An administrative law issue has arisen.Theissueisdifficult.Theneedforanswersisurgent.Thetimeis runningout.Inthissituation,foraslongastheadministrativelawbar inCanadacanremember,thereisonlyonequestion: ‘WhatdoesProfessorMullanhavetosayabouttheissue?’ Invariably,afterjustabriefsearch,wefindoneofhistimelyconfer- encepapers,oneofhisincisivearticles,oroneofhisclassictexts.Sure enough,DavidMullan’sinsightsarethere–veryrecent,practicalones, exactlyonpoint,ontheveryissuethatjustashorttimeagoseemedso intractable. Soon afterward, the insights find their way into the work product: a research memorandum, an opinion letter, a legal brief, oral argumentorrulingsandreasonsforjudgment,oftenbecomingthevery essenceofit. David’scontributiondoesnotendthere.Chancesarethathetaught thewriterortherecipientoftheworkproduct,shapinghisorherfun- damentalunderstandingofthearea.Orperhapsthewriterorrecipient attended one of the innumerable conferences to which David volun- teershistime.Orperhapsthewriterorrecipienthasreadworkproduct shaped by David’s work or authored by someone shaped and influ- encedbyDavid. David’scontributionisunique,profound,andunparalleledinqual- ityandextent.Itisfairtosaythatadministrativelawinthemodernera in Canada was born in 1968 when the Honourable James McRuer released his great five-volume report, Inquiry into Civil Rights. Two yearslater,DavidcametoCanadaandfromthattimehas actedlikea lovingparentoverthisareaoflaw,watchingoverit,nurturingit,help- viii Foreword ingittodevelop.Asaresult,weinCanadatodayarethebeneficiaries of a mature system of administrative justice that is practical, fair, and reflectsourfinestvaluesandtraditions. I had the privilege of teaching alongside David for several years in our upper-year seminar, ‘Advanced Constitutional Law,’ at Queen’s University.Fromthatclosevantagepoint,Ihaveobservedinmydear friend an exceptionally rare trifecta of qualities: intelligence but quiet humility, compassion but unceasing dedication to standards of excel- lence,and,aboveallelse,uncompromisingintegrityinallthathedoes. ThereisnobetterwaytorecognizeDavidandhismarvellouscontri- bution than to publish this exceptional collection of papers in his honour.
