NOTIFICATION

‘No. SEC/RPP.2017/CR-54/D-11.—Whereas, the superintendence, direction and control of all
elections to the Panchayats and Municipalities in the State are vested in the State Election
‘Commission, Maharashtra by virtue of Article 249-K and 243-ZA of the Constitution of India, and
the provisions of the relevant State law as applicable to such Panchayats and Municipalities ;

And whereas, with a view to provide, in the interest of sanctity of elections to the local
bodies, and in the interest of conduet of such elections, in a free, fair, effective and efficient manner,
for the registration of political partios and for matters connected thorewith; the Registration of
Political Parties Order, 2009 and Maharashtra Election Symbols (Reservation and Allotment)
Order, 2009 has been made by the State Election Commission, Maharashtra vide the State Election
Commission, Maharashtra, Notification No. SEC/MC-2009/CR-49/D-11, dated the 31stMarch 2009 ;

‘And whereas, the said Order applies to all elections held to local bodies in the State on party
except elections to Village Panchayats where elections are held on partyless basis

And whereas, before registering a political party under this Order, it is necessary to publish
‘4 notice in the Maharashtra Government Gazette indicating therein, the name and address of the
political party, its President and the symbol proposed to be allotted, ifany, and calling for objections,
if any, for such registration from the general public;

‘And whereas, as per the said Order, if no objection is received within 30 days from the date
of publication of such notification in the Maharashtra Government Gazette, it shall be competent
for the State Election Commission to register the political party, as proposed in the notification ;

‘And whereas, if any objection is so received, the State Election Commission may consider the
‘same and in case it is found to be without substance, it may reject the same and register the
political party. If on the other hand, the State Election Commission considers that the objection is
rima facie genuine, then the same shall be communieated to the applicant and his remarks shall
be called for. After receipt of the remarks, the Commission may either decide the matter on
‘merits on the basis of the records available or it may give personal hearing to the parties concerned
‘and take a decision thereafter. The decision of the State Election Commission shalll be final ;

‘And whereas, Shri Anil Shivmurti Bhosale, President “Bhim Army”, having main office

jpplied to the State Election Commission for registering * Bhim Army” as a political

‘And whereas, the said party being neither a recognised National Party nor a State Party, it is
‘ot imperative to reserve symbol to it from the list of free symbols ;

‘And whereas, as per the aforesaid Order a candidate at an election to local bodies in the
State, other than a candidate set-up by a recognised political party shall choose and shall be
allotted one of the symbols specified as free symbols by the Commission ;

‘And whereas, as per the said Order if the same free symbol has been chosen by several
candidates at such election, then, if of those several candidates only one is a candidate set-up by
registered political party and all the rest are independent candidates, the returning officer shall
allot that free symbol to the candidate set-up by the registered political party and to no one else,
and if of those several candidates two or more candidates are set-up by different rogistered political
parties and the rest are independent candidates, the returning officer shall decide by lot to which
of the two or more candidates set-up by the different registered political parties that free symbol
shall be allotted and allot that symbol to the candidate on whom the lot falls and to no one else ;

‘And whereas, itis necessary for the State Blection Commission to call for objections, if any,
from the general public for registration of the said party as a political party.

Now, therefore, the State Election Commission, Maharashtra, hereby calls for objections, if
‘any, for such rogistration of the said party from the general public within 90 days from the date of
Publication of this notification in Maharashtra Government Gazette.
