TO HARYANA GOVT. GAZ., FEB. 11, 2020 (MAGH. 22, 1941 SAKA) 25 REVIEW OF ANNUAL ADMINISTRATIVE REPORT OF LABOUR DEPARTMENT, HARYANA FOR THE YEAR, 2017. The 14th January, 2020 No. 2/138/2008-2 Lab.— 1. Sh. Pankaj Agarwal, IAS remained posted as Labour Commissioner, Haryana from 01-01-2017 to 31-12-2017. 2. The Administrative Control of the Department remained under Sh. Vijai Vardhan, IAS, Additional Chief Secretary to Government of Haryana from 01-01-2017 to 13-09-2017, Dr. Mahavir Singh, IAS, Principal Sectretary to Government of Haryana from 13-09-2017 to 31-12-2017. 3. During the year under report:- a. There were 4 work Stoppages/Lockouts during the year 2017. One work stoppage was resolved successfully, one work stoppage/Lockout was prohibited by the State Government and matter under dispute was reffered to Industrial Tribunal-cum-Labour Court, one work stoppage/lockout continued and one work-stoppage/lockout was prohibited by the State Government but management appeared in High Court & High Court granted stay. Matter is under process in the High Court. These work- stoppages affected 2685 workers and resulted in a loss of 178847 mandays. The loss of wages and production was Rs.3.37 Crore and 21.95 crore (Approx.) respectively. b. The conciliation officers of the department handled 5405 disputes. Out of these settlements were brought out in 1365 cases. 514 cases were withdrawn, 123 were filed/ rejected and 2831 were sent for adjudication and 572 disputes remained pending at the end of the year. c. 565 awards and 25 agreements were pending for implementation at the beginning of the year. 105 awards/ agreements were added during the year under review. Out of these 670 awards and 25 agreements, 44 awards/agreements were got implemented. Thus 626 awards and 25 agreements remained pending for implementation at the end of the Year. As such the percentage of implementation of awards and agreements comes to 6.33%. d. 2709 complaints of the workers regarding delayed payment of wages, less payment of wages, termination of services, leave and hours of work etc. were handled by the field staff of the department, of which 2422 were settled to the satisfaction of the workers leaving a balance of 287 complaints pending at the close of the year. As such 89.40 percentages of complaints have been settled. e. There were 6344 establishments employing 50 or more worker. Out of it 1858 industrial establishments had certified Standing Orders. 83 Standing Orders were certified during the year. Thus the number of certified Standing Orders at the end of the year rose to 1941 giving employment to about 297606 workers. f. At the beginning of the year there were 1675 registered Trade Unions in the State. During the year 28 new unions were registered and no union was de-registered thus at the end of the year the number increased to 1703. g. 578 new factories were registered and 45 Factories de-registered under the Factories Act, 1948. Thus the total number of registered factories rose to 12528 at the end of the year giving employment to 931929 workers. There occurred 121 accidents in registered factories during the year of which 56 were fatal and 65 were serious in nature. h. The Punjab shops and Commercial Establishments Act, 1958 remained applicable in whole of the State. The number of shops, commercial establishments, cinemas and hotels etc. were 449659 employing 18,61,364 workers. i. During the year under review 2663 inspections were conducted under various labour laws. 1572 prosecutions were launched and convictions were obtained in 1504 cases. As a result of it a sum of Rs. 36,43,250 lacs was realised as fine. Warnings after compliance of violations were issued in 943 cases to employer. j. An amount of Rs. 3028.13 lac has been disbursed to the workers under 22 Welfare Schemes of Haryana Labour Welfare Board during the year 2017 out of which an amount of Rs. 739.00 Lac was disbursed to the dependents/widows of deceased industrial workers and an amount of Rs. 550.29 lac has been spent under ‘Kanyadaan Scheme’ as Kanyadaan for self marriage in case of female workers and for the marriage of daughters of industrial workers. 1079 workers have been benefitted under Kanyadaan scheme. 26 SUPPLT. TO HARYANA GOVT. GAZ., FEB. 11, 2020 (MAGH. 22, 1941 SAKA) k. The Haryana Building and Other Construction Workers Welfare Board has come into force w.e.f. 02.11.2006. The Board is running various schemes for the welfare of building and other construction workers in the State like Finanacial Assistance for Education, Maternity, Marriage Assistance (Kanyadaan), Tools, Cycle, Financial Assistance in case of Accidental and Natural Death, Old age pension, Disability pension, Financial Assistance for Disabled Children etc., Special Financial Assistance for Women Construction Worker under the scheme Mukhya Mantri Mahila Sharmik Samman Yojna and Sewing machine is also being provided by the Board. In addition to these schemes the registered construction workers are also being provided health facilities at the work site through the Health Department, facilities of Mobile Toilets, Mobile Creche and Labour shed at Labour Chowks of the important towns of the State. The funds collected as cess is primarily utilized for the welfare of registered Building and Other Construction Workers. An amount of Rs. 119.79 Crore have been spent for extending benefits to 1,32,217 beneficiaries on welfare schemes during the period 1st January, 2017 to 31st December, 2017.
