approval. Mr. Dalton commented that the revised information would provide more flexibility to industries. COUNTY ADMINISTRATOR’S REPORT 1. Old School Road – Mr. Dalton reviewed with the Board a March 10, 2010 letter from Rural Development regarding the project to provide public water to the Old School Road community. He noted that he received and signed the letter of conditions for Old School Road. The Board and Mr. Dalton discussed the perimeters that the water project would encompass. 2. VACo Risk Management Programs - Renewal – Mr. Dalton reviewed a letter and proposal from VACo Risk Management Programs regarding the renewal quotation for Wythe County’s insurance policy. He noted that the County would receive some credits and reduction in costs. COUNTY ATTORNEY’S REPORT 1. River Hills Subdivision – Mr. Farthing referenced an issue between the County and River Hills Subdivision regarding a right-of-way. He explained to the Board that the County ruled against allowing the subdivision to establish “common areas” as an individual lot, so the subdivision owners extended the right-of-ways to include the common area and parking area. He stated that the County deems these areas as public ways, whereas the owners claim the two areas and the road is exclusive to owners who purchased the lots in the subdivision. Mr. Farthing stated the attorney for the River Hills Subdivision has taken it to Court to see if they have the right to claim the common area, parking lot, and road is not a public access area. The County Attorney stated he would keep the Board informed as the case is updated. 2. Juvenile & Domestic Relations Court Space – Mr. Farthing referenced the motion from the previous Board meeting that approved for DSS to use the space in the upstairs portion of the Courthouse. Mr. Farthing stated that he was contacted by 9 Board of Supervisors March 23, 2010 Judge Showalter after the information was passed on to the judges. Mr. Farthing explained that Judge Showalter was angry about the decision not to allow J&DR Court use of the space and was disappointed in the way he was notified through a memo. He stated that the Judge felt he had say over all courthouse space and explained that his interpretations of the Code Sections differed from Mr. Farthings. The County Attorney stated suggested trying to establish a resolution that would allow DSS and the courts to use part of the space. Mr. Farthing stated that Mr. Dalton had a meeting with Judge Showalter the following day to discuss the situation. Supervisor Houseman inquired if the County would be in a position of liability if something should happen since safety is one of the judges concerns. Mr. Farthing responded that because safety has been a well-known issue for a long time, the County is at risk for some liability in the event of a problem regardless. Mr. Dalton explained the plans to offer one room to be used by the courts for a witness room and to allow DSS the use of the remaining space. He commented that there are also plans to move the metal detectors to the courthouse entrance while closing off the Fourth Street exit to address some safety concerns. Supervisor Houseman expressed a desire to work out a compromise with Judge Showalter and Judge Chitwood.
