N. 3.—In pursuance of Section 106 of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India, hereby, publishes the judgment/order dated 30th September, 2016 of the Gauhati High Court in E.P. No. 04 (AP)2014 El Pet. 3/ 2016(Ghy) 241 GI/2017 (17) 18 THE GAZETTE OF INDIA : JANUARY 28, 2017/MAGHA 8, 1938 [PART II—SEC. (iii)] Election Pet 3/2016 BEFORE HON’BLE MR. JUSTICE M.R.PATHAK 30.09.2016 This election petition is pending since 15.07.2014. The petitioner was granted several adjournments enabling him to file affidavit-on-evidence. But, the same has not been filed by the petitioner till date. Mr. P Borah, learned counsel for the petitioner submits that the petitioner was informed on many occasions to file his evidence-on-affidavit but no reply has been received from him Mr. Borah also submits that on 22.9.2016 the petitioner was informed by registered post about the listing of the matter on 29.9.2016. But he did not receive any reply from the petitioner. Earlier the prayer of the respondent was rejected by this Court when the said respondent failed to file his affidavit in the matter within the time prescribed. Though the counsel for the petitioner prayed for some more time to file affidavit-on- evidence, the Court is of the view that since the counsel for the petitioner does not have any instruction from the petitioner inspire of several communication from their side, no further opportunity is to be granted to the petitioner to file his affidavit-on-evidence in this petition. Accordingly, this election petition stands dismissed with an exemplary cost of Rs.30,000/- to be paid by the petitioner to the State Legal Service Authority of Arunachal Pradesh at Itanagar on or before 31.10.2016.
