IX FOREWORD The Ottoman Court Records Project aims to organize the ocean of information in the sharia court records of Istanbul towards a deeper understanding of the history of that ciry and to collaborate with colleagues working on similar archives pertaining to other cities that were once administered within the Omoman imperial system. The project was launched in r99o when Nurhan Atasop Cemal Kafadar, and Gulru Necipoglu joined forces with Halil Inalcik, the doyen of Ottoman studies, who had pioneered the use of these sources as early as the r94os. ApproximarcTy ten thousand volumes (defters) survive from the proceedings of the courts of Ismnbul during the Ottoman era, and each volume contains several hundred case entries. Despite some gaps due to fires or physical damage, the defters constitute one of the most complete series of its kind for any major ciry of the world from the sixteenth to the early twentieth century. The collection was housed in the head- quarters of the Mufti of Istanbul, also known as the Sheikhulislam, when Abdtilhamid II (tfi76- r9o8) decided to have the records bound and organized chronologically for each of the district courts that func- tioned within the metropolis. These archives have remained in the same building during the republican era when secularization of the legal system has rendered the sharia courts themselves obsolete.' The court records are of inestimable importance for reconstructing the fabric of social and economic life of a ciey that was the capital of an empire that covered most of the Middle East and southeastern Europe for the better part of four or five centuries. They arc vital for understanding critical aspects of the political, administrative, Iegal, economic and social structures of the empire and their transformation over time. The kadis, who presided over these courts, were more than merely judges in the strict sense of the term. They also performed a variety of notarial and even some mayoral functions, and the registers therefore contain not only details of pleas entered and decisions rendered, but also registration of proper- ties, certification of official and private documents, recording of business transactions, and information on economic matters such as prices and taxes. The cases heard by the kadis cover a broad range of issues, including marriage and divorce, disputes over inheritance or among neighbors, business partnerships and licensing agreements, petitions from individual proprietors and guild members, and crime. The parties included rich and poor, men and women, Muslims and non-Muslims alike.' Our prim ary goal. has been to edit and publish the defters, both in print and in electronic format. Since this will be the first full publication of an Ottoman court register with scholarly transcription and facsimile, we have pondered carefully the appropriate conventions and protocols for editing such a corpus, hoping to contribute to the ongoing refinement of the scholarly toolkit of Ottoman studies. This phase of our project is limited to the courts of "Istanbul itself" (the ciry intramuros), but we hope eventually to include the courr records of other townships that were part of the metropolis stretching across land and water to Eyup, Galata, and Uskudar, which can boast of the earliest extant defters in all of Greater Istanbul, going back to r5rl, and to glean other kinds of records as well. Beyond Ismnbul, we hope that the project will serve as a model for research projects on other cities under Ottoman rule-e.g., Aleppo, Cairo, Jerusalem, and Sarajevo-where similar records exist in abundance and await organization.l XI IsreNBUr- MAHKEMEST rzr. $rR'iYve Sicili A sccon.i component of the project involves mapping the information in these records to provide a graphical illusrration of rhe social ropography of Istanbul between the sixteenth and nineteenth centuries. Mrrny .lgcuments involve real estace transacrions and provide indicacions as to the locations of ProPerty. -l-6is information can be used to establish the physical coordinates of residential and corrunercial units es well as public buildings, including borh the monumenral structures and more modest ones among mosques, churches, synagogues, or baths and founcains. We hope that the computerized databases will enable researchers ro arrive at a picture, for example, of what kinds of shops a Particular neighborhood had, how rents for homes or shops fluctuated, who were the occupants of various buildings, what were the patterns of ownership in various quarrers of the ciry, how many marketplaces existed at different times, and how street networks changed over the centuries. The earliesr exranr map of the ciry providing a detailed layout of streets and blocks dates ftom n1z A.H. (rg16 - r7). Accordin dy, *" decided ro begin our study and publication with defters from that year. We have already digitized, the map of 1816 -17, as well as some other historical maPs' and we are working on exrracting rhe relevant information in the sijills as well as gathering further data from other sources to be locared on che maps in order ro capture the social fabric of different neighborhoods. The project team is also mapping dramacic evenrs such as fires and revolts as they unfold in space and time, on the basis of sources that combine narrative accounts with demiled topographic information, so that we acquire an und.erstanding of not only those events themselves but also the transformation of the neighborhoods and streers that constituted rheir serring. Meanwhile, we have turned our attention to earlier defters from the sevenreenth and eighreenth centuries, some of which we are now preparing for publication. In all this activiry since r99o,we have been forrunace to receive the support of various institutions, and it is a pleasure ro acknowledge their conrributions. Among academic institutions, the Art Historical Institute of Istanbul Universicy (dtrring the deanship of Nurhan Atasoy) and the Aga Khan Program for Islamic Art and Architecrure ar Harvard Universiry (under the directorship of Gulru Necipoilu) have provided a home ro cerrain componenrs of rhe project in its early stages. The Center for Middle Eastern Studies at Harvard Universiry and Sabanci University continue to collaborate on various asPects' including Pttb- lication. We are also indebted ro rhe muftiship of Istanbul and to ISAM (the Islamic Research Center), which is the home of a microfilm collection of rhe whole archive of Istanbul court records, for allowing us access to the materials we have been working on. In terms of fundin !, weremain grateful to the Kog Foundation inTirrkey and the Aga Khan Founda- tion in Geneva for their supporr in the critical early phases of the project. Above all, we have been blessed since 1999 wirh the generous and consisrenr parrnership of the Packard Humanities Institute (PHI), which enabled us to work with a Iarge number of comperent readers from among senior academics at differenr universiries, whose narnes will appear on the tide Page of each volume. pHI's supporr extends from financial and rechnical assistance to scholarly collaboration, and it has enabled us ro d.u.lop rhe projecr in new direcrions. Upon David W. Packardt suggestion, for instance, we decided ro inuod.uce a new appararus, namely a context-sensitive concordance (appended here as a CD and to be updared in some of che furure volumes), for which software had to be developed that would function in conformiry with our rranscription system. The elaboration of the menu of symbols to indicate differenr rypes of editorial interventions was, likewise, the outcome of his encouragement' XII IsTINBUI- MeHreMssi rzr. $r*'iyyr Sicili Work is in progress to publish a full English translation of the first volume in print, and selections from future volumes, in order to make these rich sources available to students of comparative law and to non- specialists around the world. For the time being, such users may benefit from the bilingual table of con- tents that is here provided. These innovations, as well as the ones we hope to introduce in the future, such as software for lemmatization and proofreading for Ottoman Tirrkish, would have been unimaginable without our collaboration with PHI, which we have been fortunate to enjoy thanks to the institutet enlightened vision of the nature of scholarship and a shared desire to contribute to the international enterprise of Ottoman studies. Cemal Kafadar Istanbul, zoo4 r. Ahmet Akgundirz, $er'iyye Sicilleri: Mahiyeti, Toplu Katalogu ve Segme Hrikrimler (Ttirk Dtinvasr Araqtrrmalarr Vakfi, Istanbul, 1988), I:85-166 provides a vear-by-year catalogue of the defters of the courts of Istanbul in chat archive. Bur note rhat it overlooks several dozen defters, also of the courts of Istanbul, that are in the National Library (Milli Ktittphane) in Ankara (transferred there from theTopkapi Palace Archives).
