Tess MacMorris, Southwest Florida Regional Planning Chelsea May, SWFL Goodwill Housing Agenda Item 1 – Call to Order/Affidavit of Publication/Roll Call Ms. Marion Briggs brought the meeting to order at 2:00 p.m. in the Public Works/ Community Development Building, 1st Floor Conference Room, Downtown, Fort Myers. A roll call was taken and quorum was confirmed. Ms. Amanda Swindle, stated the Affidavit of Publication had been reviewed by the County Attorney’s office, was sufficient as to form and content and the meeting could proceed. Agenda Item 2 – Approval of 11-17-2017 Minutes Mr. Michael Polito made a motion to approve the minutes with Dunbar Industries, Inc being changed to Dunbar Improvement, Inc. Mr. Matthew Visaggio 2nd the motion and the motion carried 5-0. Agenda Item 3 – Elections – Chair and Vice-Chair Mr. Polito nominated Marion Briggs to be Chair of the committee. Mr. Al Giacalone 2nd the motion and the motion was carried 4-0. Mr. Giacalone nominated Mr. Vissagio to be Vice-Chair of the committee. Mr. Anthony Pardal 2nd the motion and the motion was carried 4-0. Affordable Housing Committee January 8, 2018 - draft Page 1 Agenda Item 4 – Overview of Committee Duties per ord. 08-11 Ms. Sharon Jenkins-Owen gave the committee an overview of their duties. Ms. Jenkins-Owen let the committee know in the coming months staff will also be providing them with the new SHIP application, the SHIP Policy and Procedure Manual and quarterly status update on open contracts. The committee was informed that these items will be for their review and input. Ms. Marion Briggs asked staff if the SHIP Policy and Procedure manual was a requirement by HUD. Ms. Antia Richards let the committee know that is a requirement from the State. Ms. Briggs stated that she has talked to other communities and believes that the Lee County Affordable Housing Committee should be the parent committee that all other municipalities in Lee County to look to for advice and be able to follow. Ms. Briggs asked where the obligation ends for the Affordable Housing Committee. Ms. Rozdolski explained that they are a board appointed committee and must take direction from the board and follow state ordinances for SHIP. Mr. Polito would like someone from the commissioner’s office to start attending the Affordable Housing Committee Meetings. Ms. Briggs believes that she can get someone from the commissioner’s office to attend and will work on this for upcoming meetings. Ms. Briggs asked for an overview of the Sunshine Law. Ms. Amanda Swindle gave the committee an overview of this law. Agenda item 5 – Local Housing Assistance Plan (LHAP) Amendment Ms. Jenkins-Owen explained to the committee that staff is recommending that the LHAP be changed to allow the maximum funding to be increased from $45,000 to $65,000 for very- low income households due to the market conditions and increase cost of construction. Ms. Jenkins- Owen also explained that staff has researched this topic with other counties and municipalities and has spoken to the non-profits providers. The $65,000 amount is what is needed for non-profits to be able to construct very-low income homes and meet the requirements for SHIP funds. Mr. Giacalone asked to see the distribution that was done for the SHIP FY 2017/2018 to see how the money was distributed to the new construction and rental properties. Ms. Richards explained to the committee that the state requires that 30% of the funding be used for very low-income households. Ms. Kitty Green from Habitat for Humanity explained to the committee that without the funding going up to $65,000 they would not be able to help very-low income families due to appraisals on the rise and the cost of construction. Ms. Maki asked staff what the income requirements are for very-low income household. Ms. Rozdolski stated that for a single person the income maximum is $20,400 and for a family of four the income maximum is $26,100. Affordable Housing Committee January 8, 2018 - draft Page 2 Mr. Vissagio made a motion to approve the LHAP changes. Ms. Maki 2nd the motion and the motion was carried 5-1 with Mr. Giacolone objecting. Agenda Item 6 – BoCC November 7, 2017 work session Ms. Rozdolski informed that the committee that the BoCC gave us the direction to define the problem that inhibits creation or availability of affordable housing and identify the county’s role in a solution. The BoCC asked staff to work with the Affordable Housing Committee and the Attainable Housing Coalition Steering Committee to come up with a plan to bring back to the Board. One of the items discussed by the committee members was that non-profits building affordable housing should not have to pay impact fees for the construction. The committee members asked staff to supply them with any reports that were done by Lee County and any other counties on affordable housing for their review and for their discussion at the February 12, 2018 meeting. Ms. Briggs asked when the reduced collection rate expires is up on the impact fees. Ms. Rozdolski stated that the BoCC will begin discussions at an upcoming work session and will need to make a decision by March regarding the collection fee and rate. Mr. Vissagio made a motion that the AHC recommend to the BoCC to impose a 1 year moratorium on the collection of all impact fees from non-profit organizations that provide affordable housing. Mr. Pardal 2nd the motion and the motion was carried 6-0. Mr. Giacalone asked if an Affordable Housing Committee member can speak on behalf of the committee on impact fees at the BoCC workshop. Ms. Rozdolski said that she would ask the county attorney’s office if this is problem and get back to the committee members. Mr. Giacalone made a motion that Ms. Briggs speaks at the BoCC workshop on behalf of the Affordable Housing Committee on impact fees with attorney approval. Mr. Vissagio 2nd the motion and the motion was carried 6-0. Agenda Item 7 – Items by Committee Members No items by committee members Agenda Item 8 – Items by Public Ms. Tess MacMorris stated that she attended a round table discussion on affordable housing in Broward County with discussion on financing of affordable housing. She said that she would be sharing the minutes and documentation from the meeting with the members of the affordable housing committee and staff. Ms. Briggs asked for a motion to adjourn. Motion was made by Mr. Polito and 2nd by Mr. Vissagio. Affordable Housing Committee January 8, 2018 - draft Page 4 DEPARTMENT OF COMMUNITY DEVELOPMENT Memo Date: February 2, 2018 To: Affordable Housing Committee Members From: David Loveland, Director, Community Development Subject: IMPACT FEE UPDATES ______________________________________________________________________________ The County charges impact fees for new development at the building permit stage to address capacity needs for six types of facilities or services: Roads, Schools, Regional Parks, Community Parks, Fire services, and Emergency Medical Services (EMS). State law requires that local government impact fee rates be based on the most recent and localized data available, which is addressed in the Chapter 2 of the County’s LDC requiring updates of the studies every three years. The Road and School impact fee schedules were last updated in 2015 and the Parks and Fire/EMS schedules were last updated in 2012. The County’s impact fee consultant, Duncan & Associates, has completed the 2018 impact fee study updates, and is recommending changes to the County’s impact fee schedules, mostly due to cost increases. The data for each of the studies was provided by various Lee County departments, the cities, the School Board and the Fire Districts. In addition to the fee schedules, the consultant identified the need to expand the list of land use types for the Road impact fees, based on distinctions found in the latest ITE Trip Generation Manual. The County is also proposing to revise the required update timeframe, extending it from 3 years to 5 years, to ease the constant update cycle and allow for a staggering of the studies. The new time frame would still meet the intent of State law. Copies of the current drafts of each of the studies, along with the LDC changes are attached. Review of these studies is being provided to the Affordable Housing Advisory Committee as a courtesy and no motion or recommendation is required. ahc summary memo impact fee studies.docx The Board will consider the LDC updates in two public hearings before final adoption. Any increases in impact fees require a 90-day window for implementation per County codes. It is worth noting that the studies update the base rates for each fee, but the rate of collection is a separate policy issue that will be decided by the Board of County Commissioners and implemented through a separate, stand-alone ordinance if different. The update deadline is coming up in March.
