In order to provide a more effective guide to the statutory law, each section of the Idaho Code, as well as each entry in the 2013 replacement index, was reexamined in light of subsequent amendments, enactments and repeals. Also contained in this replacement index is an index to local and special laws. The general index contains treatment of the laws compiled in the Idaho Code, the constitutions of Idaho and the United States, the Organic Act of the Territory of Idaho, the Idaho Admission Bill, Federal Laws of Particular Interest to Idaho and the various rules of the state courts. Statutory provisions are referred to in the index by section number (e.g., §18-105). The constitutions, court rules and other contents are identified by abbreviations, a table ofwhich follows this foreword. The general index is a topical index, not a random word index. Random entries in an index to statutes are misleading since they result in split or partial treatment. Therefore, we have chosen to use a systematic arrangement ofmain topical headings in order to avoid this split treatment. Main headings in the general index treat subject matter exhaustively, unless cross references are made to other main headings. Users ofteninquire as to Michie's®use ofcross references inindexes. Cross references serve to keep indexes to a manageable size by reducing the amount of repetition of treatment under different headings. To make the cross references even more useful and efficient, group section references, which cite the user to the principal statutory treatment of the subject, have been attached to many of our cross references; this provides the user with the option to ignore the cross reference altogether by going to the code for the cited material. Main headings were derived from the language of the Idaho Code, from the phraseology commonly used in the courts of Idaho and from terminology commonly used in the legal profession. In addition, an effort was made to employ phrases and terms commonly applied to Idaho Code sections, such as frequently used nonlegal terms. A thorough knowledge ofthe format and terminology ofthe Idaho Code is essential to the use of this index as a guide to subject matter. Afew basic rules for using this index are: (1) Gain familiarity with the contents ofthe Idaho Code and the index. Knowledge ofthe arrangement, terminology, topical treatment, analyses and reference system of both the code and the index is essential and must be acquired through examination and study. v VI FOREWORD TO THE INDEX (2) Consult the principal subject and not the secondary subject. Thus, for motor vehicle registration, look under motor vehicle registration and not under registration; for attorneys' fees, look under attorneys' fees and not under fees; for sales ofalcoholic beverages, look under alcoholic beverages and not under sales. (3) Lookfor the noun and not the adjective. Thus, forforeign corporations, lookunder corporations and not under foreign; for primary elections, look under elections and not under primaries. An exception to this rule is made for commonly used phrases orterms of art that are expressed in unitary phrases. Thus, for wrongful death, look under wrongful death and not under death; for declaratoryjudgments, look under declaratory judgments and not underjudgments. (4) Consult the mostpertinent subject. Thus, for claims against estates, look under decedents' estates and not under claims or creditors or liens. (5) Consult allied headings. If your search under one heading is to no avail, try another allied heading. Thus, if a search under the heading police is fruitless, try sheriffs or peace officers or law enforcement officers or other related headings. Each section has itemized entries, but perhaps they appear under headings that may not have initially occurred to you. (6) Use cross references. Pay close attention to and make full use ofthe index cross references.
