Soldier gets $115,000 in dog bite lawsuit BY NICK TABOR NEW ERA STAFF WRITER A U.S. soldier who is serving out a deployment in Afghanistan will get $115,000 when he returns next month. He’ll have to split it with the attorney who helped him sue the city of Oak Grove and its police officers. Richard C. Lestienne, 29, said a trio of Oak Grove officers violated his constitutional rights when a police K-9 bit him during an arrest. He con- sidered this cruel and unusual punishment, and he also accused the officers of arresting him with- out probable cause. He and his attorney, Ken Hag- gard, initially asked for $1.1 million. The city settled Lestienne’s lawsuit in federal court on Jan. 9. Though both sides agreed to keep the terms confidential, the city provided copies of the paperwork after the Kentucky New Era filed an open records request. When a tax-funded agency enters into a lawsuit settlement, the records are usually public under Kentucky law, regardless of confidentiality agree- ments.
