Ministry of Commerce vide Noti- fication No. GSR 686 in the Gazette of India, Part II; Section 3(i) on the 7th day of May 1966. 131 132 THE GAZETTE OF INDTA : JANUARY 28, 1995/MAGHA 8, 1916 [PART IT—SEC. 3(i)] 133 134 THE GAZETTE OF INDIA: JANUARY 28, 1995/MAGHA 8, 1916 [PART II—SEC. 3(i)] MINISTRY OF RURAL DEVELOPMENT (Department of Rural Development) New Delhi, the 12th January, 1995 G.S.R. 38.—Tn exercise of the powers conferred by the proviso to Article 309 of the Constitution and in supersession of the Department of Rural Development, Superintending Engineer and Assistant Engineer (Central Project Management Cell) Recruitment Rules, 1989, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Superintending Engineer, (Central Project Management Cell) in the Ministry of Rural Development (Depart- ment of Rural Development), namely :— 1. Short title and commencement.—(1) These rules may be called the Department of Rural Development, Superintending Engineer (Central Project Management Cell) Recruitment Rules, 1994. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Number of posts, classification and scale of pay.—The number of the said post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules. 3. Method of recruitment, age limit, and other qualifications etc.—The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule. 4. Disqualifications.—No persons,— (a) who has entered into or contracted a marriage with a person having a spouse living, or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post : Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do. it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commis- sion, relax any of the provisions of these rules with respect to any class or category or persons. 6. Saving,—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard. Transfer on deputation/Re-employment (for ex-service- men) : The Armed Forces Personnel who are due to retire or to be transferred to reserve within a period of one year and have the qualifications and experience prescribed for direct recruits under column 8 shall also be con- sidered. If selected such officers will be given depu- tation terms upto the date on which they are due for release from the Armed Forces; thereafter they may be continued on re-employment terms. In case such eligible officers have retired or have been transferred to reserve before the actual selection to the post is made, their appointment will be on re-employment basis. (Re-employment upto the date of superannua- tion with reference to civil post). (Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation/ department of the Central Government shall ordinarily not exceed four years. Note .—The proceedings of the Departmental Promotion Committee relating to confiimation of a direct recruit shall be sent to the Commission for approval. If however, these are not approved by the Commission a fresh meeting of the Departmental Promotion Committee to be persided over by the Chairman or a Member of the Union Public Service Commission shall be held.
