These rules may be called the Haryana Anatomy Rules, 2002. Definitions. 2. In these rules, unless the context otherwise requires, (a) "Act" means the Haryana Anatomy Act, 1974. (Haryana Act 24 of 1974); (b) "appropriate authority" means the Director General Health Services being the Head of the Health Department. (c) "section" means a section of the Act; (d) "village officer" means the officer of local authority or Sarpanch of concerned village; (e) "words and expressions" used in these rules but not defined shall have the same meaning as respectively assigned in the Act; PART I] HARYANA GOVT. GAZ., JAN. 28, 2003 (MAGH. 8, 1924 SAKA) 51 Period for claiming dead body. Sections 2(e) and 10(2). 3. The body of a deceased person who has no. near relative shall be considered to be unclaimed if the same is not claimed by any of his near relatives within a period of twenty-four hours of the death. Information of death to authorized officer. Sections 7 and 10(1). 4. (1) Any officer of the department of police (Ilaka Incharge) or any officer of local authority (Sarpanch of the concerned village) or any village officer, village heads man (Chowkidar) who comes to know of the death of any person, in any public place in an area in which he had no permanent place of residence, shall report the fact to the authorized officer of that area without any further delay. Confirmation of unclaimed body shall be made by Civil Surgeon/Medical Superintendent/Senior Medical Officer/Medical Officer In -charge. (2) Without prejudice to the generality of the foregoing provisions, of the said act, the responsibility for immediately reporting the fact to the authorized officer in making arrangements for the removal of the dead body to the ,approved institutions shall be of the officer -in -charge of the Police Station having jurisdiction over the area or the village headman of the area, a the case may be, and in the meanwhile to prevent decay, he will send the dead body to the mortuary of the nearest teaching medical institute where arrangements for its preservation are available. (3) When a person or patient dies in a hospital or in a prison the authority in -charge of such hospital or prison shall immediately report the fact the nearest relative mentioned in the records of the deceased person or of the patient or of the prisoner. Preservation of unclaimed dead bodies. Section 10(1). 5. All the dead bodies received in an approved institution shall be kept in the cold storage mortuary until they are removed to the anatomy department of such institution. In the anatomy department, these shall be kept under suitable conditions at the discretion of the officer -in -charge of that department till these are put to any purpose specified in sub -section (1) of section (5) or till these are claimed, as the case may be. Disposal of decomposed bodies penalties. Section 10(1). 6. Decomposed bodies which cannot be used for any purpose whatsoever mentioned in sub- section (1) of Section 5 shall be returned to the authorized officer for such disposal. Period within which dead bodies may be claimed. Sections 2(e) and 10(2). 7. A dead body handed over to an approved institution may be claimed by a near relative of the deceased within a period of ninety-six hours of the death. No charges shall be payable by the near relative if the body is claimed within a period of twenty-four hours of the death. If the claim is made after the expiry of twenty-four hours after death, the near relative shall have to pay two thousand rupees towards preservation charges of dead body. Power of authorized officer. Section 3 and 10(1). 8. The authorized officer shall, for the purpose of clearing any doubt or setting any dispute whether a person is a near relative of the deceased, hold a summary inquiry. Such authorized officer need not record the oral evidence of witnesses but he shall maintain a memorandum of evidence and a list of representations and counter representations, if any. on the basis of which he arrives at the conclusion. Disposal of belongings of the deceased. Sections 3 and 10(1). 9. The belongings of the unclaimed body shall be disposed of by the authorized officer. 52 HARYANA GOVT. Nothing contained in these rules shall apply to cases where death has taken place under suspicious circumstances and the body is required for medico legal examination. In such cases if the police have not taken possession of it themselves, the body shall be handed over to the police. Repeal and savings. 11. The Punjab Anatomy Rules, 1966 in their application to the State of Haryana, are hereby repealed : Provided that any order made or action taken under the rules so repealed, shall be deemed to have been made or taken under the corresponding provisions of these rules.
